वाराणसी| 27 अगस्त, 2022 मानवाधिकार जननिगरानी समिति (PVCHR) पीपुल्स इनिशिएटिव फॉर पार्टिसिपेटरी एक्शन ऑन फूड लेबलिंग (पीपल), सावित्री बाई फुले महिला पंचायत द्वारा यूनाइटेड नेशन वालेंटरी फण्ड फॉर टार्चर विक्टिम्स (UNVFVT) व इंटरनेशनल रिहैबिलिटेशन काउंसिल फॉर टार्चर विक्टिम्स (IRCT) के संयुक्त तत्वाधान में “संवैधानिक अधिकार, स्वास्थ्य व पोषण” पर लोक विद्यालय  का आयोजन होटल डायमंड, भेलूपुर में 27 अगस्त, 2022  को किया| इस कार्यक्रम में वाराणसी शहर के तक़रीबन ६० लोग उपस्थित थे|

इस मौके पर  “कमेटी टू प्रोटेक्ट जर्नलिस्ट्स"  के सलाहकार व वरिष्ठ पत्रकार श्री कुणाल मजुमदार को जनमित्र सम्मान भारत में पत्रकारों की सुरक्षा को संबोधित करने और उसका दस्तावेजीकरण करने के लिए, उनकी अडिग और असाधारण प्रतिबद्धता के लिए दिया गया। यह सम्मान उन्हें महंत विशम्भर नाथ मिश्र, प्रोफेसर, विभागाध्यक्ष इलेक्ट्रॉनिक इंजिनीरिंग, आई० आई० टी, काशी हिन्दू विश्वविद्यालय और पंडित प्रभाष महाराज, सुप्रसिद्ध तबला वादक द्वारा दिया गया|

 

सम्मान प्राप्त करने के पश्चात श्री कुणाल मजुमदार ने कहा कि “स्वतंत्र और निष्पक्ष समाचार मीडिया के संचालन के लिए प्रेसस्वतंत्रता और पत्रकार की सुरक्षा अनिवार्य हैं। मैं वास्तव में एक जमीनी स्तर के संगठन द्वारा मान्यता प्राप्त करने के लिए सम्मानित महसूस कर रहा हूं|”

इस मौके पर संयुक्त रूप से दो वरिष्ठ पत्रकारों द्वारा लिखी पुस्तक का विमोचन किया गया|  सबसे पहले श्री अभिषेक श्रीवास्तव की पुस्तक आम आदमी के नाम पर : भ्रष्‍टाचार विरोध से राष्‍ट्रवाद तक दस साल का सफरनामा का विमोचन किया गया | उन्होंने अपने पुस्तक में भ्रष्टाचार विरोधी आन्दोलन से लेकर आम आदमी पार्टी वाया इंडिया अगेंस्ट करप्शन तक की राजनीति को समझने के लिए इसके नेतृत्व को समझना निर्णायक है| इस पुस्तक में उन्होंने समय – सन्दर्भ में रखकर समझने की कोशिश है, साथ ही उसके व्यक्तित्व के भीतर बदलते – बिगड़ते समाज – राजनीति का अक्स देखने की कोशिश भी है| 

उसके बाद श्री विजय विनीत द्वारा लिखी पुस्तक बनारसी घाट का जिद्दी इश्क विमोचन किया गया|उन्होंने अपने किताब में लिखा है कि एक रहस्य सरीखा है बनारसी इश्क| इसे बुझने के लिए  डूबना पड़ता है| ख़ुद किरदार बनना पड़ता है| इस शहर में इश्क तभी होता है, जब कोई रिश्ता अधूरा होता है| इसकी अनुभूति में ब्रह्म एकमेव सत्ता है, बाकी सब मिथ्या| विजय विनीत ने नफ़रत के दौर में प्रेम का सन्देश देकर मानवता निर्माण में मील का पत्थर साबित किया है|

अध्यक्षी उद्बोधन  में महंत विशम्भर नाथ मिश्र, प्रोफेसर, विभागाध्यक्ष इलेक्ट्रॉनिक इंजिनीरिंग, आई० आई० टी, काशी हिन्दू विश्वविद्यालय ने सबसे पहले सी० पे० जी० के सलाहकार श्री कुणाल मजुमदार को जनमित्र सम्मान के लिए बधाई दिया| साथ में ही उन्होंने दोनों वरिष्ठ  पत्रकारों के किताबो के लिए साधुवाद दिया| उन्होंने आगे कहा कि सी० पे० जी० के कार्य को सराहा वही उन्होंने भारत सरकार से माँग किया कि पत्रकार के सुरक्षा के लिए कानून बनाना चाहिए| उन्होंने मानवाधिकार जननिगरानी समिति द्वारा गठित  पीपल नेटवर्क को लोगो के स्वास्थ्य व पोषण पर कार्य करने व वंचित समुदाय को जागरूक करने के लिए धन्यवाद दिया|  उन्होंने आगे कहा कि “सरकार को अविलम्ब पैकेट फ़ूड पर विश्व स्वास्थ्य संगठन के मानक अनुसार वार्निंग लेबल लाना चाहिये जिससे गैर संचारी रोगों में कमी आ सके और अन्य देशो में खाद्य व्यापार भी बढ़ सके|

Sir/Madam, 

         The case No. 1394/20/5/2022 in respect of DR LENIN RAGHUVANSHI CONVENER PVCHR, was placed before the Commission on 23/08/2022. Upon perusing the same, the Commission directed as follows: 

         The Commission received a complaint from Dr. Lenin Raghuvanshi, a human rights activist from Varanasi, Uttar Pradesh referring to a news report published in Dainik Bhaskar on 08.04.2022 revealing that a girl student of DPM College, Bharatpur, Rajasthan has been subjected to torture in the name of raging due to which the girl student died. The complainant thus, requested the Commission to intervene into the matter.

Accordingly, the Commission vide proceeding dated 19.05.2022 called a report from the Principal Secretary, Department of College Eduation, Government of Rajasthan and the Superintendent of Police, Bharatpur, Rajasthan.

Pursuant to the aforesaid directions a report has been received whereby it is stated that on the basis of information received, the girl-victim was being eve teased by some boys who were troubling the victim and used to pressurize the victim to have a relation with them. A case was registered U/s 143,341,328, 306 IPC and statements of the victim's father and mother were recorded U/s 161 Cr.P.C. Further, a number of witnesses have also been examined and their statements were recorded and also were video graphed. The post mortem report of the victim was also obtained from RBM Hospital and viscera samples were also sent to SMS Hospital Jaipur and also to FSL Bharatpur.

The students who were studying with the victim, namely, Bhavna Saini and Raveena Gujar and those students who used to travel with the victim, namely, Radha, Neetu and Komal their statements have also been regarding the incidents that transpired on 05.04.2022, which has revealed that the victim was neither chased nor harassed while she was coming back from college nor was she forcibly made to drink or eat anything.

Notably, the report states that the witnesses Chandrabhan and Amit in their statements have said that on 04.04.2022 the accused Naresh and Vikam had come the deceased's college and harassed her. The said accused was also interrogated and information elicited from them has also been taken on record. The reports from SMS Hospital Jaipur and FSL Bharatpur are awaited.

In view of the detailed report, the Commission is of the considered view that no further intervention of the commission is required in the matter, as the investigation is conducted in a fair manner and the Law shall now take its due course.

As far as the arrest of the accused persons is concerned, they be arrested forthwith and investigation be completed at the earliest in the case.

Let the State Government show cause within 6 weeks, as why a compensation of Rs. 10 lakhs should be ordered to the next of kin of the victim.

Fifty thousands compensation and breaking of impunity in case of custodial torture

The Commission received a complaint on 16.1.2020 from Dr. Lenin Raghuvanshi of an NGO, forwarding a press clipping on brutal police assault by constables on a person suspected to be involved in a theft case in Deoria, UP and has prayed for intervention by the Commission in the matter.

Vide its proceedings dated 30.01.2022 the Commission observed and directed thus:-

“The Commission vide its proceeding dated:02-08-2021 directed the Chief Secretary, Government of Uttar Pradesh to make the payment of monetary compensation/ interim assistance of Rs.50,000/- fifty thousand) to the victim and transmit the copy of receipt in respect of payment made within six weeks positively to the Commission.

The Commission has not received any reply from the Chief Secretary, Government of Uttar Pradesh to make the payment of monetary compensation/ interim assistance of Rs.50,000/- (fifty thousand) to the victim.

The Commission has considered the matter. The Commission has taken the serious view of the non responsive attitude of the Chief Secretary, Government of Uttar Pradesh. Let a notice be sent to the Chief Secretary, Government of Uttar Pradesh, calling upon the Chief Secretary, Government of Uttar Pradesh to submit his response qua non-payment of the monetary compensation amount of Rs.50,000/- to the victim within four weeks positively, failing which the Commission shall be constrained to issue coercive process u/s. 13 of the Protection of Human Rights Act, 1993.”

Pursuant to the above direction, the Superintendent of Police (Human Rights), Uttar Pradesh, Lucknow filed a report dated 07.05.2022 along with the proof of receipt dated 30.03.2022 of payment of compensation to Mr. Sumit Goswami (Victim) amount of Rs. 50,000/-(Fifty Thousand Only) as recommended by the commission vide proceeding dated 02.08.2021.

Considering the facts, the Commission has taken of view that in the present matter Head Constable Lal Bihari, Constable Chandra Mauleshwar Singh and Constable Jitendra Yadav used force during the questioning of the accused and accordingly on the complaint of Sub Inspector Rama Shankar Yadav, Day Officer of the Police Station, NCR No.04/2020, under section-323, 504 of IPC has been registered against the delinquent police personnel and the charge sheet has been filed before the Learned Court. Moreover, as per the direction of the commission the compensation of Rs. 50,000/-(Fifty Thousand Only) has been paid to the complainant.

In the given facts and circumstances, nothing is remained to be dealt with further in the present matter. Therefore, the present case is now closed without any order and direction.
