In 2018, my heart swelled with pride and overwhelming emotion
as I was granted a "special mention" by the esteemed Jury for the
prestigious 2018 Special mentions Prize for Human Rights of the French
Republic. The recognition bestowed upon me was for my relentless efforts in
advocating and championing the rights of the oppressed Dalits in India. It was
a momentous occasion that filled me with a sense of purpose and dedication to
the cause I held so dear.
The Commission on Human Rights (CNCDH) took the initiative to
extend their heartfelt congratulations to me, acknowledging the significance of
my endeavors in advancing the rights of the marginalized and oppressed
communities in India. Their recognition of my role as an advocate further
validated the significance of the work I had undertaken.
However, despite the initial announcement of this momentous
honor, my heart was left with a sense of longing and uncertainty. To my dismay,
the His Excellency French Ambassador in India had not extended an invitation to
me for the grand awards ceremony scheduled on December 10, 2018. As a
consequence, I had not yet been able to stand before a captivated audience and
receive the well-deserved medal and certificate that would have been a
testament to the collective efforts of all those who had stood beside me in
this noble fight for justice.
The silence that followed this announcement was deeply
disconcerting. It left me grappling with a myriad of emotions, wondering why I
had been overlooked and denied the chance to receive the recognition I had
worked so tirelessly to earn. The weight of disappointment hung heavy in my
heart, as I yearned to celebrate the honor alongside my fellow human rights
advocates, feeling a profound sense of camaraderie and accomplishment.
Adding to the complexity of this situation was a past
publication on our blog, where I had expressed my concerns about the support of
Europe to Hindu Fascist thinking back in 2013. I wondered if this article had
somehow influenced the decision-making process or created any misunderstandings

Yet, despite the disappointment and the questions that
lingered in my mind, I remained steadfast in my commitment to the cause. My
passion for advocating the rights of the Dalits and promoting human rights for
all marginalized communities in India remained unshaken. I held on to the hope
that one day, I would be given the opportunity to stand on that stage, my heart
filled with pride and emotion, as I finally received the accolade that
symbolized the triumph of justice and compassion.
Until that day, I continue to wait, knowing that the fire of
determination within me will never waver. I am resolute in my belief that one
day, the silence will be broken, and I will be recognized for my contributions
to the betterment of humanity. The French Human Rights Prize may not have been
bestowed upon me in person yet, but the flame of hope burns brighter than ever
in my heart, driving me forward in my unwavering pursuit of justice and
equality for all.
This revelation has left me with an overwhelming need for
deeper investigation to understand the facts surrounding the award's allocation.
I cannot help but wonder why I, as the awardee for 2018, have been left in
limbo while others have been recognized. The feeling of being sidelined is
difficult to bear, and I yearn for clarity and transparency in this matter.
The thought that there might be internal conspiracy and
manipulation at play only intensifies the turmoil within me. As a staunch
believer in the values of democracy and pluralism, I am deeply concerned about
the potential ramifications of such actions. If deceit and dishonesty are
allowed to prevail, it could erode the very foundations of our pluralistic
democracy, casting doubt on the integrity of our institutions.
In the midst of these emotions, I am determined to seek the
truth and ensure that justice prevails. It is essential to uncover any hidden
agendas or biases that may have led to this perplexing situation. I firmly
believe that the truth must come to light, and I am willing to persevere in
this quest for transparency and fairness.
As I confront these emotions and the uncertainty that
surrounds the award I rightfully earned, I am driven by a fierce resolve to
protect the principles of democracy, equality, and justice. The path ahead may
be arduous, but I am prepared to face whatever challenges arise in the pursuit of
truth.
The recognition I earned for my efforts in promoting human
rights was not a mere symbol or accolade. It represented the acknowledgment of
the struggles and aspirations of the marginalized communities I stand for.
Therefore, the gravity of this situation cannot be underestimated, and I am

An initiative of Jan Mitra Nyas,Special Consultative Status with ECOSOC of UN
June 28, 2023, Varanasi| Today, a program titled "Rehabilitation
through Reintegration" was organized at Hotel Kamesh Hut in Varanasi,
honoring 26 survivors who have struggled with torture and oppression, from police
and administration. This program was organized jointly by Jan Mitra Nyas (JMN),
People's Vigilance Committee on Human Rights (PVCHR) with support of
International Rehabilitation Council for Torture Victims (IRCT), and the United
Nations Trust Fund for Torture Victims (UN Trust Fund for Torture Victim).
The chief guest of the program, Shri Ashutosh Sinha, Member of Legislative
said in his address, "Today, I am glad to be a part of this program and
witness the respect being given to survivors in the present circumstances.
These survivors have continuously fought for justice despite the challenges
they faced in their environment and struggles. They present an exemplary role
model for the upcoming generation. The way you all have continuously struggled
against torture and injustice in a constitutional manner to achieve justice is
commendable."
He further stated that the Indian government should ratify the United
Nations Convention against Torture (UNCAT) and also enact laws to prevent
immediate torture, along with providing rehabilitation for survivors. He
recommended implementing police and prison reforms. In the beginning, Dr. Lenin
Raghuvanshi, founder and coordinator of the People's Vigilance Committee on
Human Rights, said, "For the past 27 years, the PVCHR has been striving to
assist and reintegrate survivors of torture and organized violence into
society. In the past year, 150 individuals have been supported through
testimonial therapy. To enable comprehensive rehabilitation of torture
survivors and provide them with opportunities for dignified lives, 2261 families
were provided seasonal vegetable seeds for kitchen gardening, resulting in a
total production of 36,536 kilograms of vegetables. The Musahar community in
Anai has been provided goat farming facilities for 27 families. Widows affected
during the COVID-19 pandemic and 16 single women were provided sewing machines.
In the last six months, a total of 83 lakh 30 thousand rupees has been provided
as compensation to survivors, as directed by the National Human Rights
Commission."
Following this, the self-narratives and anguish of the 26 survivors
were read out, and they were honored by presenting them with garments and
sharing their stories of personal suffering.
In which 16
individuals (Ashwani Choubey, Narendra Tiwari, Satendra Tiwari, Sunil
Tiwari, Ankit Tiwari, Siddhanath Gaud, Vishwajeet Rai, Babli Devi, Dukhit
Gaud, Hariom Tiwari, Jagtaran, Nainatara Tiwari, Preity Tiwari,
Rampravesh, Shampoo Devi, Anil Tiwari) who are affected farmers and
laborers from Bihar's Buxar district, are protesting the acquisition of
land for the construction of the 1320 (2x660) megawatt coal-based thermal
project (BTPP) by SJVN Thermal Power Limited (STPL). The local police in
Buxar, with heavy police force, forcefully attempted to enter the houses
of the protesting farmers in Banarapur village. Similarly, they forcefully
entered each other's houses, breaking doors and started abusing and
beating women, children, and daughters-in-law. They even made children
undress in the freezing cold and beat them while pouring cold water in
front of their mothers and sisters.
Sanju Gautam from
Jaunpur district, whose only minor son lost his life due to the
irregularities of the school administration.
Abhinesh Singh, a
journalist from Mirzapur district, went for news coverage where the
police, using the pretext of the law, unjustifiably arrested and brutally
beat him, and filed a false case against him.
Along with this, in
the cases of Ramnath and Basanti from Sonbhadra, the police provided
protection to the accused and did not take appropriate action.

district was kept in the police station throughout the night and harassed.

वाराणसी: अंतर्राष्ट्रीय यातना विरोधी दिवस पर जनसंघर्षों के कार्यकर्ताओं ने अपना दर्द साझा किया
वाराणसी। “हम मर मिट जाईब धरना ना छोड़ब, हमरा के धमकियां मिलत बाय, हमनी के जमीन गईल बा, हमहन के बेटा-बेटी के सतावल जात बा कि डर के हट जा सभन, त सुनी लिहा साहब लोगन अब हमनी के पीछे नाहीं हटे के बा,.. चाहे…!”
चौसा, बक्सर (बिहार) की रहने वाली 85 वर्षीया तेतरा देवी की यह दर्द भरी दास्तान सुनकर भला कैसे कोई विचलित ना हो। उम्र के पचासी बसंत देख चुकीं तेतरा देवी के शरीर और चेहरे पर पड़ी झुर्रियों को साफ देखा जा सकता है, लेकिन उनके हौसले आज भी बुलंद हैं। हाथ में लाठी लेकर चलने वाली तेतरा देवी चौसा बिहार से चलकर वाराणसी आई हुई थीं। अवसर था ‘संयुक्त राष्ट्र अंतर्राष्ट्रीय यातना विरोधी दिवस’ के उपलक्ष्य में मनाए जाने वाले ‘लोक सम्मान समारोह’ का। जहां विभिन्न यातना के शिकार लोग उत्तर प्रदेश से लेकर बिहार के कई जनपदों से पहुंचे थे।
28 जून 2023 को वाराणसी के होटल कामेश हट में “पुनर्वास के माध्यम से उपचार” विषयक कार्यक्रम का आयोजन करके लोक विद्यालय और यातना से संघर्षरत 26 पीड़ितों का सम्मान समारोह का आयोजन किया गया। इस कार्यक्रम का आयोजन जनमित्र न्यास (JMN), मानवाधिकार जन निगरानी समिति (PVCHR), ‘इंटरनेशनल रिहैबिलिटेशन काउंसिल ऑन टार्चर विक्टिम’ (IRCT), यूनाइटेड नेशन ट्रस्ट फण्ड फॉर टार्चर विक्टिम (UN Trust Fund for Torture Victim) के संयुक्त तत्वाधान में किया गया।
यातना पीड़ितों का सम्मान समारोह
कार्यक्रम के मुख्य अतिथि वाराणसी स्नातक क्षेत्र से एमएलसी आशुतोष सिन्हा ने अपने वक्तव्य में कहा कि इस कार्यक्रम में सम्मिलित होकर बहुत अच्छा लगा कि वर्तमान परिस्थिति में यह सम्मान ऐसे पीड़ितों को दिया जा रहा है जो लगातार न्याय के लिए संघर्ष करते रहे हैं। उन्होंने पीड़ितो के संघर्षो की हौसला अफजाई करते हुए कहा कि जिस तरह से आप लोग यातना और अन्याय के खिलाफ लगातार संवैधानिक तरीके से संघर्ष कर रहे हैं वो आने वाली पीढ़ी के लिए एक आदर्श उदाहरण है। उन्होंने कहा कि भारत सरकार संयुक्त राष्ट्र यातना विरोधी कन्वेंशन (UNCAT) का अनुमोदन करे, साथ ही अविलम्ब यातना रोकथाम क़ानून बनाकर पीड़ितों का पुनर्वास भी करे। उन्होंने पुलिस और जेल सुधार को लागू करने की भी मांग की।
बिहार के चौसा कांड की गूंज
बिहार के बक्सर जिले के चौसा में पिछले 255 दिनों से किसानों और चौसा थर्मल पावर प्लांट से प्रभावित हुए लोगों का धरना चल रहा है। चौसा थर्मल पावर प्लांट का तकरीबन 80% कार्य पूर्ण हो चुका है, बावजूद इसके इससे प्रभावित हुए आसपास के किसानों को अभी तक न्याय नहीं मिल पाया है। पुलिस और प्रशासन इनका लगातार इनका उत्पीड़न कर रही है।
85 वर्ष की अवस्था पार कर चुकी तेतरा देवी चौसा बक्सर कांड का दर्द बयां करते हुए उग्र हो जाती हैं। इस उम्र में भी उनके मन मस्तिष्क पर चौसा कांड के उत्पीड़न का जो दर्द दिखलाई देता है उसे सुनकर सभागार में उपस्थित हर किसी की आंखें नम हो उठीं। बिहार के “चौसा कांड” के पीड़ित किसानों के दर्द को सुनकर बिहार समेत उत्तर प्रदेश के वाराणसी, जौनपुर, सोनभद्र और मिर्जापुर से आए पुलिसिया यातना के शिकार पीड़ित अपना दर्द भूल कर विचलित हो उठे।
पीड़ित तेतरा देवी
सामाजिक कार्यकर्ता संध्या ने बिहार के चौसा कांड पर बोलते हुए कहा कि “बिहार के संघर्षरत किसानों की वेदना की गूंज यूपी में हो रही है। काबिले तारीफ है कि ऐसे मुद्दों पर एक होकर सभी को आंदोलन छेड़ना होगा तभी सफलता सुनिश्चित होगी।”
बिहार अधिकार मंच के संतोष उपाध्याय कहते हैं कि “चौसा के किसान आंदोलनरत हैं। संविधान की सर्वोच्चता होनी चाहिए, लेकिन यहां तो फर्जी मुकदमें होते हैं, आंदोलनकारियों के परिवारों को पीटा जाता है, ताकि परिवार प्रभावित हों, परिवार प्रभावित होगा तो आंदोलन करने वाले लोग पीछे हट जाएंगे, ऐसी मानसिकता पैदा की जा रही है। मामला सिर्फ यातना-प्रताड़ना का नहीं है उसके बाद का है, जो पीड़ित पर मनोवैज्ञानिक असर डालता है।”
यूपी और बिहार में फर्जी गिरफ्तारियों के मसले पर बोलते हुए उन्होंने कहा कि “जिन मामलों में गिरफ्तार करने का कोई भी कानून नहीं है, वैसे मामलों में भी पुलिस अंधाधुंध गिरफ्तारियां करती है। कानून के रखवालों को लगता है कि इससे कानून बचेगा, लेकिन नहीं, इससे सिर्फ भय का वातावरण बनेगा।”
1860 में बने पुलिस एक्ट में बदलाव कि पुरजोर वकालत करते हुए संतोष ने कहा कि “गिरफ्तार व्यक्ति के क्या अधिकार हैं इस को लेकर डी.के. बसु गाइड लाइन हर थानों के नोटिस बोर्ड पर जरूर चस्पा होना चाहिए ताकि लोग जागरुक हों और पुलिस की तानाशाही और मनमानी यातना वाली प्रवृतियों पर रोक लगे।”
‘पुनर्वास के माध्यम से उपचार’ विषयक कार्यक्रम में मौजूद लोग
मई 2022 से चौसा आंदोलन जारी है। बिहार के बक्सर के तत्कालीन जिलाधिकारी अमन समीम भी किसानों से कोई सकारात्मक बात नहीं कर पाए। वहां के विस्थापित किसान विधि संगत ढंग से अपनी मांगों को लेकर अड़े हुए हैं। किसान कहते हैं कि जब तक अपनी मांगों को मनवा नहीं लेगें तब तक खामोश नहीं बैठेंगे।
किसान कहां जाएं?
यातना दिवस के उपलक्ष्य में मनाए जा रहे कार्यक्रम में बिहार से आए बृजेश राय ने तंज कसते हुए कहा कि “देश में प्रजातंत्र नहीं तानाशाही भरा माहौल चल रहा है। भूमि अधिग्रहण कानून में विसंगतियां व्याप्त हैं।” चौसा थर्मल पावर प्लांट पर चर्चा करते हुए उन्होंने कहा कि “हम लोगों को बहुत प्रताड़ित किया गया है। सरकार के लिए बुलेट ट्रेन चल जाए, फोरलेन बन जाए, रेल पटरी बन जाए अहम है, लेकिन किसान कहां जाएं? यह एक अहम सवाल है, इस पर देश के प्रधानमंत्री क्यों नहीं विचार करते हैं?”
उन्होंने आगे कहा कि “हम किसी भी योजना के खिलाफ नहीं हैं। हम गलत व्यवस्था और किसानों, आदिवासियों, प्रभावितों के उत्पीड़न के खिलाफ हैं।” वरिष्ठ पत्रकार विजय विनीत अपने तीन दशक से ज्यादा समय के पत्रकारिता के अनुभव को साझा करते हुए विभिन्न पुलिस मुठभेड़ों और यातनाओं की चर्चा करते हुए हाल के दिनों में बढ़ते पुलिसिया उत्पीड़न और फर्जी मामलों पर बात की। उन्होंने लगातार हो रहे मानवाधिकार हनन पर गंभीर चिंता जताई।
संघर्षरत पीड़ितों का सम्मान
सुशासन वाली सरकार भी खामोश
चौसा थर्मल पावर प्लांट को लेकर चल रहे किसानों के आंदोलन को कुचलने के लिए जिन दमनकारी नीतियों का सहारा लिया गया है वह भूलने और क्षमा करने योग्य नहीं है। यह कहते हुए पीड़ित नरेंद्र तिवारी का गला भर आता है। वह कहते हैं कि “9 जनवरी 2023 को धरना स्थल पर पुलिस आती है और किसानों के मनोबल को तोड़ने के लिए हर यातना का सहारा लेती है। पुलिसिया बर्बरता का वीडियो बनाकर वायरल करने वाले उनके बेटे को प्रताड़ित किया जाता है।” वो कहते हैं कि ‘यातना को याद करने मात्र से ही पूरा परिवार कांप जाता है। करवा चौथ वाले दिन भी पुलिस ने मां, बहन-बेटियों के साथ जो दुर्व्यवहार किया वह भूलने योग्य नहीं है।”
वह सरकार से सवाल करते हुए कहते हैं कि “यह अन्याय, अत्याचार के फिलाफ लड़ाई है, इसमें हम जीतेंगे। सुशासन वाली बिहार की नीतीश सरकार क्यों चुप्पी साधे है? किसान नहीं रहेंगे तो फैक्ट्री जो बिजली उगलेगी उसका क्या होगा? जो अन्नदाता है, जो सबका पेट पालता है, वह बेचारा बना हुआ है। वह अपनी उपज, जमीन का मूल्य निर्धारित नहीं कर पा रहा है।” वह कहते हैं कि “हम विकास के विरोधी नहीं हैं, लेकिन हमें ऐसा विकास नहीं चाहिए जो किसानों को उजाड़ कर तैयार हो?”
संयुक्त राष्ट्र में जाएगा मुद्दा
मानवाधिकार जन निगरानी समिति के संस्थापक संयोजक डॉ लेनिन रघुवंशी “जनचौक” को बताते हैं कि “चौसा थर्मल पावर प्रकरण में प्रभावित लोगों की पीड़ा को संयुक्त राष्ट्र संघ में उठाने की तैयारी है। जिस प्रकार से दमनकारी नीतियों के बल पर प्रभावित परिवारों पर जुल्म ढाए गए हैं वह कदापि क्षम्य नहीं है। पुलिस प्रताड़ना का असर यह है कि लोगों में आज भी भय बना हुआ है।” उन्होंने कहा कि “अंग्रेजों का भी कंपनी राज था, आज भी कंपनी राज चल रहा है, जो घातक है।”
कार्यक्रम में बोलते डॉ लेनिन रघुवंशी
उन्होंने कहा कि “किसानों, पिछड़े, दलितों और धार्मिक अल्पसंख्यकों के मौलिक अधिकारों का हनन किया जा रहा है। इसके लिए नए तरह के आंदोलन पर जोर दिया जा रहा है, ताकि दलित, पिछड़े, वंचित, मुसलमान, सिख, सभी को साथ लेकर मौलिक अधिकारों के हनन को रोका जा सके।”
तीन दशक से मनाया जा रहा है यातना विरोधी दिवस
पिछले 30 वर्षों से यातना विरोधी दिवस मनाया जा रहा है। दरअसल यातनाओं के शिकार लोगों के दर्द को कोई सुनना नहीं चाहता है, यहां तक कि अपनों का भी साथ नहीं मिल पाता है। ऐसे में लोगों को इस मंच के जरिए उपयुक्त मदद और न्याय दिलाना ही आयोजन के पीछे का मकसद है। इसी मकसद से 26 यातना पीड़ितों को सम्मानित किया गया।
यूपी के पीड़ितों ने सुनाया अपना दर्द
जौनपुर जिले की संजू गौतम, जिनके इकलौते नाबालिग बेटे की स्कूल प्रशासन की अनियमितता के वजह से जान चली गयी। मिर्जापुर के पत्रकार अभिनेष प्रताप सिंह न्यूज कवरेज के लिए गये थे जहां पुलिस ने कानून का बेजा इस्तेमाल कर उन्हें बेवजह गिरफ्तार कर लॉक-अप रखा और लाठियों से बुरी तरह पीटकर चालान कर दिया गया।
कार्यक्रम में सोनभद्र के रामनाथ और बसंती के मामले में पुलिस द्वारा आरोपी को संरक्षण देने और वाराणसी की अनीता को रात भर थाने में रखकर प्रताड़ित करने का मामला छाया रहा। कार्यक्रम में इन मामलों के लेकर चिंता जताई गई और इन्हें हर स्तर पर सहयोग का भरोसा दिलाया गया।
कार्यक्रम में शामिल विभिन्न संगठनों के कार्यकर्ता
कार्यक्रम में सावित्री बाई फुले मंच की संयोजिका श्रुति नागवंशी, जय कुमार मिश्रा, सुश्री शिरीन शबाना खान, रिंकू पाण्डेय, अभिमन्यु प्रताप, सुशील कुमार चौबे, छाया कुमारी, ज्योति, प्रतिमा, ओंकार विश्वकर्मा, संतोष उपाध्याय सहित वाराणसी, सोनभद्र के सैकड़ों लोग उपस्थित रहे।
पीड़ितों की मदद
मानवाधिकार जन निगरानी समिति के संस्थापक और संयोजक डॉ लेनिन रघुवंशी ने बताया कि “मानवाधिकार जन निगरानी समिति पिछले 27 वर्षो से यातना व संगठित हिंसा के पीड़ितों की मदद करके उनके जीवन को समाज में पुनर्स्थापित करने का प्रयास कर रही है। विगत वर्ष में 150 लोगों को टेस्टीमोनियल थेरेपी से संबल प्रदान किया गया। यातना पीड़ितों के समग्र पुनर्वास और उनको आत्मनिर्भर बनाने के लिये 2261 परिवारों को किचन गार्डनिंग के लिये मौसमी सब्जी के बीज दिए गए। जिसके जरिए कुल 36,536 किलो सब्जी का उत्पादन हुआ।
उन्होंने बताया कि अनेई मुसहर बस्तियों के 27 परिवारों को बकरी पालन के लिये बकरियां दी गईं हैं। कोरोना काल के दौरान विधवा हुई 16 महिलाओं को सिलाई मशीन दी गई हैं। साथ ही पिछले 6 महीने में कुल 80 लाख 30 हजार रुपये मुआवजा राष्ट्रीय मानवाधिकार आयोग के निर्देश पर पीड़ितों को मिला है।
