Two cases of child protection (police torture, police inaction, trafficking and sexual abuse).

I am taking this opportunity to share that about two cases of child protection (police torture, police inaction, trafficking and sexual abuse). The detail of case are as follows:

1. Radha (Name changed)
Shri padmakar Shukla, Assistant Secretary, Government of Uttar Pradesh in letter no 59/2018/21 आई आर/छ- मा०-1/2018-19-3 (109)/13 wrote to Additional Director General of Police, Uttar Police head quarter, Allahabad that he is directed to inform that in the question with the Human Rights Commission the human rights violation found in this matter. Hon’ble Governor of Uttar Pradesh accepted for the interim assistance of 1 lakhs Rupees to Radha (Name changed) daughter of Saluka Jamdar resident of Gulkeda Gudasai under jurisdiction Chakradharpur west singhbhumi, Jharkhad state of India. This interim assistance amount will be recovered from the alleged police official.

2. Sahil Nut:   The matter relates to torture and illegal detention of victim Sahil, aged 10 years by police of P.S. Lanka (Sunderpur), Varanasi, Uttar Pradesh. The Commission had recommended an amount of Rs.1,00,000/- as interim relief to be paid to the victim. In response, Additional Superintendnet of Police, Protocol in the Office of Senior Superintendent of Police, Varanasi, Uttar Pradesh vide communication dated 2.4.2018 has submitted the compliance report. Perusal of the same reveals that an amount of Rs.1,00,000/- has been deposited on 9.1.2018in the bank A/c No.616562080001282 of victim Sahil. Proof of payment has also been annexed. The Commission has considered the matter. An amount of interim relief of Rs.1,00,000/- as recommended by the Commission has been deposited in the bank account of victim. The criminal case registered in the matter has already been chargesheeted. The Chief Secretary, Government of Uttar Pradesh and Director General of Police, Uttar Pradesh shall take appropriate action against the delinquent police personnel, who were allegedly involved in beatings, intimdating and unlawfully detaining the victim boy at the police station. The District Magistrate and Senior Superintendent of Police, Varanasi, Uttar Pradesh shall ensure proper rehabilitation, education and security of the victim and will see that benefits of Social Welfare Legislations are extended to him. Fifty one lacs and sixty thousands to 142 LABORERS AND CHILDREN IN SONBHADRA AND MIRZAPUR

Direction of National Human Rights Commission(NHRC) in case number 12889/24/69/2017 :
The complainant has alleged that worker working in District of Mirzapur and Sonbhadra are working in inhumane condition, paid less wages and are physically exploited. He further alleged that the family of the workers are sexually and physically exploited while some workers were even intoxicated. The health of the workers is of great concern. He has requested intervention of the Commission. Pursuant to the directions of the Commission, a report dated 06.09.2017 has been submitted by District Magistrate, Sonbhadra, Uttar Pradesh. It is reported that routine inspection are being conducted with the assistance of the Administration by the Labour Department. The minimum wages claim to the tune of Rs. 50 Lakhs (fifty hundred thousands Indian Rupees) has been filed by approx. 300 workmen, which has been successfully adjudicated by the Deputy Labour Commissioner, District Mirzapur. No complaint of child labour has been received, neither any violation found during inspection. 8 cases of violation of Child Labour (Prohibition & Regulation Act) has been registered before the Court of CJM, Robertsganj, Sonbhadra, Uttar Pradesh, wherein compensation of Rs. 20,000/- has been given to the said victim. The said child labour are relocated and provided basic education. The officers posted at the Districts are sensitized to be careful in case of any bonded labour. Since, steps has been taken by the District Administration in relocating and rehabilitating the child labours.

In the instant matter, the Commission had received a complaint/e-mail dated 13.5.2014 from one Dr. Lenin Raghuvanshi of an NGO alleging that there were riots in District Meerut and requested for an impartial enquiry to be conducted by an independent agency. The complainant prayed for compensation to the victims. Taking cognizance, the Commission obtained reports from various authorities. Pursuant to the directions of the Commission, the SSP, Meerut vide his communication dated 07.08.2014 reported that on 10.05.2014 there was communal violence in the jurisdiction of P.S. Kotwali Meerut on the issue of construction of drinking water facility near the site of a well. 32 separate cases were registered in the matter which are under investigation of the Crime Branch. 14 accused have been arrested in this connection and sent to jail. One person died, three persons sustained injuries and five other sustained losses of property. It was further informed that compensation of 13.00 lakhs to the next of kin of the deceased and various amounts to all those who suffered injuries and loss of properties has been sanctioned. DM, Meerut vide communication dated 14.08.2014 has forwarded a copy of the above report. Pursuant to the directions of the Commission dated 29.09.2014 the SSP, Meerut submitted a report of the Circle Officer (Crime), PS Kotwali Meerut dated 17.12.2014 which was considered by the Commission in its proceedings dated 21.1.2016. On consideration of the report of the SSP, Meerut, the Commission asked him to submit the outcome of the investigation into the relevant 32 cases complete in all respect as per the directions of the Commission dated 29.09.2015. Vide letter dated 28.06.2017, the Sub-Inspector, P.S. Kotwali, Meerutsent a consolidated statement of 32 cases. It was submitted that out of the 32 cases, in 27 cases charge-sheets and in 5 cases final reports hadbeen filed. Upon consideration of the report, the Commission vide proceedings dated 06.11.2017 directed the Chief Secretary, Govt. of Uttar Pradesh to submit proof of payment as SSP, Meerut and DM, Meerut vide their letters dated 07.08.2014 and 14.08.2014 respectively had informed that the sanction has been accorded by the State Government for payment of compensation for the victims. Pursuant to the directions of the Commission, ADM (City), Meerut vide communication dated 08.11.2017 has submitted that a sum of Rupees 13.00 lakhs was paid to the NoK of the deceased Shubham, Rs. 50,000/- each to the injured Shri Shitij Arora and Shri Babloo and Rs. 20,000/- to injured Shri Karar Ali through cheques dated 06/07-06-2014. It has also been informed that payment of Rs. 5,00,000/- to Shri Khaliq Ahmed, Rs. 28,000/- to Shri Piyush Tayal, Rs. 80,000/- to Shri Gian Chand and Rs, 5000 to Shri M. Naim has been made through cheques on 13.08.2014 for the loss of their properties. He has also forwarded proof regarding payment of compensation amount. In view of compliance of recommendation of the Commission, the case along with the linked file i.e. 19543/24/54/2014 is closed.
