NHRC and right to development

These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 05.06.2014. Dr. Lenin, Secretary General, Manavadhikar Jan Nigrani Samiti on 9.4.2012 enclosed press clipping of "Dainik Jagran" dated 4.4.2012 in which it is mentioned that in Sampla Municipal Corporation, Rohtak a lot of money has been invested on sewer, street light and construction of drain but in Old Mandi Market, Sampla, Rohtak, but the condition of streets is pitiable even the drinking water is not available to the common man. The Commission on 8.6.2012 took cognizance and transmitted a copy of the complaint to the concerned authority calling for action taken report within four weeks. On 05.06.2014, the Commission observed and directed thus: "Let copy of the report be sent to the complainant for comments which should be received in the Commission within six weeks. The report is silent about providing drinking water by Municipal Corporation to Old Mandi Market, Sampla, Rohtak. Secretary, Department of Urban Development, Government of Haryana be asked to submit latest position of the development work in Old Mandi Market, Sampla and also report about the facilities provided for drinking water to the public in Old Mandi Market Sampla, Rohtak which should be received in the Commission within six weeks". No report was submitted by the Secretary, Deptt. Of Urban Development, Govt. of Haryana, despite final reminder dated 11.02.2015 and summon dated 01.06.2015. Therefore, the Commission was constrained to issue summon vide its order dated 01.12.2015 and directed thus: "The Commission takes a serious view of non-responsive attitude of the Secretary, Deptt. of Urban Development, Govt. of Haryana, and hence, directs its Registry to issue summons u/s 13 of the Protection of Human Rights Act 1993, to the Secretary, Deptt. of Urban Development, Govt. of Haryana, to appear before the Commission in person on 15.01.2016 at 11.00 AM, at Manav Adhikar Bhawan, Block-C, GPO Complex, INA, New Delhi-110023 along with requisite report in the matter". Pursuant to the directions of the Commission, Chief Engineer, Urban Local Bodies, Deptt., Haryana, appeared before the Commission and submitted a report of Sub Divisional Engineer-II, Urban Local Bodies, Haryana, Panchkula, dated 12.01.2016. The report revealed that development works in Old Mandi Market Sampla, is carried out by the Directorate of Urban Local Bodies, Haryana, and the report is as under: a. The construction work of Market Committee road has been completed by Municipal Committee, Sampla through the tender called on dated 20.12.2011. b. Later on the drains were also covered under D-Plan Scheme Head. c. The sanitation work was being executed by the Municipal Committee, Sample through the 30 employees who have been appointed on contract basis. d. The total street lights (1365+250= 1615 Nos.) are being maintained through agreement by the contractor. e. Total Budget provision for development work of Municipal Committee, Sampla, for the year 2015-16 was Rs. 760.00 lacs. The report further stated that the drinking water to the public in Old Mandi Market, Sampla, Rohtak, is to be provided by Public Health Engineering Deptt. (PHED) through the Sampla Town Water Works. The report further stated that there is no shortage of drinking water in the Municipal Committee area. However, to augment water supply in the Mandi area, a proposal to lay a separate 6" i/d Pipe Line to fill the Boosting Station, Sampla, has been undertaken which shall be completed by 05.02.2016. The Commission perused the report and observed that the construction of road and other facilities such as sanitation work, street light etc. has been provided in the Mandi Market, Sampla by the Directorate of Urban Local Body, Haryana. They have made provision of Rupees 760 lacs in the budget of 2015-2016 for development work to be carried our by Municipal Corporation, Sampla. This shall also augment the infrastructural facilities in the Mandi Market Sampla. However, Marketing Board has requested & deposited fund for construction of a separate 6" i/d to fill the Boosting Station, Sampla. The project was being executed by the Public Health Engineering Deptt., Rohtak, and the project, shall be completed by 05.02.2016. The Superintending Engineer, Public Health Department, opposite Treasury, Rohtak, be asked to intimate the present position of the supply of drinking water in the Mandi Market, Sampla and status of the new projects being undertaken for augmenting water supply in the area within six weeks. A copy of the report of the Sub Divisional Engineer-II, Panchkula, dated 12.01.2016 be forwarded to the complainant for comments, if any, within four weeks.
