शिक्षा अधिकार भारतीय बच्चे : दृष्टिकोण बिना कैसा विकास

शिक्षा अधिकार भारतीय बच्चे: दृष्टिकोण बिना कैसा विकास शिक्षा अधिकारों की पैरवी में बाल पंचायतों की तीन नाट्य अभिव्यक्ति --- “हमें पढ़ाएँ बिन डंडा मार” “पढाई हुई मुहाल” एवं “आधा ही मिला शिक्षा अधिकार” बाल पंचायतो द्वारा वाराणसी चौकाघाट सांस्कृतिक संकुल में देकर शिक्षा अधिकार कानून के लागू होने में आ रही बाधाओं व बुनियादी सुविधाओं के अभावों पर ध्यान आकर्षित कराया 



शिक्षा अधिकार कानून लागू होने के तीन वर्ष से भी अधिक होने को है लेकिन आज भी हर बच्चा शिक्षा से नही जुड़ पाया है जमीनी हकीकत आज भी कानून से परे है | होटल ढाबों में साडी-कालीन बिनाई में ईट भट्ठों में बालश्रम में आज भी लगे हैं वे जितना काम करने को बाध्य किये जाते हैं और उनके परिवार की परिस्थितियाँ जितनी विपरीत हैं शिक्षा उतनी ही उनसे दूर है | कानून लागू होने के इतनी अवधि के बाद भी शिक्षा व्यवस्था उनके अनुकूल नही है | ना ही जनप्रतिनिधियों के लिए यह गम्भीर मुद्दा बन सका है स्पष्ट है की कुछ खास तबकों के समुदायों के बच्चों का शिक्षा अधिकार बाधित हो रहा है जिससे यह उनके लिए महत्वपूर्ण नहीं है कार्यक्रम के आयोजन के उद्देश्यों पर अपने विचार रखते हुए समिति की मैनेजिंग ट्रष्टी श्रुति नागवंशी ने कहा | 



ऐसे में मानवाधिकार जननिगरानी समिति, वाराणसी (उ०प्र०) द्वारा ग्लोबल फंड फॉर चिल्ड्रेन (USA) ,सर दोराबजी टाटा ट्रस्ट एवं क्राई के संयुक्त तत्वाधान में शिक्षा अधिकार भारतीय बच्चे: दृष्टिकोण बिना कैसा विकास शिक्षा अधिकारों की पैरवी में बाल पंचायतों की नाट्य अभिव्यक्ति के माध्यम से कानून के लागू होने के बाद भी आ रही बाधाओ समस्याओं एवं मुद्दों पर जोर देने का प्रयास किया गया है | जिसमे शिक्षा अधिकार की पैरवी के समर्थन में बाल पंचायतों के बच्चों द्रारा विभिन्न महत्वपूर्ण सामाजिक विषयों – बालश्रम, बालिका शिक्षा, विधालयों की स्थिति, शिक्षकों का व्यवहार, विद्यालय में पिटाई, गुणवत्तापूर्ण शिक्षा एवं बाल अधिकार आदि विषयों पर बच्चों द्वारा नाट्य अभिव्यक्ति आयोजन किया जा रहा है | 

कार्यक्रम में सकरा जौनपुर, रौप सोनभद्र एवं वाराणसी जनपद के विभिन्न गाँवो से आये हुए अतिवंचित तबके व समुदाय के बच्चों द्रारा नाट्य कार्यक्रम प्रस्तुत किया जायेगा | इस कार्यक्रम के माध्यम से बच्चे इन मुद्दों पर व समस्याओं पर आम लोगों एवं शासन-प्रशासन का ध्यान खीचने का प्रयास करेंगे एवं अपनी भावनाओं को व्यक्त करेंगे | 

 
बच्चों की यह नाट्य अभिव्यक्ति वाराणसी के चौकाघाट स्थित साँस्कृतिक संकुल के ओपन थियेटर में हुई कार्यक्रम के विशिष्ट अतिथि श्री. अनिल पाराशर (ज्वाईनट रजिस्ट्रार राष्ट्रीय मानव अधिकार आयोग, नई दिल्ली) एवं मुख्य अतिथि वरिष्ठ समाजसेवी प्रोफ़ेसर एस०एस० कुशवाहा (पूर्व कुलपति महात्मा गाँधी काशी विद्यापीठ) रहे | 

        
बाल पंचायतो के बच्चों द्वारा स्कूल में सजा व भेदभाव विषय पर – “हमें पढ़ाये बिन डंडा मार” प्रवासी कामकाजी बच्चों की स्थितियों पर – “पढाई हुई मुहाल” शिक्षा में आ रही बाधाओ, गुन्व्त्ताओ, विशेष रूप से बुनियादी सुविधाओं की कमियों पर – “आधा ही मिला शिक्षा अधिकार” नामक तीन नाटकों के माध्यम से बुनियादी सवाल खड़ा किया गया | इस मौके पर समिति के के अध्यक्ष डा. महेन्द्र प्रताप सिंह, गवर्निंग बोर्ड की सदस्या प्रोफेसर शाइना रिजवी, श्री. बल्लभाचार्य जी एवं महासचिव डा. लेनिन रघुवंशी मौजूद रहे | इस मौके पर बाल पंचायतो के बच्चों ने दीपावली पर पटाखा न जला कर दीप जलाकर दीवाली मनाने की अपील करते हुए पटाखों को पानी में डालकर पटखा बहिष्कार की अपील किया | कार्यक्रम का संचालन इरशाद अहमद ने किया और धन्यवाद ज्ञापन सीनियर मैनेजर सिरिन शबाना ने किया|

1. हमें पढ़ाएँ बिन डंडा मार
विषय : स्कूल में शारीरिक दण्ड और भेद-भाव 
रूपरेखा : यह नाटक बच्चो के अपने अनुभवों को प्रदर्शित करेगा जो कि शारीरिक दण्ड और भेदभाव को उजागर करेगा | यह नाटक बच्चो द्वारा स्कूल में विभिन्न तरह के भेदभाव का सामना करने के विषय में प्रदर्शित करेगा – यह जाति आधारित, वर्ग आधारित, लिंग आधारित आदि को प्रदर्शित करेगा और शारीरिक दण्ड से होने वाले क्षति को उजागर करेगा |

प्रदर्शन के माध्यम से बच्चे अपनी भावनाओं को अभिव्यक्त करने का प्रयास करेंगे जो कि शारीरिक या भावनात्मक दण्ड से जुडा है | यह एक बच्चे के दिमाग पर है प्रतिघात का काम करता है और कैसे यह बच्चे का विकास बाधित करता है यह भी इस नाटक में प्रदर्शित किया जाएगा | 


यह नाटक इस विषय पर भी दिखाने का प्रयास करेगा कि कैसे भय और भेदभाव का वातावरण बच्चो को स्कूल से दूर करता है |

2. पढाई हुई मुहाल 
विषय : प्रवासी कामकाजी बच्चों की स्थिति 
रूपरेखा : इस नाटक के माध्यम से बच्चे भट्ठा मजदूरों के बच्चों की शिक्षा से वंचितिकरण को चित्रित करने का प्रयास करेंगे|यह नाटक उन कारणों को भी उजागर करने का प्रयास करेगा जो बच्चो को मजदूर बनाने के लिए मजबूर करते है – यह पारिवारिक, आर्थिक या अन्य तरह के होते है जिससे बच्चो पर असर पड़ता है | 

बच्चे अपनी कहानी बयान करेंगे कि कैसे का उम्र में शादी उन्हें शिक्षा से दूर ले जाती है | नाटक यह भी प्रस्तुत करने का प्रयास करेगा कि कैसे कम उम्र में जिम्मेदारिया सौपी जाती है – परिवार के लिए रोटी कमाने के लिए, छोटे भाई बहन की देख रेख करने के लिए, घर के काम को स्कूल जाने की कीमत चुकाकर, उनका बचपने को लूट लेता है और उनके सुनहरे भविष्य पर एक धब्बे जैसा है |






इस नाटक के माध्यम से बच्चे यह सवाल उठायेगे और मांग करेंगे कि सभी बच्चो को शिक्षा अधिकार क़ानून से जोड़ा जाय | 

3. आधा ही मिला शिक्षा अधिकार
विषय : शिक्षा के लिए बाधाओं को विशेषरूप से बुनियादी सुविधाओं की कमी पर ध्यान केंद्रित | रूपरेखा : यह नाटक बच्चो द्वारा स्कूल में आने वाली चुनौतियों को प्रस्तुत करेगा –यह स्कूल में अध्यापको की कमी से शिक्षा गुणवत्ता पर प्रभाव को दर्शायेगा, पर्याप्त कक्षा कक्ष की कमी किस प्रकार सीखने में बाधा उत्पन्न करती है | स्वच्छ शौचालय की कमी, पीने के पानी की कमी, मिड दे मील के लिए बर्तनों की कमी या फिर खेल के मैदान की कमी और इन सभी के न होने बच्चो पर का प्रभाव को भी दर्शायेगा | बच्चे अपने रोज के अनुभव को भी प्रस्तुत करेगे कि उन्हें स्कूल में शिक्षा का लाभ उठाने के संदर्भ मेंक्या काम करना होता है क्या नहीं |

On the 23rd October, 2013, during the visit of the National Human Rights Commission to Manipur, two of its Members, accompanied by senior officers, met Ms Irom Sharmila, who, having declared that she will fast until the Armed Forces Special Powers Act is repealed, is under trial for charges under Section 309 IPC, since in the view of the State Government, her sustained refusal to eat is an attempt to commit suicide. The Commission met her in the government hospital where she is held in judicial custody, kept alive with nutrients administered to her through a tube. Ms Sharmila is a person of concern to the Commission on three counts. She is, firstly, a person in custody, on the terms of whose imprisonment the Commission has received some complaints. Secondly, it has been represented to the Commission, and to UN Special Rapporteurs who have visited India, that the terms of her imprisonment have deliberately been made harsh because she is a human rights defender. Lastly, in so far as she is held in conditions that are onerous because of her peaceful opposition to an aspect of government policy, a law whose repeal she seeks, she is a prisoner of conscience. The Commission found Ms Irom Sharmila frail, but alert. The doctor in attendance confirmed that her health was monitored and there was no cause for concern. She herself seemed resigned to the fact that, though she will not voluntarily accept any nourishment, it will be administered to her, and did not complain of any physical ill-treatment. However, Ms Irom Sharmila complained repeatedly that she was rarely allowed visitors, whereas all others in the custody of the Manipur Government routinely received visits from family and friends. Even her fiancé, who lives abroad, had been refused permission to meet her during his last visit to India in 2011. It was clear that her enforced separation from those on whose support and affection she leans, and whose visits she has a right to expect, is a source of considerable anguish to her. Though a person still under trial, she is in effect kept in a solitary confinement which places her under enormous stress. The Commission considered this unconscionable and asked the officials in whose immediate custody she is why, for her, this egregious exception is made to the practice that permits and regulates visits to persons in custody. It received no satisfactory reply, but was informed that permission to meet Ms Irom Sharmila must be issued by either the Chief Minister or the Deputy Chief Minister. The Chief Secretary, Government of Manipur, has since informed the Commission that access to Ms Irom Sharmila was regulated for two reasons: to guard against dangers to her life and to insulate her from individuals and ideologies acting against the State. The fact that the State Government had permitted the Commission to meet her showed that it did not keep her in isolation. The Commission has pointed out to the Chief Secretary that it did not need the permission of the Government of Manipur to visit Ms Irom Sharmila. Section 12 (c) of the Protection of Human Rights Act lays down that the Commission may: "visit, notwithstanding anything contained in any other law for the time being in force, any jail or other institution under the control of the State Government, where persons are detained or lodged for purposes of treatment, reformation or protection, for the study of the living conditions of the inmates thereof and make recommendations thereon to the Government" The Commission has met Ms Sharmila and is issuing these proceedings under the terms of Section 12 (c) of the Protection of Human Rights Act. The Commission also pointed out to the Chief Secretary that the Special Rapporteur it has appointed for the North-East, a retired Director General of Police, was refused permission to meet Ms Irom Sharmila during his visit to Manipur in August, 2013. He too was told that permission would have to come from the Chief Minister, and was rarely forthcoming. The Commission has explained to the Chief Secretary that, under the terms of access that he outlined, the denial of permission to its Special Rapporteur could only mean that the Government of Manipur considered the National Human Rights Commission inimical to it, and one of its most senior representatives a threat to Ms Sharmila. The Commission understands that two Special Rapporteurs of the UN Human Rights Council, on visits to Manipur, had expressed an interest in meeting her, but had also been told that this would not be possible. The Commission believes that if the Government of Manipur could deny permission to its Special Rapporteur, and to Special Rapporteurs of the UN, to visit Ms Irom Sharmila, it is unlikely that it gives others access to her. It would appear that, while keeping her alive, since her death would create problems for the State Government, it is trying to break her spirit through this enforced isolation, for which there is no judicial mandate, though she is in judicial custody. The Commission reminds the Government of Manipur that its treatment of Ms Irom Sharmila is in breach of several international human rights standards. Article 10 of the International Covenant on Civil, Political and Cultural Rights, to which India is a Party, stipulates that: "All persons deprived of their liberty shall be treated with humanity and with respect for the inherent dignity of the human person." Article 1 of the Convention against Torture states: "For the purposes of this Convention, the term "torture" means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity..." The "Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment", adopted by the UN General Assembly in 1988, stipulates in Principle 6 that "No person under any form of detention or imprisonment shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. No circumstance whatever may be invoked as a justification for torture or other cruel, inhuman or degrading treatment or punishment." Principle 19 stipulates that "A detained or imprisoned person shall have the right to be visited by and to correspond with, in particular, members of his family and shall be given adequate opportunity to communicate with the outside world, subject to reasonable conditions and restrictions as specified by law or lawful regulations. These "conditions and restrictions" are laid down in Principles 16 and 18, but Principle 15 lays down that Notwithstanding the exceptions contained in principle 16, paragraph 4, and principle 18, paragraph 3, communication of the detained or imprisoned person with the outside world, and in particular his family or counsel, shall not be denied for more than a matter of days. The UN Commission on Human Rights has held that a person in custody in whose case these principles are not honoured is kept in "arbitrary detention". The Commission therefore strongly recommends to the Government of Manipur that it immediately remove the arbitrary restrictions imposed on access to Ms Irom Sharmila, which are in breach of India's obligations under international human rights standards and principles, and a grave violation of human rights. She must be permitted to receive visitors under the regime that governs all persons in judicial custody. The Commission shall expect the Chief Secretary, Government of Manipur, to report to it by December 6, 2013, on the steps it has taken in response to this recommendation.

These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 17.6.2013. In response, the Superintendent, District Jail, Depria, U.P., vide its communication dated 19.7.2013, has submitted the report. Perusal of the same reveals that an amount of Rs.3,00,000/- (Rupees Three Lakhs only) as recommended by the Commission, has already been remitted electronically to the account of District Magistrate, Deoria, U.P., on 18.7.2013 for disbursement to the next of kin of the deceased Ram Bachan. The Joint Secretary, Prison Administration & Correctional Department-III, government of U.P., vide communication dated 29.8.2013, has informed the Commission that the District Magistrate, Deoria has been asked to submit the proof of payment made to next of kin of the deceased. It has also been stated that the Special Secretary, Medical Department-III, Government of U.P., Lucknow, has also been asked to submit the details of departmental action taken against the delinquent Medical Officer Dr. Bharat Singh in the matter. The proof of payment and details of departmental action taken against the delinquent Medical Officer are, however, still awaited. The Commission has considered the matter. Despite sufficient time and opportunity having been given, the requisite reports have not been received. In these circumstances, let summons be issued for the personal appearance of District Magistrate, Deoria, U.P. and Special Secretary, Medical Department-III, Government of U.P., before the Commission on 15.10.2013 at 11.00 A.M. along with the requisite reports. In case the reports are received on or before 8.10.2013, the personal appearance of District Magistrate, Deoria, U.P. and Special Secretary, Medical Department-III, Government of U.P., shall stand dispensed with.

This proceeding shall be read in continuation of the earlier proceeding of the Commission dated 13.12.2012. Pursuant to the show cause notice issued by the Commission u/s 18 (a) (i) of PHRA Act 1993, a report dated 20.2.2013 has been received from the Joint Secretary, Home (HR) Department, Government of Rajasthan, Jaipur, enclosing therewith a report of SP (Civil Rights), Police Headquarters, Rajasthan. It is intimated that a sum of Rs. 10 lakhs has been paid to the victim lady by the Collector, Pratapgarh, vide cheque no. 531165 dated 18.5.2011 from the Chief Minister's Relief Fund. However, a copy of the receipt of the cheque or payment has not been enclosed with the report. The DM and SP, Pratapgarh, Rajasthan, are directed to send within four weeks, a photocopy of the receipt obtained from the victim lady regarding payment of Rs. 10 lakhs to her by cheque.



Public hearing to ensure human dignity against on bonded labour and children labour



On the one side India is moving ahead to be the superpower in the world and on the other side it is stated to be the home for largest number of bonded labours. On October 25, 2013 the People’s Vigilance Committee on Human Rights (PVCHR) jointly with the Danish Institute Against Torture (dignity) with the support from Voice of People and QICAC, organised the public hearing against bonded labour and child labour to protest human dignity.

The Chief Guest in the programme was Dr. Yogesh Dube, the member of the National Child Protection Commission and chairperson of the core committee for eradication of bonded labour in Uttar Pradesh along with Ms Shameena Shafiq, member National Women’s’ Commission, and Assistant Registrar, National Human Rights Commission Mr. O.P Vyas. Former DGP Uttarakhand Mr. Jyotiswaroop Pandey was present in the hearing as jury. Ravindra Singh Dogra the secretary of the Panchayati raj and Rastravadi Granthalaya was special guest
 


 The members of the jury released a report called “The dark site of India” during the programme. The report has been published by the PVCHR on the basis of the experience of bonded labours in Uttar Pradesh.
 


Giving his welcome address and throwing light upon the subject the director of PVCHR Dr Lenin Raghuvanshi said that in the past two-and-half years the organisation has been successful in liberating 243 bonded labours through advocacy at different levels including district, state and national administration. Since 1996 about 3500 bonded labours have been set free from the organised bonded labour system. He said that this is astonishing but fact that these bonded labours belong to scheduled caste, tribal community, backward class or minority community and none of them belonged to upper caste. He said that existence of bonded labours in our society today has several reasons such as economic discrepancies, caste systems, autocratic attitude, communal mindset and patriarchal thoughts. It is due to such practices that castes are suppressed and worst is the situation of women and children.


For the public hearing, about 70 cases from different districts such as Sonebhadra, Jaunpur, Varanasi, Chandauli and Aligarh were brought for discussion in the hearing. Out of the total about 15 such cases who are waiting for justice, were presented before the jury where the victims presented their tale of woes. They narrated how the administration ignores their welfare, their rehabilitation, social development, welfare schemes for them and even eradication of bonded labour system. It may be mentioned that the report released by minister Shiv Pal Singh Yadav on the Mujaffarnagar riots does indicated on bonded labours but it does not accepts the problem exists straightaway. The report says some of the riot victims are not going back from relief camps as they have taken loan from the brick kiln owners and fear they will ask the money back, says the point number two of the report. In the Bandhuaa Mukti Morcha Vs Union Government case it has been said that if someone has taken a loan and is made to do same work repeatedly to repay the loan, and the loan taker is frightened and is not being given minimum wages the person according to the reference given in the case is termed as a bonded labour. In such matter the victim should be liberated and his or her rehabilitation should be ensured to provide a free life.




Recently a renowned organisation from Australia, “Walk Free Foundation” has released a report on slavery index 2013 which says the survey was done in 162 countries and 3 crore people in these countries are slaves. Of these half 1.39 crore are in India. Along with India the other poor countries of the world the poor are being made slave against their poverty, political instability, caste, gender and illiteracy and are subjected to human trafficking, forced marriage, sex trade, and other offence. Making someone victim and exploiting them sexually and mentally by making them slave that were experienced by humans in 18th century still exists in some part of the world while laws against human slavery were brought in and implemented decades before. The labour department runs several welfare schemes for labours. In fact bonded labour and child labour fetch manifold profits to capitalists.


For the success of the public hearing the Uttar Pradesh Social Welfare Board and agriculture production commissioner gave their messages and the public hearing was participated by organisations such as International Justice Mission, OXFAM and pressed upon the need to eradicate child labour and bonded labour. The sessions were coordinated by Shruti Nagvanshi of Voice of People’s state coordinator, and vote of thanks was given by Anoop Srivastava of the PVCHR.

आज 25 अक्तूबर 2013 को लखनऊ के हजरतगंज स्थित होटल इण्डिया अवध में मानवाधिकार जननिगरानी समिति द्रारा डेनिश इंस्टीट्यूट अगेंस्ट टार्चर (डिग्निटी) के सहयोग और वायस ऑफ़ पीपुल एवं क्यू० आई० सी० ए०सी० के संयुक्त तत्वाधान में “बंधुआ मजदूरी” एवं “बाल बंधुआ मजदूरी” के खिलाफ इंसानी गरिमा को सुनिश्चित, सुरक्षित एवं संरक्षित करने उददेश्य से एक “जनसुनवाई” आयोजित किया गया |





जनसुनवाई में मुख्य अतिथि राष्ट्रीय बाल अधिकार संरक्षण आयोग के सदस्य और उत्तर प्रदेश बाल मज़दूरी उन्मूलन कोर कमेटी के चेयरपर्सन डा. योगेश दूबे जी, विशिष्ट अतिथि राष्ट्रीय महिला आयोग की सदस्या सुश्री. शमीना शफीक जी, एवं राष्ट्रीय मानव अधिकार आयोग से असिस्टेंट रजिस्ट्रार श्री ओम प्रकाश व्यास जी, उत्तराखंड राज्य के भूतपूर्व डी० जी० पी० श्री. ज्योतिस्वरूप पाण्डेय जी बतौर ज्यूरी के रूप में शामिल हुए | इस जनसुनवाई में विशिष्ट अतिथि के रूप में पंचायतीराज एवं राष्ट्रवादी ग्रन्थालय सभा सचिव श्री. रवीन्द्र सिंह डोंगरा जी भी शामिल हुए | इस मौके पर ज्यूरी सदस्यों द्रारा “The dark site of India” नाम से रिपोर्ट रिलीज किया गया, जो समिति द्रारा प्रकाशित की गयी है और जो कि उत्तर प्रदेश में बन्धुआ मजदूरों की विकट परिस्थियों और उनके कठोर अनुभवो पर आधारित है |
 
स्वागत भाषण और विषय प्रवेश कराते हुए समिति के निदेशक डा.लेनिन ने बताया कि पिछले ढाई सालों विभिन्न आयोग, राज्य स्तरीय एवं जिला स्तरीय प्रशासनिक पैरवी एवं क़ानूनी हस्तक्षेप के ज़रिये 243 बन्धुआ मजदूरों को मुक्त कराया गया है और 1996 से अब तक 3500 मजदूरों को ढाचागत बन्धुआ मजदूर प्रणाली से मुक्त कराया गया है| उन्होंने बताया कि यह आश्चर्यजनक तथ्य है की ये सभी बन्धुआ मजदूर अधिकांश अनुसूचित जाति, पिछड़ी जाति, आदिवासी समुदाय या फिर अल्पसंख्यक समुदाय से सम्बन्धित मिले, एक भी बन्धुआ मजदूर ऊँची जाति से नही संम्बन्धित थे | आज भी हमारे समाज में बंधुआ मजदूरी की समस्या बने रहने का प्रमुख कारण हमारे समाज की आर्थिक विषमता, जातिगत व्यवस्था, तानाशाही प्रवृति, साम्प्रदायिक मानसिकता एवं विचारधारा और पितृसत्तात्मक सोच का समाज में बने रहना है | जिससे आज इक्कीसवीं सदी में भी हाशिये पर जीने वाले समुदायों के परिवार में विशेषकर बच्चों व महिलायों की स्थिति बहुत अमानवीय एवं नारकीय है | 



साथ ही जनसुनवाई के इस विशिष्ट सन्दर्भ में उत्तर प्रदेश के विभिन्न जिलों सोनभद्र, जौनपुर, वाराणसी, चंदौली, अलीगढ़ से कुल सत्तर से अधिक बन्धुआ मजदूरों और बाल मजदूरों के मामलो को शामिल किया गया | इनमे से पन्द्रह केसों को ज्यूरी के सामने सुनवाई के लिए रखा गया, जिसमे न्याय की आस लगाये बन्धुआ मजदूरी के शिकार पीड़ितों ने अपनी आप बीती कहानी व स्व-व्यथा कथा ख़ुद सुनाया | साथ ही यह भी बताया प्रशासन बंधुआ मजदूरों को चिन्हित करने, उनके पुनर्वास, सामाजिक विकास और कल्याण की योजनाओं में वरीयता व भागीदारी एवं बन्धुआ व बाल मजदूरी उन्मूलन कानूनों की सख्ती से लागू करने में लगातार लापरवाही करता है विदित हो कि हाल ही में मुजफ्फरनगर और शामली में हुए सांप्रदायिक दंगे के सन्दर्भ में उत्तर प्रदेश सरकार के लोक निर्माण एवं सिंचाई मंत्री माननीय श्री. शिवपाल सिंह यादव द्रारा जारी की गयी रिपोर्ट में भी बंधुआ मजदूरी के लक्षणों को चिन्हित किया गया है, किन्तु सीधा बन्धुआ मजदूरी को स्वीकार नहीं किया गया है | रिपोर्ट में दंगा पीडितो का शिविरों से अपने घर वापस न लौटने के कारणों में बिंदु संख्या 2 में बताया गया है कि कुछ पीडितो द्रारा स्थानीय लोगों और भट्ठे से कर्ज लिया गया है और वे वसूली के डर से गाँव वापस नही जा रहे हैं| बन्धुआ मजदूरी के सन्दर्भ में “बन्धुआ मुक्ति मोर्चा बनाम भारत सरकार” के फैसले में स्पष्ट कहा गया है कि यदि किसी व्यक्ति ने कर्ज लिया है और उसे कर्ज के एवज में वंही काम करने की बाध्यता हो, साथ ही उसे न्यूनतम मजदूरी नही मिलता हो, व्यक्ति डरा हो तो इस फैसले के अनुकूल यह सीधे - सीधे बन्धुआ मजदूरी का मामला है | ऐसे सभी मामलो को अविलम्ब चिन्हित करते हुए उन्हें बंधुआगिरी से मुक्त कराते हुए पुनर्वासित किया जाना चाहिए जिससे वे पुन: बन्धुआ जीवन जीने को बाध्य न हों | 


हाल ही में आस्ट्रेलिया की प्रतिष्ठित संस्था “वाक फ्री फाउन्डेशन’’ के द्वारा जारी रिपोर्ट में विश्व दासता सूचकांक 2013 के आकड़ों के अनुसार 162 देशों में सर्वेक्षण के अनुसार दुनियाभर में 3 करोड़ लोग दासता के शिकार हैं, जिसमें भारत में ही अकेले 1.39 करोड़ लोग दासता का जीवन जी रहे हैं | भारत समेत दुनिया के गरीब देशो में इंसानों की सामाजिक, आर्थिक, राजनैतिक, परस्थितियो (जाति, लिंग, गरीबी, अशिक्षा) का फायदा उठाकर उन्हें गुलाम बनाकर बन्धुआ मजदूरी, बाल मजदूरी, मानव तस्करी, जबरन विवाह, देह व्यापर के धंधे में धकेला जाता है | छल के जरिये किसी व्यक्ति की आजादी छीनकर दबाव हिंसा के जरिये उनका आर्थिक,शारीरिक व मानसिक शोषण करना उन्हें दास बनाना अठारवीं सदी की घटनाएँ जो आज भी भारी संख्या में जबकि बंधुआ मजदूरी और बाल मजदूरी के खिलाफ कई दशक पहले कानून लागु हो चुका है और श्रम मंत्रालय के अधीन मजदूरों के कल्याण और पुनर्वास के लिए सैकड़ो योजनाए सचालित हैं | बन्धुआ मजदूरी और बाल मजदूरी से मालिकों द्वारा कई गुना मुनाफा कमाने का जरिया बना है |


जनसुनवाई की सफलता के लिए उत्त्तर प्रदेश समाज कल्याण बोर्ड एवं कृषि उत्पादन आयुक्त द्वारा शुभकामनाए दी गयी साथ ही सुनवाई में इंटरनेशनल जस्टिस मिशन, आक्सफेम सहित कई संस्थाओ के प्रतिनिधियों ने भागीदारी की और बन्धुआ एवं बाल मजदूरी को जड़ से समाप्त करने पर जोर दिया | में सत्र का संचालन वायस ऑफ़ पीपुल की राज्य संयोजिका श्रुति नागवंशी ने किया और अंत में मानवाधिकार जननिगरानी समिति के अनूप श्रीवास्तव ने ज्यूरी के सदस्यों को धन्यवाद ज्ञापन दिया|

बिरसा मुण्डा जनमित्र सामुदायिक केंद्र का उद्घाटन


वाराणसी जिले के बडागांव ब्लाक स्थित बरहीं कलां गाँव के मुसहर बस्ती में आदिवासी महानायक बिरसा मुण्डा के नाम पर मानवाधिकार जननिगरानी समिति द्वारा बच्चों के लिए कार्यरत अमेरिकी संस्था ग्लोबल फण्ड फार चिल्ड्रेन के आर्थिक सहयोग से आदिवासी महानायक बिरसा मुण्डा  जनमित्र सामुदायिक केंद्र का निर्माण कराया गया है | इस केंद्र के निर्माण के बाद अब बस्ती के छोटे बच्चों को आंगनबाड़ी की प्रतिदिन सेवा और देखभाल मिलने की सम्भावना बढ़ गयी है, इसके पहले विपरीत मौसम बारिश अधिक गर्मी अधिक ठंढ में यह केंद्र कम ही खुलता था | आंगनबाड़ी कार्यकर्ती ललिता देवी केंद्र का सामान कंहा रखतीं, बस्ती में इन मुसहर परिवारों के घर तो फूस की झोपडी के थे, कुछ के घर पक्के सरकारी इंदिरा आवास हैं भी बहुत जर्जर स्तिथि में. ऐसे घरों में सामान रखने में हमेशा डर बना रहता है क़ी कब घर गिर जायेगा तो उसमे रखा सामान भी नष्ट हो जायेगा | आज यह केंद्र समिति द्वारा समुदाय की निगरानी में आंगनबाड़ी कार्यकर्ती को दिया गया | 

आज बिरसा मुण्डा सामुदायिक केंद्र का उद्घाटन वरिष्ठ पत्रकार एवं दैनिक समाचार पत्र जनसंदेश टाइम्स के उप समाचार सम्पादक श्री. विजय विनीत जी के द्वारा फीता काटकर उद्घाटन किया गया उसके बाद मुख्य अतिथि (श्री. विजय विनीत जी) ने बच्चों के साथ खीर खाया | साथ ही 27 मुसहर बच्चों को स्कूल बैग, कापी, पेन्सिल, रबर, कटर, रंग, पेन्सिल बाक्स आदि सभी बच्चों को वितरित किया गया. साथ ही आंगनवाड़ी केंद्र में  नामांकित सभी बच्चों के लिए रंग, ड्राइंग कापी, रबर, पेन्सिल, कटर, कहानियों की किताबें, तरह तरह के ब्रांडेड खिलौने एवं ब्रांडेड झूले आदि आंगनबाड़ी कार्यकर्ती सुश्री ललिता देवी को सौंपा. जिससे आंगनबाड़ी में आने वाले बच्चों का निमितिकरन व ठहराव हो सके | इन बच्चों का भी इन संसाधनों के बीच शारीरिक और मानसिक विकास हो सके |            
       आज के इस अवसर पर मुसहर परिवारों द्वारा अपनी लोक संस्कृति के उत्सव गीत -- मुसहरहुवा, ककरहुवा एवं बिरहा आदि सांस्कृतिक गीतों से पूरे माहौल को झंकृत कर दिया जिसमे गायक दिनेश कन्नौजिया आदि प्रमुख रूप रहे | इसी कार्यक्रम में समिति द्वारा डा० राकेश सिंह, प्रभारी प्राथमिक स्वास्थ्य केंद्र बसनी बडागांव को “जनमित्र सम्मान” प्रभारी प्रधानाध्यापक श्री. सुनील कुमार, एवं शिक्षामित्र अध्यापक श्री संदीप कुमार दुबे द्वय को “नवदलित सम्मान” प्रशस्ति पत्र और शाल ओढ़ाकर सम्मानित किया गया |   

विजय  विनीत जी ने कहाकि, बिरसा मुण्डा अपने छोटे से जीवनकाल में अन्धविश्वास और सामाजिक कुरीतियों के खिलाफ आदिवासी समाज को जागृत करते रहे.उन्होंने सामाजिक आर्थिक राजनितिक स्तर की गुलामी के खिलाफ आवाज उठाई  बेगारी प्रथा के खिलाफ जबरदस्त आन्दोलन किया इनके जीवन से प्रेरणा लेते हुए अपने जीवन में शिक्षा के महत्त्व को समझते हुए गुलामी बेगारी का विरोध कर सामाजिक विकास की सरकारी योजनाओं तक अपनी पहुच बनाना होगा |
कार्यक्रम का संचालन इरशाद अहमद ने किया एवं अतिथियों को धन्यवाद ज्ञापन डा. राजीव सिंह ने दिया, कार्यकम में आसपास के कई गाँवो से सैकड़ों की संख्या में जन समुदायों की भागीदारी रही | समिति के महासचिव डा. लेनिन,श्रुति,शिरिन शबाना खान  सहित जमीनी स्तर के कार्यकर्ता आनन्द प्रकाश, शोभनाथ, बृजेश, सुभाष, प्रतिमा, छाया, संध्या, शिव प्रताप चौबे, आदि कार्यकर्ताओं ने भागीदारी की | 
विदित हो की माह जनवरी से मुसहर बच्चों को समिति द्वारा प्रतिदिन एक गिलास दूध दिया जाता है जो उनके कुपोषण को रोकने बड़ा सहायक है |पिछले वर्ष यहीं के चौदह बच्चे अति गम्भीर कुपोषण का शिकार हो गये थे जिसके बाद ग्लोबल फण्ड फार चिल्ड्रन के सहयोग से समिति इन बच्चों के विकास में जुटी है.
