Introduction:

In the pursuit of justice and accountability, the tragic incident of three sanitation workers losing their lives inside a sewage tank in Singrauli district, Madhya Pradesh, serves as a compelling case study. This article explores the details of the case, the legal actions taken, and the analysis of the compensation provided to the victims' families, reflecting excellence on a global scale in addressing such heart-wrenching incidents.

The Case:

The complaint, filed by Lenin Raghuvanshi on behalf of PVCHR, was based on a news report that three sanitation workers had died due to asphyxiation from toxic gases while working for a company hired by the Municipal Corporation to clean an underground sewage tank. The complainant sought compensation for the families of the deceased workers and requested the filing of a complaint against the responsible company.

Initial Response:

Following the directives of the Commission, the Commissioner of Municipal Corporation, Singrauli, submitted a report on 17th October 2022. According to the report, the sewer project in Singrauli city was under construction, and no sewer cleaning work was ongoing at the time. The tragic incident occurred during the repair of a manhole, and the contractor, M/S K.K. Spun India Limited, had provided Rs. 4,00,000/- each to the dependents of the deceased workers, with proof of payment attached. In total, the three dependents received a compensation of 42 lakhs.

Additionally, the Vice President of the National Commission for Safai Karamchari directed several actions, including the initiation of an FIR, payment of Rs. 10 lakhs each to the dependents of the deceased workers under the M.S. Act, 2013, job opportunities for family members, and medical treatment for two minor daughters of one deceased worker who were blind by birth.

Subsequent Developments:

The National Human Rights Commission (NHRC), through its proceedings on 20th January 2023, directed the SP of Singrauli, Madhya Pradesh, to submit a detailed report regarding the lodging of the FIR within four weeks. It also instructed that a copy of the report from the Commissioner, Municipal Corporation, Singrauli, be sent to the complainant for comments, if any, within the same time frame.

However, as of the most recent update, the awaited report from the SP, Singrauli, and comments from the complainant on the Municipal Corporation's report have not been received.

The Commission's Analysis and Conclusion:

Upon comprehensive analysis of the reports received, the NHRC made several key observations and determinations. Firstly, it noted that an FIR had already been lodged under sections 304 and 34 of the Indian Penal Code, 1860, related to the incident.

Furthermore, the NHRC considered the compensation provided to the victims' dependents, including Rs. 4 Lakhs from M/S K.K. Spun India Limited and 10 Lakhs from the state government as per the M.S. Act, 2013. The Commission also acknowledged the effort to secure better medical treatment for the two minor daughters of one of the deceased workers.

Additionally, it recognized that the family members of the deceased workers had been provided with job opportunities by the Municipal Corporation, Singrauli, Madhya Pradesh.

Conclusion:

The tragic deaths of three sanitation workers in a sewage tank in Singrauli, MP, serve as a stark reminder of the need for worker safety and accountability. The actions taken by authorities, including compensation and job opportunities for the families, reflect an important step towards justice.

While the case was investigated thoroughly and appropriate actions were taken, it is essential for all stakeholders to remain vigilant in preventing such incidents in the future.
