Sir/Madam,
 
         With reference to your complaint dated 18/08/2020. I am directed to say that the matter was considered by the Commission on 30/03/2021. The Commission has made the following directions:
 
 
         The complainant, based on a media report, in a complaint dated 18.08.2020,   has alleged sexual assault on a 14-year old minor boy by a sadhu in an ashram under district Ayodhya, Uttar Pradesh, and on failure to do so, he had chopped off the victim's genitals. He has requested intervention of the Commission.
The Commission vide its proceeding dated 10.11.2020 had directed the District Magistrate and Sr. Superintendent of Police, Ayodhya, Uttar Pradesh. to submit report whether any compensation u/s Rule 7 of the POCSO Rules, 2012 or under Victims Compensation Scheme of the State of Uttar Pradesh has been awarded to the victim Akhilesh Upadhyay, S/o Late Anirudha Upadhyay. The report shall also specify what efforts/steps have been taken by the district administration for the award of compensation to the victim.
Pursuant to the directions of the Commission, a report dated 18.12.2020 has been submitted by the District Magistrate, Ayodhya, Uttar Pradesh. It is reported that the financial assistance to the tune of Rs. 3 Lakhs has been sanctioned to be paid to the victim boy namely Akhilesh Upadhyay directly to his bank account.
Report dated 22.12.2020 has been submitted by the Sr. Superintendent of Police, Ayodhya, Uttar Pradesh. It is reported that on the written complaint, the FIR No. 586/2020, U/Sec. 324/504/506/511 IPC and section 3/4 POCSO Act was registered at P.S. Ram Janambhoomi against the accused Baba Ramsewak Das, wherein he was arrested and sent to judicial custody. Later on charge sheet has been submitted vide CS No. 531/2020 in the instant case after completion of the investigation on 06.09.2020. Sanction has been granted to pay the financial assistance of Rs. 3 Lakhs to the victim boy.
Since, the investigating officer has investigated the case, submitted charge sheet in the matter and the law will take its own recourse. The financial assistance to the tune of Rs. 3 Lakhs has been sanctioned to be paid to the victim boy namely Akhilesh Upadhyay directly to his bank account, no further intervention of this Commission is required in the present case.
The case is closed.

Sir/Madam,
 
          I am directed to say that the matter was considered by the Commission on 02/08/2021 and the Commission has directed as follows.:
 
 
         In this case, the Commission received a complaint from Sh. Lenin Raghuvanshi, a resident of Varanasi, Uttar Pradesh, alleging that, the accused police officials on suspecting the victim of theft, severely assaulted him by putting their shoes on his face and beaten him mercilessly.

     The Commission took cognizance of the complaint on 10-02-2020 directed Superintendent of Police, Deoria, Uttar Pradesh to submit report within four weeks.

        The Commission received a report dated:30-08-2020 from the Superintendent of Police, Deoria, Uttar Pradesh, whereby, it was submitted that, on 08-01-2020 one Sumit Goswami was brought to the Police Station in connection with case Crime No.04/2020, P.S.- Madanpur, under section-379 of IPC.   It has been admitted that, the Head Constable Lal Bihari, Constable Chandra Mauleshwar Singh and Constable Jitendra Yadav used force during questioning of the accused and accordingly on the complaint of Sub Inspector Rama Shankar Yadav, Day Officer of the Police Station, NCR No.04/2020, under section-323, 504 of IPC has been registered against the delinquent police personnel and the same is pending investigation.  

       The Commission has considered the matter.   As per the police report, it appears that, the accused was subjected to custodial violence and as a result legal action has been initiated by the local police itself against the delinquent police personnel.   The action on the part of the delinquent police personnel is contrary to law and has resulted in violation of human rights of the victim.   In these circumstances, the Commission vide proceeding dated:01-02–2021, a Notice under section- 18 of the Protection of Human Rights Act, 1993 was issued to the Government of Uttar Pradesh through its Chief Secretary to Show Cause within six weeks as to why an amount of Rs.50,000/- as interim relief may not be recommended to be paid to the victim for violation of his human rights by the public servants.

        The Commission vide its proceeding dated:01-02-2021 directed the Senior Superintendent of Police, Deoria, Uttar Pradesh to submit status/ outcome of the case registered against the delinquent police personnel and details of departmental action taken against them within four weeks.

The Commission received a report dated:05-07-2021 from the Joint Secretary, Government of Uttar Pradesh, whereby, it was submitted that, the charge sheet has been filed against the delinquent police personnel before the Learned Court.    The show cause notice regarding the interim assistance of Rs.50,000/- given to the victim by the Superintendent of Police, Deoria, Uttar Pradesh, it has been requested to consider adjourning till the results of the trial of the Learned Court.

        The Commission has perused the report dated:30-08-2020 received from the Superintendent of Police, Deoria, Uttar Pradesh and report dated:05-07-2021 received from the Joint Secretary, Government of Uttar Pradesh.  It is pertinent to mention here that, the charge sheet has been filed against the delinquent police personnel before the Learned Court.  The show cause notice regarding the interim assistance of Rs.50,000/- given to the victim by the Superintendent of Police, Deoria, Uttar Pradesh, it has been requested to the Commission to consider adjourning till the results of the trial of the Learned Court.

         The Chief Secretary is directed to make  the payment of monetary compensation/ interim assistance of Rs.50,000/-   (fifty thousand) to the victim and transmit the copy of receipt in respect of payment made  within six weeks positively to the Commission.  

Put up on 23 September, 2021.
 
 
          It is therefore, requested that the compliance report in the matter be sent to the Commission latest by 07/10/2021, so that the same could be placed before the Commission.

          I am directed to say that the matter was considered by the Commission on 31/12/2021 and the Commission has directed as follows.:
 
 
         File has been put up before this Bench as Member(M-2) Justice Sh. P.C. Pant has demitted office.  

On 22.10.2021, the Commission took cognizance in the matter, as the complainant had brought to the notice of the Commission a news report wherein it was reported that a 18 year old vegetable vendor died after he was caught over charges of defying Covid-19 lockdown norms and mercilessly beaten by the Police Constable and Homeguard in Bangarmau in Unnao District. The victim succumbed to the injuries. The report further stated that both the police personnel had been suspended.

The Commission had directed to transmit the copy of the complaint to the District Magistrate, Unnao and the Superintendent of Police, Unnao, Uttar Pradesh calling for a report in the matter within six weeks.

The SP, Unnao had submitted a report that the deceased was brought to the police station by Constable Vijay Chaudhary and Home Guard Satya Prakash later on the allegations of assault by the police officer a case u/s. 302 IPC stands registered against the police officials.

Subsequently, Home Guard, Satya Prakash and Constable Vijay Chaudhary were arrested on 25.5.2021 and sent to judicial custody, while a service of Home Guard, Satya Prakash had been terminated.  

The report submitted by the SP, Unnao apparently makes out a case of violation of human rights of the deceased by the police officials, who apprehended him for the violation of lockdown protocol and thereafter assaulted him.   The fact of registration of FIR and disciplinary proceedings is sufficient admission on the part of local police, Unnao of the act of police atrocities leading to loss of life of a civilian, who was an 18 year old, petty vegetable vendor.   It was an appropriate case, where recommendation of compensation should be made by the Commission against the Government of UP for its vicarious liability for the acts of atrocities of the police officials.  

Therefore, a show cause notice was issued under section 18(a)(i) of the PHR Act, 1993 to the Govt. of UP through its Chief Secretary to file a reply in a period of six weeks, as to why the Commission should not recommend a compensation of Rs. 5 Lac (Rupees Five Lac only) to be paid by the State to the next of kin of the deceased.

The O/o. Supdt. of Police, Unnao has again requested the facts of incident and registration of case and disciplinary proceedings.  The report submitted does not indicate anything substantial to controvert the findings of the Commission for recommendation of compensation of Rupees Five Lakhs to the next of kin of the deceased, who lost his life due to acts of atrocities of police officer.

Thus, recommendation is hereby made to the Govt. of UP through its Chief Secretary to pay of compensation of Rupees Five Lakhs (5 Lakhs) to the next of the kin of the deceased.

The Chief Secretary to the State of Uttar Pradesh shall ensure disbursement of the compensation amount of sum of Rupees Five Lakhs to the next of the kin of deceased, under his personal responsibility and inform the Commission the same in a period of Four weeks.  

Put up after Four weeks.
 
 
          It is therefore, requested that the compliance report in the matter be sent to the Commission latest by 07/02/2022, so that the same could be placed before the Commission.

 "My life partner and I both have hectic work schedules and long hours working on  ground for the rights of marginalised people . This doesn't leave us much time to prepare homemade meals. So we often depend on packaged food. I lost my immunity due to my ignorance of its harmful effects. COVID made me realise this.

After my 12-day stay in the ICU due to COVID-19 infection in the second pandemic wave, I became more aware of my health and optimized my nutrition (high protein-rich diet) for boosting my immunity. I became aware that packaged food, which is high in fat, sugar, and salt, leads to obesity, as well as diabetes, hypertension, heart disease, and other non-communicable diseases (NCDs). 


While working among the marginalised, my alertness towards the packaged foods became my strength to spearhead a campaign for strong Front of Package Labelling (FOPL) in India for combatting NCD, childhood obesity, diabetes, hypertension and other diseases."  says Dr Lenin Raghuvanshi, an award-winning renowned human rights activist and physician.

अन्तर्राष्ट्रीय मानवाधिकार दिवस के उपलक्ष्य पर मानवाधिकार जननिगरानी समिति वाराणसी के द्वारा समिति के कार्यालय में यातना से संघर्षरत पीडितो का सम्मान समारोह कार्यक्रम का आयोजन किया गया| कार्यक्रम का संचालन ओंकार विश्वकर्मा द्वारा किया गया| जिसमे उत्तर प्रदेश के सोनभद्र जिले से आयी पीडितो को सम्मानित किया गया| कार्य्रकम को आगे बढ़ाते हुए समिति की कार्यकर्ता छाया कुमारी द्वारा पीडितो के साथ हुई घटना की टेस्टमनी को पढ़ा गया| जिसमे जान्ती देवी के पुत्र की जेल में हुई हत्या से जुड़ा मामला था| वही बनौरा से आई साईबा बानो को टेस्टमनी को फरहत शबा खानम के द्वारा पढ़ा गया| वही उषा देवी के साथ हुई घटना की कहानी को ज्योति कुमारी द्वारा पढ़ा गया| जिसके बाद उक्त सभी पीडितो को उनकी कहानी की कॉपी के साथ गमछा देकर सम्मानित किया गया| उक्त सम्मान समारोह कार्यक्रम में पीडितो ने अपनी कहानी सुनकर अपने पीड़ा को व्यक्त करते हुए जान्ती देवी ने कहा की पुलिस वाले को हम बोले थे की साहब मेरा बेटा निर्दोष है| उसे छोड़ दीजिये|इस बात पर पुलिस बोला था की छोड़ देंगे ढाई लाख रुपया ला कर दो हम बोले गरीब है साहब इतना पैसा नहीं दे पायेंगे| तब पुलिस ने कहा था की जमीन बेच कर दो हम पैसा नहीं दिये| पुलिस को पैसा न देने पर मेरे बेटे को जेल भेज कर मार दिया| वही बनौरा से आई साहिबा बानो ने बताया की उसके पति ऑटो चलाते थे| जिसे पुलिस पकड़ कर थाने ले गयी| जहा 10000 हज़ार रूपये मांग रहा था 10000 नहीं देने के वजह से मेरे पति को पुलिस ने हिरोइन का मुकदमा दर्ज  कर जेल भेज दिया| जहा पे जेल में उनके साथ मार पीट हुआ और वहा उनकी मौत हो गयी

 


इस तरह सभी पीडितो ने बारी बारी से अपने दर्द को सुनाया जिस पर मानवाधिकार जन निगरानी समिति की निदेशक श्रुति नागवंशी ने सभी से मिल कर उन्हें सांत्वना देते हुए न्यायिक कार्यवाही की बात कही उन्होंने कहा की हम आप सभी के इंसाफ के लिए लड़ेंगे, और आप सब को इन्साफ दिलायेंगे| आप अगर यहाँ आये है तो उम्मीद रखिये हम आपके संघर्ष में साथ है और आपके इन्साफ की लड़ाई पूरी तरह हमारी संस्था लड़ेगी| वही जय कुमार मिश्रा जी के द्वारा पीडितो को अन्य पीडितो को गमछा दे कर सम्मानित किया गया| कार्यक्रम में फरहत शबा खानम अरबिंद कुमार, पिंटू गुप्ता, एवं संस्था के अन्य कार्यकर्त्ता मौजूद थे!

- Statement for the 72nd Human Rights Day -


Human Rights Day was established in 1950 to commemorate the declaration of the Universal Declaration of Human Rights in 1948, working toward the dignity of everyone and for freedom, justice, and equality in the world. However, seventy-four years have passed since the enactment of the Universal Declaration of Human Rights, and the current experience of human rights on the globe is not hopeful. In some countries, democracy and human rights are declining due to the emergence of military dictatorship regimes. 

Many countries around the world, including countries in Asia (e.g., Myanmar, Thailand, Philippines, and Hong Kong) are facing a crisis of democracy due to authoritarian regimes. Citizens who have struggled at the hands of the military and regimes have been abducted or detained, have gone missing, and have had their human rights brutally destroyed. This is not a single country’s problem. Broken democracies and human rights on either side of the globe are affecting other countries like falling dominoes. 

In addition, between developed and developing countries, the COVID-19 vaccine has not seen equal distribution due to differences in the status of vaccine development and supply. Global pharmaceutical companies are the exclusive owners of medical technology, resulting in exorbitant vaccine prices and vaccine monopolies in developed countries. Also, the accessibility and inoculation rate of vaccines in developing countries are vastly different from those in developed countries. This has resulted in an inability to reach herd immunity, and as the world’s safety is threatened by the spread of mutations, such as the Delta and Omicron variants, people are made to fear COVID-19. In addition, the difference in the quality and quantity of education depends on digital accessibility, and this is becoming a serious problem when students cannot go to school during the pandemic. Educational inequality is clear evidence of social disparity among children in developing countries or marginalized regions, and it will eventually adhere to social and economic polarization. 

Additionally, the Black Lives Matter movement and anti-Asian hate crimes have shown that racial discrimination is occurring not only in the US and Europe but also in Asia. This did not happen overnight. These problems have exploded due to deep-rooted discrimination and prejudice, combined with the outbreak of COVID-19 and other social issues. Racism caused by nationalism and white supremacy will devastate a healthy civil society and gradually establish an exclusionary attitude toward other ethnicities and races. 

Accordingly, we urge the international community and governments of each country to do the following:

-     The international community should halt aid and cooperation with illegitimate military governments and authoritarian regimes.

-     International organizations, such as the United Nations Security Council, the United Nations Human Rights Council, and the International Criminal Court should strengthen their monitoring of crimes against humanity and seek active international measures to protect human rights.

-     The World Health Organization should come up with countermeasures to distribute vaccines to developing countries and marginalized groups.

-     Global pharmaceutical companies should temporarily exempt the application of intellectual property rights of COVID-19–related medical products and actively cooperate in the sharing of medical technology and the equitable distribution of vaccines.

-     The UN, each government, and global corporations should work together to come up with solutions that address educational inequalities caused by unequal digital access—for instance, by building an internet platform.

-     The government should conduct comprehensive research on race-, religion-, and gender-based discrimination through investigations on hate crimes, protect victims, and establish civic education programs for the realization of an inclusive democracy.

डॉ लेनिन रघुवंशी और श्रुति नागवंशी ने विश्व स्तर पर बढाया काशी और भारत का गौरव

9 नवम्बर, 2021 वाराणसी| आज होटल कामेश हट, लहुराबीर में प्रो० शाहीना रिज़वी, उपाध्यक्ष और जै कुमार मिश्रा, सदस्य सचिव ने प्रेस वार्ता को संबोधित किया| संबोधन के दौरान प्रो० शाहीना रिज़वी ने कहा कि कल 8 नवम्बर, 2021 को ग्लोबल सेंटर फॉर प्लूरलिज्म ने ग्लोबल प्लुरलिज़्म अवार्ड के लिए 10 फाइनलिस्टों की घोषणा की। इस वर्ष के फाइनलिस्ट में हमारे संस्था के सह - संस्थापक और सीईओ डॉ लेनिन रघुवंशी को चुना गया| डॉ लेनिन पहले और एक मात्र भारतीय है जिनका चयन इस अवार्ड के लिए किया गया है| उन्होंने आगे कहा कि यह सम्मान काशी के बहुलतावाद और श्रमण संस्कृति का है| स्थापना से ही हमारी संस्था मानवाधिकार जननिगरानी समिति मानवाधिकार संरक्षण के साथ बहुलतावाद और समावेशी संस्कृति को अपने बुनियादी मूल्य में शामिल करके उसी अनुसार अपने कार्यक्रम को जमीनी स्तर पर लागू करती है| ग्लोबल सेंटर फॉर प्लुरलिज़्म ने अपने प्रेस वक्तव्य में कहा कि 2021 ग्लोबल प्लुरलिज़्म अवार्ड के लिए 70 देशों से 500 नामांकन प्राप्त हुए। नामांकित व्यक्ति कठोर समीक्षा प्रक्रिया से गुजरते हैं और बहुलवाद से संबंधित अनुशासनों की स्वतंत्र विशेषज्ञों की अंतरराष्ट्रीय जूरी (जिसमे कनाडा के पूर्व प्रधानमंत्री है) द्वारा चुने जाते हैं। अफगानिस्तान, डोमिनिकन गणराज्य, कोसोवो, इज़राइल, भारत, केन्या, हांगकांग, कनाडा, मलावी में और विश्व स्तर पर-2021 के फाइनलिस्ट ने शिक्षा, सामुदायिक निर्माण, सामाजिक-आर्थिक विकास और कला के माध्यम से बहुलतावाद को आगे बढ़ाने के लिए असाधारण प्रयास किए हैं। विदित को कि ग्लोबल सेंटर फॉर प्लुरलिज़्म, एक स्वतंत्र स्वयंसेवी संगठन है जिसकी स्थापना महामहिम आगा खान और कनाडा सरकार द्वारा की गई है। संस्था की दूसरी संस्थापक सुश्री श्रुति नागवंशी को उनके महिला अधिकार, बाल अधिकार और शांति पर उत्कृष्ट कार्य के लिए 2021 पब्लिक पीस प्राइज के नवाजा गया| इस वर्ष यह पुरस्कार 5 देशो के 9 लोगो को दिया गया जिसमे कनाडा, भारत, कोलम्बिया, कांगो, लोकतान्त्रिक गणराज्य (डीआरसी) और पाकिस्तान को दिया गया| जै कुमार मिश्रा, सदस्य सचिव ने बताया कि संस्था हाशिये पर स्थित एवं उपेक्षित समूह को सेवा प्रदान करके समाज की मुख्य धारा से जोड़ने का काम विगत 25 वर्षो से कर रहा है| अभी चाइल्ड राइट्स एंड यू के सहयोग से मातृत्व व बाल स्वास्थ्य और अधिकार पर वाराणसी के 4 ब्लाकों में काम कर रहा है| साथ ही दो CMC का संचालन कर रहा है और वंचित समूह में कोवीड टीकाकरण लगवाने के लिए जागरूक कर रही है| यूनाइटेड नेशन वालेंटरी ट्रस्ट फण्ड फॉर टार्चर विक्टिम्स (UNVFVT) के सहयोग से मनो- सामाजिक सम्बल प्रदान करके पुनर्वासन करके उनमे पैरवी करती है| नोरेक, नॉर्वे और नेपाल की संस्था इन्सेक के साझा प्रयास के युवाओ की ट्रेनिंग और डायलाग का आयोजन कर रही है जिससे युवाओ को उनके भागीदारी, SDG और अधिकार के बारे में मालूम हो सके| उन्होंने आगे कहा कि हमारी संस्था शुरू से ही कुपोषण के मुद्दे पर लिखा पढ़ी और हंगर अलर्ट जारी करके जन आन्दोलन किया जिसके वजह से तत्कालीन सरकार ने कुपोषण और भूख के मामले में अविलम्ब 1000 रुपये का इमरजेंसी सहायता के लिए बजट का आवटन किया| हमारी संस्था अलीगढ और वाराणसी में दो कंसल्टेशन का आयोजन किया जिसमे एक पोषक तत्व प्रोफाइल मॉडल को शामिल करें जो डिब्बाबंद भोजन के माध्यम से नमक, चीनी और वसा की उच्च खपत को सीमित करता है, जिससे बच्चों के स्वास्थ्य और पोषण अधिकारों की रक्षा होती है। भारत में एक फ्रंट ऑफ पैकेट लेबलिंग (एफओपीएल) विनियमन होना चाहिए इसके लिए लेनिन जी ने माननीय प्रधानमंत्री को उनके जन्मदिन पर पत्र लिखकर कृपया मजबूत एफओपीएल के माध्यम से भारत के बच्चों के स्वास्थ्य को उपहार दें। जिसपर प्रधानमंत्री कार्यालय ने महोदय, आपकी शिकायत को नोट कर लिया गया है। FSSAI पैकेज्ड फूड प्रोडक्ट्स पर FOPL को पेश करने के लिए भी काम कर रहा है| इस मामले में सलाहकार समिति। यह निर्धारित करने के लिए IIM अहमदाबाद द्वारा एक सर्वेक्षण आधारित अध्ययन शुरू करने का निर्णय लिया गया है| वही सावित्री बाई फुले महिला की संयोजिका श्रुति नागवंशी और PVCHR की कार्यक्रम निदेशक शिरीन शबाना खान में राष्ट्रीय मानवाधिकार आयोग को शिकायत की| याचिका को संज्ञान में लेते हुए माननीय आयोग ने स्वास्थ्य सचिव, भारत सरकार से चार सप्ताह के भीतर जवाब माँगा है| संस्था कोविड वैश्विक महामारी के दौरान ऑक्सीजन कांसन्त्रटर (हेल्मा रिचा और इंडो- जर्मन सोसाइटी ऑफ़ रेमसाईड), प्रोटीन युक्त भोजन (न्यूज़ीलैण्ड हाई कमीशन) किचन गार्डन (इंटरनेशनल रिहैबिलिटेशन काउंसिल फॉर टार्चर विक्टिम्स) के सहयोग के इमरजेंसी असिस्टेंस दिया गया| संस्था द्वारा ESIC अस्पताल, वाराणसी को दिए गए सहयोग को श्रम एवं रोज़गार मंत्री, भारत सरकार एवं रोजगार राज्य मंत्री , भारत सरकार द्वारा हस्ताक्षरित प्रशस्ति पत्र अपर आयुक्त सह – क्षेत्रीय निदेशक, कानपूर द्वारा 12 नवम्बर, 2021 को सुबह 10 बजे प्रदान किया जायेगा| विदित हो कि इसके पहले संस्था के काम को जिला जेल वाराणसी और जिलाधिकारी वाराणसी द्वारा प्रशस्ति पत्र देकर भी किया गया था| प्रेस वार्ता के दौरान ग़ालिब सेंटर फॉर प्लुरलिज़्म के नक़्शे का फोटो दिखाया| इस सेंटर का निर्माण जनमित्र न्यास के प्रोग्राम ऑफिस के ऊपर इंडो- जर्मन सोसाइटी ऑफ़ रेमसाईड और इन्वेंट के सहयोग से किया जायेगा| इस मौके पर श्रुति नागवंशी और डॉ लेनिन रघुवंशी का सम्मान स्टाल और पेन देकर किया सम्मानित किया गया| उसके बाद संस्था के काम पर बने डाक्यूमेंट्री unspoken का लोकार्पण किया है

आज से सात साल पहले नरेंद्र मोदी ने जहां से भारतीय समाज और संस्कृति की बहुलता को चुनौती दी थी, दुनिया ने वहीं से बहुलता की रक्षा के लिए एक शख्स को सम्मानित किया है। #काशी के डॉ. लेनिन को आज दुनिया भर में बहुलता के संरक्षण के लिए प्रयासरत दस शख्सियतों की अंतिम सूची में शामिल किया गया। ग्लोबल सेंटर फॉर प्लुरलिज़्म यह पुरस्कार हर दो साल में एक बार दुनिया भर के व्यक्तियों, संगठनों और सरकारों को ऐसे अधिक समावेशी समाजों के निर्माण में अनुकरणीय उपलब्धियों के लिए देता है जहां विविधता की रक्षा की जाती है।
इस मौके पर कनाडा के पूर्व प्रधानमंत्री जो क्लार्क ने कहा, “बहुलवाद सम्मान, सहयोग और साझा उद्देश्य का एक ऐसा विवरण है जो समुदायों को गतिशील रखता है। इन शख्सियतों ने बहुलवाद में उल्लेखनीय योगदान दिया है। वे आज की दुनिया में अन्याय, असमानता और अपवर्जन की चुनौतियों से निपटने में मौलिकता और साहस को दर्शाते हैं।”
