The complaint dated 22/05/2021, was placed before the Commission on 24/05/2021. Upon perusing the complaint, the Commission directed as follows: |
The complainant has brought to the notice of the Commission a news report wherein it is reported that a 18 year old vegetable vendor died after he was caught over charges of defying Covid-19 lockdown norms and mercilessly beaten by the Police Constable and Homeguard in Bangarmau in Unnao District. The victim succumbed to the injuries. The report further states that both the police personnel have been suspended. Transmit the copy of the complaint to the District Magistrate, Unnao and the Superintendent of Police, Unnao, Uttar Pradesh calling for a report in the matter within six weeks. |
2. Accordingly, I am forwarding herewith a copy of the complaint as an attachment for taking appropriate action in the matter as per the directions of the Commission. It is requested that an Action Taken Report be sent to the Commission within 6 weeks from the date of receipt of this letter. |
3. The complaint dated 07/05/2021, was placed before the Commission on 20/05/2021. Upon perusing the complaint, the Commission directed as follows: |
The complainant has brought to the notice of the Commission an incident where one 28 years old prisoner Krishan Murari committed suicide by hanging himself with the gamcha at District Jail, Sonebhadra. The District Magistrate, Sonebhadra and the Superintendent of Police, Sonebhadra, Uttar Pradesh are directed to send the following reports to the Commission within six weeks: i. Detailed Report(covering all the aspects leading to death) (Including action, if any, taken on the complaint by relatives of deceased) ii. Inquest Report iii. Post Mortem Report iv. Video Cassette/CD of Post Mortem examination v. Chemical examination and histopathology report of viscera, if applicable vi. Final cause of death based on FSL report vii. Complete medical treatment record of the deceased viii. Site Plan of scene of occurrence giving all the details ix. Panchnama' of scene of occurrence x. Magisterial Enquiry Report (u/s 176 (1-A) Cr PC, as amended by Act 25 of 2005) Following reports, if applicable, may also please be sent:- i. Action Taken Report on the Magisterial Enquiry Report ii. Medico legal Certificate iii. Final Outcome/Status of Departmental action or Criminal Proceedings iv. CB/CID Inquiry Report, if applicable v. Copy of FIR, relevant GD entries and arrest Memo. Also, office to make enquiry if the Uttar Pradesh State Human Rights Commission has already taken the cognizance. Put up after six weeks. |

The complaint dated 14/05/2021, was placed before the Commission on 19/05/2021. Upon perusing the complaint, the Commission directed as follows: |
The complainant shares a newspaper clipping which states that the victim, a 92-year-old inmate of the district jail of Etah was chained to bed during his treatment in a hospital. The ADG, Prisons has suspended a Jail warden for his negligence. It is a very serious matter. The Commission fails to understand what fear is there from a 92 years old inmate. It shows how insensitive and selfish the jail attendants were. From this incident, a further inference can be drawn, if a 92 year old ill person is chained to bed during his treatment, the persons who can really be a threat, would be treated in more inhuman and barbaric manner. Keeping a 92 years old ill person in Jails indicates towards malfunctioning of Sentence Review Boards in the State. The larger and Institutional issue is, for the protecting the Human rights of the prisoners, the functioning of Sentence Review Boards in the State of UP should be improved. Under section 433 Cr. PC and Prison Rules, the Government has powers to commute the Sentence through Sentence Review Board. Functioning of Sentence Review Board in professional manner is necessary to decongest jails and relieve the burden of Government form taking care of a 92 years old ill person. The Chief Secretary Govt. of U.P. be asked to explain as to 1. When was the last meeting of Sentence Review Board held, 2. How many cases are pending before Sentence Review Board, 3. How many sentences have been commuted by Sentence Review Board in year 2020 and 2019, and 4. What system is being followed in Jails for referring the matters to Sentence Review Boards. Let the report be sent within 6 weeks. |
