Interview: There are no rights without accountability and transparency

(July 17, 2017, Varanasi, Sri Lanka Guardian) “Accountability and transparency are important values for me. There are no rights without accountability and transparency. If as a human rights organization, we are asking for accountability and transparency by the government and corporation, so we need to implement ourselves too,” Lenin Raghuvanshi an eminent human rights defender based in #Varanasi, India told in an interview with the Sri Lanka Guardian’s recently launched initiative “Redefining the Civil Societies in Asia.”

“The people must believe in themselves. The need of the hour is to create new dynamics and debate for plural, humane and inclusive world”, he said

“Our forefathers were freedom fighters. Three of them rose against the tyranny of the Raj in 1857 and were executed,” Lenin recalled his ancestors.

The awards winning defender sat with Nilantha Ilangamuwa of Sri Lanka #Guardian to talk the variety of issues in the area he works.

विश्व के सबसे बड़े लोकतान्त्रिक मुल्क को आज़ाद हुये 70 साल से ज्यादा बीत गए है, पर अभी भी मुल्क में सभी के लिए न्याय दूर की कौड़ी है, जिसकी बड़ी वजह है जाति जो अभी भी देश के 125 करोड़ लोगो के राजनैतिक, सामाजिक और आर्थिक जीवन का निर्धारण करती आ रही है| संसाधनों पर पकड़ और ताकत के साथ साथ सत्ता के गठजोड़ और प्रभाव के चलते बहुधा निःसहाय वंचितों, विशेष रूप से दलित (अस्पृश्य) जो कि निर्धनता और अशिक्षा से पीड़ित हैं को न्याय नहीं मिलता है। दलितों पर अत्याचार और उत्पीड़न, अवैध वसूली, गहरी पैठ वालों के विरुद्ध शिकायतें दर्ज न करना, झूठे आरोपों पर मनचाही गिरफ्तारियां, अवैध बंदी और कारागार में मृत्यु रोजमर्रा की बात है। ग्रामीण भारत में जहाँ आधुनिक सामाजिक आडिट प्रणाली गायब है, कानून के रखवाले बहुधा ‘पुलिस राज’, का हौव्वा खड़ा करते है। पंगु राष्ट्रीय मानवाधिकार आयोग और इसकी राज्य शाखाओं के पास सीमित अनुशंसनात्मक नियंत्रण और एक दुष्क्रियाशील कानूनी सहायता प्रणाली वास्तव में निराशाजनक छवि का निर्माण करते हैं। मुख्य रूप से उत्तर प्रदेश, जहां पर दलितों के विरुद्ध सबसे अधिक अपराध की दर होती है, से केस स्टडी का उद्धरण देते हुए, वरिष्ठ और अनुभवी मानवाधिकार कार्यकर्ता लेनिन रघुवंशी एक रोचक तरीके से लिपिबद्ध करते हैं कि किस प्रकार प्रशासन के अव्यक्त समर्थन से उच्च जातियों के लोग दलितों पर अत्याचार करते हैं और उनका अपमान करते हैं, जैसे जूतों की माला पहनना, उनके चेहरों पर कालिख पोतना या गधे पर बैठना; फिर भी अधिकांश मामलों में हंसिये पर पड़े और वंचित समुदाय के विरुद्ध की गयी हिंसा, मृत्यु या हिरासत में उत्पीड़न दर्ज ही नहीं होते हैं। विडम्बना है कि औपनिवेशिक दासता से मुक्त होने के बाद भी, हमारे प्रशासनिक ढाँचे में जहाँ बड़े पैमाने पर भ्रष्टाचार है, यह विरासत के रूप में मौजूद है जिसके चलते स्वतंत्र भारत के ग्रामीण हिस्सों में कई सरकार समर्थित परियोजनाएं विफल हो जाती है। पेशे से एक आयुर्वेदिक चिकित्सक लेनिन रघुवंशी वाराणसी और उत्तर प्रदेश के पूर्वी भाग, भारत, में बाल श्रम और अन्य सीमान्त लोगों के अधिकारों पर कार्य कर रहे हैं। वर्ष 1996 में वह और उनकी पत्नी श्रुति ने एक समुदाय आधारित संगठन मानवाधिकार जन निगरानी समिति/पीपुल्स विजिलेंस कमेटी आन ह्यूमन राइट्स (पीवीसीएचआर) की स्थापना की ताकि पारंपरिक मलिन बस्तियों और गावों के बंद व सामंती पदक्रम को तोड़ा जा सके एवं स्थानीय न्याय, बंधुत्व व गरिमा पर आधारित स्थानीय संस्थाओ का निर्माण हो और उनका हाई प्रोफाइल और सक्रिय मानवाधिकार नेटवर्क से समर्थन किया जा सके। अशोका फेलो होने के साथ लेनिन संयुक्त राष्ट्र युवा संगठन (यूएनवाईओ), उत्तर प्रदेश (भारत) अध्याय के 23 वर्षा की उम्र में अध्यक्ष बने । लेनिन के काम को 2007 के ग्वान्जू मानवाधिकार सम्मान के लिए मान्यता दी गयी। वर्ष 2007 में डेनमार्क के यातना पीड़ितों के लिए डिग्निटी: डेनिश इंस्टिट्यूट अगेंस्ट टार्चर के सहयोग से लेनिन के भारत में यातना उत्तरजीवियों के लिए टेस्टीमोनियल थेरेपी का माडल विकसित किया। जर्मनी में वाईमर की नगर परिषद ने लेनिन रघुवंशी को 2010 के अंतर्राष्ट्रीय मानवाधिकार सम्मान के लिए चुना। अभी हाल में न्यायमूर्ति श्री संतोष हेगड़े की अध्यक्षता वाली जूरी ने लेनिन को दलित व वंचित के मानवाधिकार में उत्कृष्ट कार्य के लिए एम ए थॉमस नेशनल ह्यूमन राइट्स अवार्ड से नवाज़ा है| वही बालाधिकार में उत्कृष्ट कार्य के लिए वोकहार्ड फाउंडेशन ने 2016 में वर्षा का बलाधिकार कार्यकर्ता के रूप में चयनित किया है| सांप्रदायिक फासीवाद, नवउदारवाद व जातिवाद के संयुक्त गठबंधन के खिलाफ संघर्षरत लेनिन के नवदलित आन्दोलन के लिए जर्मनी के संसद की उपाध्यक्ष सुश्री क्लौडिया रोथ ने सराहा है|

Compensation and CID investigation in case of police firing at Jharkhand

The matter rested thus when the Commission vide its proceedings dated 28.05.2015 had inter-alia observed and directed as under: - "The fact remains that the deceased was killed in police firing without any provocation. It is a killing in fake encounter. Hence the Chief Secretary, Govt. of Jharkhand is directed to 'Show Cause' u/s 18 a (i) of the Protection of Human Rights Act, 1993 as to why monetary compensation of Rs. 5 Lakhs should not be recommended to be paid to the next of kin of the deceased within 8 weeks" The response to the 'Show Cause Notice' is still awaited. The Supdt. of Police, CID, Jharkhand vide his communication dated 10.08.2015 had however stated that the Case FIR No.14/2012, PS Barbadih, Latehar is still pending investigation. The Commission further considered the matter on 23.05.2016, when it observed and directed as under: - "Let a final reminder be sent to the Chief Secretary, Govt. of Jharkhand calling upon him to submit reply to the 'Show Cause Notice' within four weeks, failing which it shall be presumed that the State Govt. has nothing to say and the matter will be decided on merits. The DGP, Jharkhand is also called upon to submit status/outcome of the case being investigated by the State CID within this period." In response, Supdt. of Police, CID, Jharkhand vide his communication dated 27.07.2016 has submitted that the case is still pending investigation and necessary instruction have been given to the investigating officer to conclude the investigation. The Commission has considered the matter. The State Governmnet has not submitted reply to the 'Show Cause Notice'. It thus appears that the State Government has nothing to say in the matter. The deceased Lucas Minz (35 Yrs), a hearing and speech impaired person, as observed earlier has died in police firing without any provocation. In these circumstances an amount of Rs. 5,00,000/- (Rupees Five Lakh Only) as interim relief is recommended to be paid to the next of kin of the deceased. The Chief Secretary, Government of Jharkhand is asked to submit the proof of payment within four weeks. The DGP, Jharkhand is also called upon to submit status/outcome of the case being investigated by the State CID within this period.

These proceedings shall be read in continuation with earlier proceedings of the Commission. The matter rests thus. The complainant, from an NGO, had alleged that four named accused persons had caused fire to the house of victim woman on 18/03/2015 and her household items got destroyed in the fire. Police did not come to the spot despite the telephone calls made to PCR. On 19/03/2015 the accused persons had abused the victim woman & her daughter and started beating them. When they went to the police station to inform the incident, the accused persons were present outside the police station and started beating them. The victim and her family are living under the fear. Superintendent of Police, Crimes, Nodal Officer, Varanasi in his report dated 01/06/2016 has stated that the complainant had lodged Case Crime No. 251/2015 dated 14/07/2015 u/s 323/436/504/506 IPC and Sec.3 of SC/ST POA Act, PS: Badagaon against four accused persons. During investigation Section 436 IPC was omitted from the case and the Charge Sheet dated 13/08/2015 was filed against four accused persons. There was an inordinate delay of about four months in a registration of the criminal case in the alleged incident dated 18-19/03/2015. Prima facie allegations of the complainant that police have not taken any action in the matter appear to have sound merits. The Commission had issued Notice dated 13/04/2015 to Senior Superintendent of Police, Varanasi and it was after three months of that Notice, the police had set law into motion. The police report is silent as to reasons for inaction of four months from date of incident. The report is also silent whether or not any financial assistance was provided to the victims under the provisions of SC/ST POA Act. Consequently, the report does not inspire confidence of the commission. The allegations of police inaction are required to be enquired in an impartial manner by the State Authorities. Apparently, the Human Rights of the victims have been violated by the State Police for not setting the law into motion and by delaying the process of law. Although the injuries caused to the victim on reasons of police inaction cannot be undo, but an interim relief of monetary compensation would be a solace to injured sentiments. Notice be issued to Chief Secretary, Govt. of Uttar Pradesh to Show Cause why interim relief of monetary compensation of Rs.25,000/- (Rupees Twenty Five Thousand) shall not be granted to the victim as per Section 18 of the Protection of Human Rights Act, 1993. Response within four weeks, without fail. Director General of Police, Uttar Pradesh is directed to get a fresh enquiry conducted against the allegations of police inaction for about four months in this matter, from a Gazetted Police Officer of any District other than District Varanasi. Appropriate action be taken against delinquent police officers including penal prosecution under Section 166/166A IPC & Sec.4 SC/ST POA Act, in accordance with laws. An Action Taken Report be submitted within four weeks, without fail. District Magistrate, Varanasi is directed to submit his report indicating payment of monetary relief/ other benefits to victims under Schedule Caste and Schedule Tribe (Prevention of Atrocities) Act or under State Victim Compensation Scheme in connection with Case Crime No. 251/2015 dated 14/07/2015 u/s 323/436/504/506 IPC and Sec.3 of SC/ST POA Act, PS: Badagaon. Response within four weeks. A copy of these proceedings be also transmitted to the complainant and to the victim for their information.

These proceedings shall be read in continuation of the proceedings dated 16.3.2015. Commission had directed DM Jaunpur to take steps for rehabilitation and providing the complainant the alternative means of livelihood within one month. Cases have also been filed against the accused under the Minimum Wages Act and other acts. DM Jaunpur in his report dated 6.5.2013 have communicated that brick kiln labourer Nandu Mushar has been provided Antodaya card, Prem Mushar and Border Mushar BPL card has been attached with Mahender Kumar Yadav. Nandu s/o Bonu card under MNREGA bearing no. UP-58-033-044-022/38 has been issued. He has been given work under MNREGA in year 2011-2012 for 87 days, in year 2012-2013 80 days, in 2013-2014, 105 days, in 2014-2015, 27 days. Under Samajwati Pension Scheme, he has been paid Rs. 6,000/- in his UBI account maintained at Rampur. SP Jaunpur had communicated that accused has been charge sheeted u/s 3(1)/6 SC/ST Act and additional charge sheet 47A dated 14.12.2014 has been filed in the court which is sub judice. Assistant Labour Commissioner, Jaunpur, in his report dated 20.4.2015 submitted that labourer Guddu and other freed labourers have been rehabilitated and each has been paid Rs. 20,000/- . A list has been submitted along with the report, showing the payment in their accounts. Commission had considered the report submitted by the authorities. No further action is required. The case is closed.
