dated 28.06.2018, the Commission had recommended to the Govt. of Uttar Pradesh
to pay a sum of Rs. 3 Lakhs as monetary compensation to the NoK of the deceased
Balveer. The Chief Secretary, Govt. of Uttar Pradesh was directed to submit compliance
report along with proof of payment within 6 weeks.
Pursuant to the directions of the Commission, Under Secretary, Govt. of Uttar Pradesh vide communication dated 17.10.2018 conveyed the sanction accorded by the State Government for payment of compensation of Rs. Three Lakhs as monetary compensation to the NoK of the deceased Balveer.
Superintendent, District Jail, Etah has now endorsed to the Commission a copy of the communication dated 07.03.2019 addressed to the District Magistrate, Etah requesting him for identification of the NoK of the deceased so that the payment of compensation could be made.

LUCKNOW: The death of the Etahundertrial is another example of barbarism and beastly manner in which state police deals with ordinary citizens implicated in criminal cases. Balvir, 28, the murder-accused who died at the surgery department of King George's Medical University, Lucknow on Friday morning had been tortured severely. Father of a one-year-old girl child, Balvir was holed up in custody of Awagarh police for four days, where cops of Etahdistrict subjected him to painful torture.
Corroborating these allegations of the family, the deceased's injury report shows severe wounds around the genitals. Deceased was not a hardcore criminal but cops at Awagarh police station subjected him to inhuman treatment and torture of the extreme kind after having booked him in a murder case on the basis of his cell phone location and statements issued by some persons from his village. Deceased had been picked from his residence at Isauli village in Sakrauli area of Etah on April 20 in connection with murder of his cousin brother. Awagarh police was investigating the case and had kept the deceased in lock-up for four days before sending him to jail, allegedly.

The atrocity of police and jail authorities in the district that supports heavyweights ofSamajwadi Party was evident from Balvir's haemoglobin level. Doctors in several hospitals where he was admitted for treatment before being brought to the KGMU's surgery department, refused to operate upon him. On May 15, Balvir was referred to KGMU's surgical gastroenterology department by PGI.
Doctors usually do not operate on patients having less than 10gm hemoglobin level, whereas Balvir's count at the time of admission was 2.5gm. Nonetheless, Balvir was examined by doctors. Wounds were found in the middle of root of the scrotum and anal opening that extended up to 5 cm into the anal canal. Tarry stool containing blood was present in the anal area of the deceased. Deceased also sustained surgical emphysema on the right side of his abdomen, said a doctor who examined him. "The wounds could not have been self-inflicted," he added.
The autopsy took place at KGMU's mortuary around Saturday noon and the report mentioned septicaemia as the cause of death. Deceased was also found suffering from chronic lung and kidney diseases.
The body was handed over to the deceased's family members in Etah on Saturday evening.
Shailendra Kumar the sub-inspector who allegedly tortured the deceased in custody could not be arrested on Saturday. Ashutosh Pandey, inspector general of Agra zone police, said sections in the first information report will be revised accordingly after police receives copy of the report. Pandey added that a home guard who was also involved in the act had been arrested.
Therefore it is kind request
1. To conduct an inquiry in this incident of custodial death under section 176(1)A Cr.PC by a Judicial Magistrate.
2. To provide compensation to the victim's family.
3. To ensure Videography of the Post-Mortem Report of the victim& the same is informed to NHRC.
4. To inquire the reason for the death of several prisoner through tuberculosis.

For this interview on Relentless Minds I traveled (virtually) to India, and interviewed long-time activist and change maker Lenin Raghuvanshi. Lenin is the cofounder of PVCHR (People’s Vigilance Committee on Human Rights) Founded with his wife Shruti in 1996. PVCHR is a community-based organization, which focuses on breaking the feudal hierarchies of conservative slums and villages in India by building up local institutions and supporting them with a high profile and active human rights network. The ultimate mission is to provide basic rights for all and to eliminate situations that give rise to exploitation and marginalized groups. Lenin’s principle focus is on advocating for the basic rights of marginalized groups in India’s society and over the last 25 years of work he, along with his wife through PVCHR, has managed to impact 200 communities and thousands of individuals. During this interview Lenin discusses the injustices that the Dalits and women experience through the caste system and the influences that continue to oppress marginalized communities, as well as the actions that PVCHR has taken to uplift these communities and fight against the caste system.
