Sir/Madam, 

         The case No. 1394/20/5/2022 in respect of DR LENIN RAGHUVANSHI CONVENER PVCHR, was placed before the Commission on 23/08/2022. Upon perusing the same, the Commission directed as follows: 

         The Commission received a complaint from Dr. Lenin Raghuvanshi, a human rights activist from Varanasi, Uttar Pradesh referring to a news report published in Dainik Bhaskar on 08.04.2022 revealing that a girl student of DPM College, Bharatpur, Rajasthan has been subjected to torture in the name of raging due to which the girl student died. The complainant thus, requested the Commission to intervene into the matter.

Accordingly, the Commission vide proceeding dated 19.05.2022 called a report from the Principal Secretary, Department of College Eduation, Government of Rajasthan and the Superintendent of Police, Bharatpur, Rajasthan.

Pursuant to the aforesaid directions a report has been received whereby it is stated that on the basis of information received, the girl-victim was being eve teased by some boys who were troubling the victim and used to pressurize the victim to have a relation with them. A case was registered U/s 143,341,328, 306 IPC and statements of the victim's father and mother were recorded U/s 161 Cr.P.C. Further, a number of witnesses have also been examined and their statements were recorded and also were video graphed. The post mortem report of the victim was also obtained from RBM Hospital and viscera samples were also sent to SMS Hospital Jaipur and also to FSL Bharatpur.

The students who were studying with the victim, namely, Bhavna Saini and Raveena Gujar and those students who used to travel with the victim, namely, Radha, Neetu and Komal their statements have also been regarding the incidents that transpired on 05.04.2022, which has revealed that the victim was neither chased nor harassed while she was coming back from college nor was she forcibly made to drink or eat anything.

Notably, the report states that the witnesses Chandrabhan and Amit in their statements have said that on 04.04.2022 the accused Naresh and Vikam had come the deceased's college and harassed her. The said accused was also interrogated and information elicited from them has also been taken on record. The reports from SMS Hospital Jaipur and FSL Bharatpur are awaited.

In view of the detailed report, the Commission is of the considered view that no further intervention of the commission is required in the matter, as the investigation is conducted in a fair manner and the Law shall now take its due course.

As far as the arrest of the accused persons is concerned, they be arrested forthwith and investigation be completed at the earliest in the case.

Let the State Government show cause within 6 weeks, as why a compensation of Rs. 10 lakhs should be ordered to the next of kin of the victim.
