Interim relief of 15 hundred thousand INR to the family of three survivors: Intervention by the NHRC on the complain of PVCHR

Proceeding order: This is a complaint received from a Human and Social Right Activist forwarding print media report regarding death of 3 persons due to electrocution when a HT cable of 11 KV fell upon them. The complainant desires inquiry, against the erring officials and compensation to the next of kin of the deceased. Taking cognizance, notice was directed to the concerned authorities. Pursuance thereto, the commission received a report dated 05-06-2021 from the office of Superintendent of Police, District Balia (UP) forwarding inquiry report of C.O. dated 26-05-2021. As per the report, the accident occurred when all three victims were on a motor bike and the HT cable of 11 KV fell upon them. The police has registered an FIR No.38/2021 under section 304 of IPC against the concerned official including J.E., SDO, Executive Engineer etc. and investigation pending. No statutory report of the Chief Electrical Inspector is received despite notice issued to CMD, UPPCL. Issue reminder to the CMD,UPPCL for submission of requisite report along with details of compensation, if any, paid to the NoK of the victims within four weeks failing which the Commission would be constrained to invoke its coercive power u/s 13 of the PHR Act,1993 calling for the personal appearance of the authority concerned before the Commission.
