These proceedings shall be read in
continuation of the proceedings dated 15.4.2014. Commission had perused the
complaint moved by Dr. Lenin drawing attention towards a newspaper item
published in Hindu on 8.8.2013 regarding child labour rescued from Manipur
Bakery. The Child Welfare Committee Thoubal District raided a bakery located
at Kakching Aeirak, the bakery owner Mohammed Jalalludin of Assam was found
taking work from the childrens at his bakery for a long time. The childrens
were never paid their wages. The police had also arrested Mohammed
Hellanuddin, the younger brother of accused Jalaluddin. The Manipur
Government granted Rs. 5,000/- to each of the boys and they were taken to
their home by police and officials of the Social Welfare Department of Assam.
Deputy Secretary to the Government of Assam, Social Welfare Department,
Dispur, vide communication dated 28.10.2013 submitted that Director, Social
Welfare, Member Secretary, State Child Protection Society to send the
District Child Protection Officer Karimganj and District Social Welfare
Officer, Thoubal District of Manipur. It was instructed that the boys who
have been rescued are to be escorted to their native home district where they
are to be united with their families after observing due formalities by Child
Welfare Committee. It has also been reported that the boys were taken on
21.8.2013 by the team of the Social Welfare officers to their home districts
and have been reintegrated with respective families after observing
procedure. Proper arrangements for their education are to be made and
directions had been issued in this regard. Child Welfare Committee, Thoubal,
have executed undertaking in presence of Km. A.K. Veera Devi, Hon’ble
Minister, Social Welfare and Cooperation Manipur. The childrens Taheruddin 15
years (2) Bahruddin 13 years (3) Abduluph 15 years (4) Shahmuddin 15 years
(5) Rekhamuddin 13 years (6) Shamim 14 years (7) Mohammed Sunjan (8) Shakil
Ahmed 14 years (9) Shirajuddin 17 years, have been restored to their
respective parents through Child Welfare Committee, Karimganj. Joint
Secretary, Government of Manipur, vide letter dated 22.5.2014 have informed
the Commission that Government had adopted a more vigorous effort to tackle
issues of the violation of child rights in the State and Child Welfare
Committees in each of the districts of the State are taking active role to
tackle issues of child trafficking. Commission has considered the reports.
All the nine child rescued by the Child Welfare Committee have been restored
with their parents along with the compensation of Rs. 5,000/- each. The
report of Government of Manipur is silent about the recovery of Rs. 20,000/-
each from the employers of the children as per the law laid down by the
Hon’ble Supreme Court in M.C. Mehta vs. State of Tamil Nadu and others (1996)
6 SCC 756 for contravention of the provisions of Child Labour (Prohibition
and Regulation) Act 1986. Commission directs Chief Secretary, Government of
Manipur to ensure the compliance of the Hon’ble Supreme Court direction and report
be submitted within eight weeks.
