Urgent Appeal: उत्तर प्रदेश मे घर से बेघर कर, बच्चे, वृद्ध, महिला, और पुरुष को अमानवीय तरीके से मारने पीटने के सम्बन्ध मे


उत्तर प्रदेश मे सोनभद्र जिले के चुर्क थानान्तर्गत चुर्क बाजार का दक्खिन टोला मे वन विभाग की पुलिस द्वारा बिना नोटिस के घर गिराकर उन्हें घर से बेघर कर, बच्चे, वृद्ध, महिला, और पुरुष को अमानवीय तरीके से मारने पीटने के सम्बन्ध मे-

4 मई, 2018 को मानवाधिकार जननिगरानी समिति की प्रशिक्षित मनोसामाजिक कार्यकर्ता की टीम पीडितो को टेस्टीमोनियल थेरेपी द्वारा सम्बल और मनोसामाजिक सहायता देने पहुची|  इससे पहले समिति के सोनभद्र जिला प्रभारी घटना का फैक्ट- फाइंडिंग और मौका का जायजा लिया था| वही घटना के बाद 15 दिन तक विस्थापित लोग को सुशील त्रिपाठी जन मित्र शिक्षण केंद्र पर  अल्पकालिक आश्रय दिया गया|

तथ्य विवरण

सोनभद्र जिले मे मकान न० 291 वार्ड न० -5 पोस्ट चुर्क बाजार जिनकी जनसंख्या लगभग 200 के आस पास 35 घर के लोग कई पुश्तो से इस बंजर जमीन खाता संख्या 00387 पर अपना घर बनाकर निवासरत थे उन्होंने मेहनत मजदूरी से अपनी गृहस्थी बसा ली थी |
बिना नोटिस दिये अचानक 4 सितम्बर 2017 को वन विभाग की पुलिस इनकी बस्ती मे जे.सी.बी के साथ आई और आकर गैर -कानूनी तरीके से तोड़ फोड़ करने लगी जब इसका विरोध समुदाय के लोगो ने किया तो वन विभाग की पुलिस गाली गलौज करने व अभद्रता पर उतर गयी सबसे ज्यादा अफ़सोस की बात यह है की बूढ़े, बच्चे, महिलाये और पुरुष सभी को बुरी तरह से मारा पिटा गया और अभद्र व्यवहार किया गया| वे लोग अपने साथ सभी के घर से सामान तक उठा ले गये जब समुदाय के लोगो ने इसका विरोध किया तो लोगो के अन्दर दहशत पैदा करने के लिये कुछ लोगो को जेल भेज दिया|
जबकि बस्ती के पास बहुत सारे लोग है जो बंजर जमीन पर पुश्तो से दुकान, घर पर काबिज है पर पुलिस और वन विभाग से उनको नहीं हटाया| वहा रहने वाले सभी निवासियों का उसी पते का निवास प्रमाण पत्र, वोटर कार्ड सहित सभी दस्तावेज में वहीं का पता दर्ज है | कुछ लोगो का नाम कुटुंब रजिस्टर मे भी अंकित है |

पुलिस वालो ने घर से बेघर कर घनघोर जंगल की और खदेड़ दिया: ग्यास जान उम्र -52 वर्ष पुत्र श्री सजब निवासी- ग्राम- चुर्क बाजार, थाना- राबर्सगंज सोनभद्र का रहने वाला हूँ|  

4 सितम्बर, 2017 शाम को 13 थाना की पुलिस मेरे टोले मे आयी, मैंने सोचा की हो सकता है किसी मामले मे आये होगे गाँव मे जब बुलडोजर देखा तो मै चौक गया की ऐसी कौन सी बात है जो पुलिस वाले अपने साथ बुलडोजर भी लेकर आये है|

वो लोग आते ही तोड़ फोड़ शुरू कर दिये तब मैंने हिम्मत जुटाकर पूछा की साहब क्या बात है जो हम लोगो के मकान को आप बुलडोजर लगा कर क्यों गिरा रहे है इतना सुनते ही पुलिस वाले लाठी -डंडे से बेरहमी से मारने लगे और हमको उठाकर जमीन पर पटक दिये जिससे मेरे पीठ मे गिट्टी धस गया|  मै बहुत तेजी से चिल्लाया पर पुलिस वालो को जरा सा रहम नही आया मेरे ऊपर मै उस समय बहुत मजबूर था मै सिर्फ पुलिस का मार खाता रहा और चिल्लाता रहा|

पुलिस वाले बड़ी बेरहमी से मेरा घर बुलडोजर से तोड्वा दिये जिसमे घर का सारा सामान दब गया और जितना कीमती सामान था सब उठा ले गये और घर मे रखे हुये राशन को बाहर फेक दिये और मुर्गा का बच्चा व बकरी का बच्चा दबकर मर गया, मै पुलिस वालो का हाँथ पैर जोड़ता रहा पर पुलिस वालो को मेरे लिए कोई रहम नही आया, मेरा सब कुछ लुट गया हमे पुलिस वाले माँ बहन की भद्दी -भद्दी गाली देते हुये घसीटकर रोड पे ला दिये और रोड पे लाठी से मारने लगे मै उस समय हाँथ जोड़कर दुहाई देता रहा पर पुलिस वाले मुझ निहायत गरीब की बात एक न सुने मै व मेरे परिवार वहाँ से 10 किलोमीटर दूर घर से घनघोर जंगल मे चले गये पुलिस वाले सुबह का आये हुये थे शाम को 8 बजे गाँव से गये पर एक भी घर को नही छोड़ी पुलिस वालो ने सब घर बुलडोजर से गिरा कर शमशान बना दिये और वहाँ से हमे खदेड़ कर जंगली जानवर समझकर हमे जंगल मे हांक दिये घनघोर जंगल मे जाकर दर -दर भटक कर ठोकरे खा रहे है| जब पुरुआ हवा जब चलता है तो पुरे शरीर मे बहुत तेज दर्द होता है और हाँथ पैर कापने लगता है| जंगली जानवर से भी डर लगता है पर मेरी मजबूरी है की मै घनघोर जंगल मे रात दिन किसी तरह बिता रहा हूँ |

पुलिस वालों का खौफ इस तरह बैठ गया लोग काम पर जाना छोड़ दिए: सजब मेरा उम्र लगभग 60 वर्ष है मेरे  परिवार में चार लड़के तीन लड़कियां है मैं ग्राम चुर्क मकान न०-291 वार्ड न०-5 पोस्ट- चुर्क  बाज़ार जिला -सोंनभद्र का रहनें वाली  हूँ|  मैं आज भी बनी मजदूरी करके अपने बच्चों के सहयोग से परिवार चला रही हूँ |

पुलिस वालों ने भद्दी भद्दी गाली देते हुये  बोले  की यह जमींन यहाँ छोड़कर भाग जाओ पुलिस वालों की बात सुनकर हम सारे बस्ती के लोग उनके पैरों पर गिरकर दया की भीख मांगने लगे | पुश्तो से जिस जमींन पे अपने लहू पसीने से सींच कर जो घर बनवाई हम लोग कहा जायेंगे इतना कहते ही पुलिस वालों ने जबरदस्ती औरतों व बच्चियों का  हाथ पकड़ते हुए बेरहमी से घसीटते हुए घर से बाहर निकाल दिए|

उस समय हम लोग गुहार लगाते रहे सभी औरते बच्चे बिलखकर रो रहे थे | पुलिस वालो को उनके  आंसू पे भी रहम नही आया | वह बुलडोजर बुलवाकर पुरे घर को एक तरफ से वीरान करना शुरु कर दिये|यह देखकर हम लोगो का कलेजा बैठ रहा था | कई औरतों को चोट भी लगा व प्रसाशनिक विभाग को जरा सा रहम नही आया | हम लोग जो बनी मजदूरी करके जो अनाज बर्तन घर में रखे थे उसे भी उन लोगो ने तोड़ फोड़ दिया सारा अनाज बच्चों की किताबे व घर के और सामान सब कुछ बर्बाद कर दिया | मुझे भी चोट लगी मै भी दर्द से कराह रही थी फिर भी उनको मुझ पर  दया नही आयी |वहा से सांकल भठवा  टोला (जंगल) में परिवार ले कर गयी  वहा पुलिस वालों की खौफ  थी  वहाँ  भी हम लोगों को सिर छुपाने  की जगह नही मिल रही थी किसी तरह झुग्गी झोपडी बनाकर अपना जीवन गुजार रहे थे की वहाँ भी पुलिस वालों की लाठियों की कहंर टूट पड़ी| उनकी मार से मेरे अब्बा जौहर की मौत हो गयी | उससे हम लोग बिलकुल टूट गये|

पुलिस वालों का खौफ इस तरह बैठ गया लोग काम पर जाना छोड़ दिए पता नही हमारे जाने के बाद हमारे परिवार का क्या हाल होगा डर से रात में नींद  नही आती भूख नही लगता| पानी काफी दूर से लाना पड़ता |कभी कभी कभी बिना खाये सो जातें थे जब बच्चे भूख से कराहते थे तो आँख से आंसू निकल पड़ता था उनके दर्द को बर्दास्त नही कर पाते थे यहाँ  तक की हम लोग कोई सामान बाज़ार से भी नही ले पाते थे | पुलिस वालों का बहुत बड़ा डर था कि कही हम लोगों पे फर्जी केस  लगाकर थानें में बंद न कर दे आज भी हम लोग असुरक्षित है| हमारे पास रहने को घर नही है | हम लोग किस तरह अपने परिवार के साथ  सुनसान जंगल व खतरनाक जानवरों के बीच अपना जीवन बिता रहें हैं| यह खुदा ही जानता है |

ताबड़ तोड़ पुलिस वालो ने लाठी डंडा से मारते हुये घर से बेघर कर घनघोर जंगल की ओर खदेड़ा  चुर्क गाँव के 35 घरो मे पुलिस के खौफ से लोग घर से बेघर हो गये साथ ही इमाम पिता मोहम्मद को भी पुलिस वालो ने तोड़ फोड़ करते हुये भद्दी -भद्दी गालिया देते हुये लाठी डंडे से इतना बेरहमी से मारे इमाम का दाया हाँथ टूट गया व घुटना मे भी बहुत चोट आ गया पुलिस की मार से आज तक इमाम अपाहिज हो गया घर से बेघर होने का दर्द व शरीर से अपाहिज होने का दर्द लोग सहने मे अक्षम हो गये इस समय अपने परिवार बच्चो को लेकर लोग खुले आसमान के निचे दर से बेदर भटक रहे है |यहा तक की प्रशासन ने इतनी हदे पार कर दी लोगो के पास मरहम तक नही था लगाने के लिये कई दिनों तक लोग भूखे प्यासे मरते रहे कई बच्चे भूखे मर गये यहा तक की लोग पानी भी पिने के लिये तडपते है आज समुदाय के लोग इस हालत मे जी रहे है प्रसाशन ने अपनी बड़ी चालाकी से साजिस चुर्क बस्ती के लिये की है इस तरह लोगो को घर से बेघर कर मारने के लिये ताकि लोग तडप-तडप कर मर जाये और प्रशासन बेदाग बच जाये इस घटना से करीब 35 घर प्रभावित हुये है

Again PVCHR rescued 6 bonded labours

PVCHR rescued 6 bonded labours (village Jodhkapurwa, Post- Jhingur, Thana- Maheshganj, Kunda, Pratapgarh) from DBF Marka brick kiln village Virbhanpur under Lohta jurisdiction of Varanasi district. Dr. Lenin Raghuvanshi, Member of the District Vigilance Committee Bonded Labour abolition Act wrote letter to District Magistrate on the behalf of affidavit of bonded labour for the immediate rescue of the labour. The team from PVCHR (Shiv Pratap Chaubey, Chhaya Kumari and Farhat Saba Khanam), Labour enforcement officer and Tehsildar did the rescue.

Gender and Torture Rehabilitation: Towards a Common Approach

Studies reveal that a significant number of torture survivors are female, yet, for many reasons, torture is often underreported among female survivors. Women are less likely to seek support or redress, often due to complex legal, societal or cultural reasons. As a response, IRCT centres from around the world have adopted gender-based principles, sharing their experiences on how they are pioneering unique ways of addressing these barriers 

Data from IRCT member centres has shown that female survivors of torture suffer from a wide array of gender and sexual-based torture including sexual humiliation and molestation, forced nakedness, rape, forced sterilisation or castration, and, forced prostitution or sexual slavery. 
The impact of torture extends beyond the immediate physical and psychological pain. It has the ability to profoundly corrode the personal identity of victims and affects their ability to sustain familial and social relationships, pursue employment and maintain daily routines. Many IRCT member centres report that female victims can often feel intense humiliation, shame, guilt and isolation. 

Given the multi-faceted consequences of torture and the unique complexity of each victim, individually-tailored and holistic rehabilitation is essential if survivors are to heal their wounds. This requires a complex range of immediate and comprehensive services that range from medical support and psychological counselling to family and community interventions, as well as legal and economic assistance. 

However, women often face practical barriers to accessing the appropriate support to begin the healing process. Many women have difficulty speaking about extremely traumatic experiences or refrain from seeking help because of societal, cultural or familial factors. “Female victims often feel more stigmatized and therefore do not receive treatment,” said Shirin Shabana Khan, from IRCT member centre PVCHR based in Varanasi, India.

In response to these specific challenges, five IRCT member centres from Asia, Europe, Latin America, Africa and the MENA region came together to share their experiences and adopt a set of principles on gender-sensitive rehabilitation. These principles include ensuring that women have access to services, that staff are trained in gender-sensitive approaches, that rehabilitation is tailored to the individual needs of the victim, that steps are taken to provide social support to mitigate stigma, and that advocacy work includes gender-sensitive components.

Some IRCT centres have noted that adopting gender-based policies have helped shed light on previously unknown areas and have as such had a transformative effect on how services are provided to clients. “After the implementation of gender policies, we changed our approach and suddenly noticed that more than 90% of the secondary patients are female,” said Shirin Shabana Khan. 

 “These principles will solidify the excellent work being done by centres from around the world and ensure that we all benefit from each other’s expertise”, said Lisa Haagensen, GATE Project Manager at the IRCT. “They will guide us in providing better services to support life after torture, which is ultimately, what we all aspire to achieve”.

PVCHR Released of thirteenth bonded and bonded child labour

On 3rd July, 2018 PVCHR team (Shiv Pratap Chaubey, Chhaya Kumari and Farhat Saba khanam) along with the SDM, Rajatalab, Labour enforcement officer rescued 13 bonded labour including 4 child labour and 19 pony from the brick kiln of Surya marka Nidaura, Kashipur under jurisdiction of Rohaniya police station in Varanasi district. On 27th June, 2018 Dr. Lenin Raghuvanshi, Member of District Vigilance Committee under Bonded Labour abolition Act wrote letter to District Magistrate on the behalf of affidavit of bonded labour.

  In the first feature chapter, Archana Kaushik, Lenin Raghuvanshi and Mohanlal Panda explore the practice of untouchability through the experience of one Indian village. Though constitutionally outlawed, the practice is deeply ingrained in Indian culture. It has its roots in the caste system, a traditional form of apartheid. “Dalits,” who are at the lowest rung of caste hierarchy, typically experience discrimination and social exclusion in a myriad of ways. The Dalits in the village lived in thatched houses at the periphery of the village, and their children were denied immunization, supplementary nutrition and schooling because upper-caste health care and education workers dread the prospect of sullying their spiritual purity through physical contact with the Dalits. The chapter recounts the experience of the People’s Vigilance Committee on Human Rights (PVCHR), a nongovernmental organization (NGO), in breaking down the barriers that hindered the Dalits from enjoying their most basic rights through the mobilization and empowerment of the Dalits to voice their concerns and fight for justice.

Sir and Madam,

Greetings from City of pluralism, diversity and inclusiveness: Varanasi in India.

Varanasi, one of the oldest and continuously inhabited cities in the world is known also as Banaras or Kashi and incorporates the different schools of thoughts, religions which makes it the centre of attraction among people across the globe.

India is a land of diversity with great and long History populated by many different peoples, from many different origins, and who have many different religious, political and philosophical views. Many abuses are committed against peoples due to their caste or their religion and nature is more and more systematically ransack for privates interests.

The mains problems facing the country came from two things: the implementation of a "culture of impunity based on mind of caste with silence " - which is a sharing believe that few can act without be accountable for their actions – at the social, economic and political level, and the meet of this cognitive problem with a context of market democracy and economic globalisation.


After that, we will take time to propose a way to change this situation by calling for the creation of a "neo-Dalit" movement – combining shudras and anti-shudras from all regions. We will also try to explain why this popular movement seems to be the best way to remove this "culture of impunity" and how opinion leaders from all communities have a great role to play on this major gathering.

We believe that many problems that India faces today are linked together and therefore cannot be separated, both in understanding and resolution. For that reason, we believe that the most effective way to resolve them is to address the problem in a comprehensive approach that takes into account the political, economic and sociological and seeks solutions which take care of those different "linked problems", based on a popular movement.

This shall help to put an end to corporate fascism arising out of casteism, sectarian thinking, neoliberal economic policy and communal fascism.

Therefore in this context, Neo Dalit Consultation has been called upon on occasion of Quit India Movement, August 09, 2018 at the Moolgadi Kabirchaura Math,Kabirchaura, Varanasi,India at 11 am.  It is one step after Banaras Convention further for better India for better world.

प्रिय सम्मानित साथी,

        वाराणसी, जो बनारस या काशी के नाम से भी मशहूर है यह दुनिया के सबसे पुराने शहरों में से एक है | जो 11 वीं शताब्दी ईसा पूर्व से काशी एक आध्यात्मिक सांस्कृतिक नगरी के रूप में भी जानी जाती है | विभिन्न धर्मावलम्बियों के विचारों का केंद्र होने, अपनी साँझा संस्कृति गंगा जमुनी तहजीब और बहुलतावादी संस्कृति के साथ ही साथ यह अपने पवित्र गंगा घाट के कारण दुनिया में लोगों के बीच आकर्षण का केंद्र बना है |

        जहाँ एक तरफ पुरातन समय से हर धर्म और जाति में समुदायों के बीच में आपस में एक दूरी बनाई गयी है जिसकी वजह से इनमे कभी समन्वय स्थापित नहीं हो पाता है | इसलिए काशी से "नव-दलित" आंदोलन का आगाज़ करने हेतु एक बेहतरीन मंच बन सकता है जिसके माध्यम से हम आपसी एकता और एकजुटता को बढ़ावा दे सकते है |

        9 अगस्त 1942 को भारत छोड़ो आंदोलन की शुरुआत की गयी थी इसी ऐतिहासिक दिन के उपलक्ष्य में वाराणसी के मूलगादी कबीरचौरा मठ में 9 अगस्त 2018 को नव दलित सम्मेलन का आयोजन किया जा रहा है जो एक बेहतर भारत और बेहतर दुनिया के लिए बनारस सम्मेलन के बाद यह एक कदम आगे बढ़ने जा रहा है।

सभी 'टूटे हुए लोगों' औरप्रगतिशील लोगोंकी एकता दण्डहीनता की संस्कृति वंचितिकरण के खिलाफ लड़ने का सबसे अच्छा तरीका है, क्योंकि कि यह परिवर्तन उन लोगों से ही नहीं आएगाजो इस प्रणाली से लाभ उठाते हैं | इसलिएसंरचनात्मक परिवर्तन केवल सामाजिक पिरामिड के नीचे से ही आना चाहिए | इस आंदोलन को 'नवदलितकहने का तात्पर्य यह है कि भारत में दलित समुदाय ही है, जो सबसे ज्यादा पीड़ित है और दलित आन्दोलन दुनिया का सबसे उत्कृष्ट अहिंसात्मक परिणामदायी आन्दोलन रहा है |
नवदलित आंदोलनको करने का उद्देश्य राजनीतिकआर्थिक और सामाजिक स्थितियों में न्याय समता के परिप्रेक्ष्य में बदलाव लाना प्रमुख है | सबसे पहलेहम कानूनी प्रक्रिया द्वारा राजनीतिक दमन और दण्डहीनता के खिलाफ लड़ सकते हैं | कई मानवाधिकार संगठन पहले से ही 'कानून के गलत नियमों का सम्मान करने वाले ब्राह्मणवादी सोच (पुरोहितवादी सोच) को चुनौती देते हुए सरकार से न्याय पर आधारित कानून के राज को स्थापित करने के लिए संघर्ष कर रहे हैं | वही दूसरी ओर हमें संज्ञानात्मक कमजोरी को बदलकर सामाजिक दण्ड को हराना होगाक्योकि जातिवादी संग्यनात्मकता ने लोगों को अपनी हीन भावना का शिकार बनाया है औरचुप्पी की संस्कृतिको बढ़ावा दिया है | आज हमें नव दलितों के लिए एक आम मंच बनाने की जरूरत है जिससे यह चुप्पी की संस्कृति की दीवार तोड़ी जा सकेजो यथास्थिति के प्रति स्वीकार्यता की राह प्रशस्त करता है | ऐसे में हमें इस आन्दोलन को आगे बढ़ाने के लिए संवाद की प्रक्रिया शुरू करनी चाहिए जो उन्हें सिखाएगी कि संवैधानिक रूप से हम सभी समान हैं |
नवदलित आंदोलन वंशजातिधर्म और लिंग पर आधारित भेदभाव का सामना करने वाले सबसे हाशिए पर पड़े लोगों के लिए उम्मीदसम्मान और मानवीय गरिमा का प्रतीक है | दण्डहीनता चुप्पी की संस्कृति के खिलाफ न्याय, क्षमा याचना न्याय पर आधारित नेल्सन मंडेला के संघर्ष का माडल है |  जाति व्यवस्थासामंतवादसांप्रदायिक फासीवाद और नवउदारवाद के खिलाफ विभिन्न समुदायों में एकता लाने के लिए एक पहल है | यह भविष्य में दुनिया में बहुलवादी लोकतंत्र सभी को तरक्की में योगदान करने की उम्मीद पैदा करता है।
