| I am directed to say that the matter was considered by the Commission on 24/08/2021 and the Commission has directed as follows.: |
| The Commission has received a complaint from Dr. Lenin Raghuvanshi, a human rights activist regarding custodial death of an Under Trial Prisoner, Surajpal S/o Sundar Singh, of the District Jail Etah (Aligarh) on 09.08.2020. The complainant has alleged that the victim boy was beaten up brutally by the Aliganj Police officials when he had gone out to buy some food items during the lockdown. The complainant has further alleged that the injured boy was admitted in the hospital and later he succumbed to his injuries. The complainant has sought intervention of the Commission in the matter. The Commission took cognizance of the matter and directed the District Magistrate (DM) Ambedkar Nagar (Uttar Pradesh), Senior Superintendent of Police (SSP) Ambedkar Nagar (Uttar Pradesh) and Superintendent of District Jail Etah (Aliganj) (Uttar Pradesh) to send the requisite reports to the Commission. Registry was also directed to take up the matter with the Uttar Pradesh State Human Right Commission to enquire whether they have taken cognizance of this case of judicial custody death, if so the date of cognizance to be obtained from the Uttar Pradesh Human Rights Commission. Since no report has been received from the concerned authorities, let a reminder be issued to the District Magistrate (DM) Ambedkar Nagar (Uttar Pradesh), Senior Superintendent of Police (SSP) Ambedkar Nagar (Uttar Pradesh) and Superintendent of District Jail Etah (Aliganj) (Uttar Pradesh), for submission of the following reports within six weeks positively:- i. Initial health screening report, as per NHRC format.(including report of previous jail, if applicable). ii. Complete medical treatment records, including previous jail, if applicable. (a brief medical summary in chronological order should be made available mentioning ailment(s) and in-door/outdoor treatment given to the deceased). iii. Inquest panchnama. v. CD of postmortem examination. vi. Chemical examination of viscera (if applicable). vii. Histopathology examination of viscera (if applicable). viii. Final cause of death based on FSL report (if applicable). Following reports, if applicable, may also please be sent: i) Action Taken Report on the Magisterial Enquiry Report. ii) Final Outcome/Status of Departmental action or criminal proceedings. iii) CB/CID Inquiry Report, if applicable. Since, no report has been received from the Uttar Pradesh Human Rights Commission, let a reminder be issued to Registrar/Secretary, Uttar Pradesh State Human Right Commission to enquire whether they have taken cognizance of this case of judicial custody death, if so the date of cognizance to be obtained from the Uttar Pradesh State Human Rights Commission, within six weeks positively. |
| 2. It is therefore, requested that the additional/complete report as directed by the Commission in the matter be sent latest by 15/10/2021, for futher consideration by the Commission. |
