Support to the survivor to improve his well-being and to again reconnect him

PVCHR in collaboration with SICHREM, a member organization of NATT organized training of trainer workshop on testimonial therapy from 5 – 15 June, 2012 at Indian Social Institute, Bangalore. In the workshop 12 participants were trained and 15 survivors were psychologically supported through testimonial therapy.

In the second week of workshop Mr. Bheema Sena, a survivor faced firing by the forest official and he now is disabled. He was financially supported with Rs. 10,000/- with support from RCT-PVCHR project. He will use the money to start weaving fishing net. Mr. Bheema Sena belongs to tribal community known as Jenu Kuruba (Honey hunter)[i] and now these tribes are in crises.[ii]

Direction issued by the CommissionThe Commission has come across a distressing press report captioned, "Human safaris exploit Jarawas with cops' that appeared in 'The Times of India' dated 11.1.2012. The press report, while referring to a news item that appeared in 'Observer' in UK, has alleged that naked Jarawa tribals who live in reserve forests in South Andaman are being made to dance in the nude before tourists for food and money during the course of 'human safaris' organized by operators in connivance with local authorities. The UK-based 'Observer' newspaper has also released a video showing a policeman, posted to protect the tribals, urging Jarawa women to dance after telling them he would give them food. The report describes tourists throwing bananas and biscuits to the tribals at the roadside, "as they would to animals in a safari park". It has further been alleged in the report that the local police have taught them to beg and to take away the money collected by the tribals in return for tobacco, which they never previously used, and food. The Commission issued notice to the Home Secretary, Ministry of Home Affairs, Government of India, New Delhi as well as the Administrator, Andaman & Nicobar Administration to submit a report in the matter within four weeks including action, if any, taken against the tour operators/police officials. A report dated 6.2.12 was received from the Principal Secretary (TW), Directorate of Tribal Welfare, Andaman & Nicobar Administration. As per the report, the police department initiated investigation on the report appearing in the print media in an FIR No. 07/2012 u/s 292/IPC read with section 67 IT Act 2000, Section 3 (1)(III) of SC & ST (Prevention of Atrocity) Act 1989 and 7/8 of A&N Islands (Protection of Aboriginal Tribes ) Regulation, 1956 and two persons featuring in the article which appeared in the “observer” have been arrested and sent to judicial remand. The Supreme Court in Special Leave Petition (Civil) No.12125 of 2010 has directed the Principal Secretary (Tribal Welfare) and other officers of the administration of Andaman and Nicobar to ensure total compliance of the prohibition contained in notification dated 30.10.2007 of the Directorate of Tribal Welfare, Andaman and Nicobar Admionistration, prohibiting any person other than a member of an Aboriginal tribe from entering the buffer zone for any commerical and / or tourism activities. विषय : असम मे हुये दंगो के बाद हिन्दू पक्ष द्वारा मुस्लिम पक्षो के साथ दुर्व्यवहार और ट्रेन मे आई कार्ड चेक करके उनके साथ मार-पीट और 14 लोगो को ट्रेन से फेके जाने पर 4 लोगो की मौत के सम्बन्ध मे।

महोदय,

       आप का ध्यान बी.बी.सी हिन्दी खबर की ओर आकृष्ट कराना चाहता हूँ, खबर के अनुसार पूर्वोत्तर ले लोगो के खिलाफ फैली अफवाह और दहशत के बीच बैंगलोर से असम के लिये जा रही विशेष ट्रेन मे शनिवार को पश्चिम बंगाल के जलपाईगुडी मे अचानक चलती ट्रेन के एक डिब्बे मे 40-50 की संख्या मे उग्र अराजक तत्वो द्वारा दोनो तरफ का दरवाजा बन्द कर दिया गया और लोगो से कहा गया कि वे अपना पहचान पत्र दिखाये जो भी इसका विरोध करेगा उसका गला काट दिया जायेगा। साथ ही सभी का मोबाईल, सामान और पैसा भी छीन लिया गया। फिर पहचान पत्र देखकर सारे मुस्लिमो को मारा पीटा गया। उस डिब्बे मे कुल 14 मुस्लिम व्यक्ति थे उनके साथ लगभग ढाई घंटे तक मार पीट की गयी और सभी 14 मुस्लिम व्यक्तियो को चलती ट्रेन से नीचे फेंक दिया गया। जिनमे से 4 लोगो की मृत्यु हो गयी और कई की हालत नाजुक बनी हुयी है उन्हे अस्पताल मे भर्ती कराया गया है जहाँ उनकी हालत नाजुक बनी हुयी है। ये सभी शव और घायलो को जलपाईगुडी के फलाकट और बेलाकोवा स्टेशनो के पास पाया गया है। उसमे बैठे लोगो का कहना है कि हिंसक हो चुकी भीड मे शामिल लोग उसी ट्रेन के यात्री थे और बैंगलोर से ही ट्रेन मे सवार हुये थे।

       अतः आप से विनम्र निवेदन है कि कृपया इस मामले को संज्ञान मे लेते हुये इस घटना की उच्च स्तरीय जाँच करायी जाय और मृतको और घायलो को मुआवजा दिया जाय। साथ ही दोषियो के खिलाफ मुकद्दमा पंजिकृत कराया जाय।

This is to bring to your kind notice that the Government of Odisha had declared to establish Special Court to undertake pendency cases related to atrocities on Scheduled Caste and Scheduled Tribes way back in may, 2010. These courts are yet to be established. Please see the link for detail:

Sir, violence against women is on rise in the state.  The Chief Minister has admitted in the State Assembly that there is an increase in total number of crimes of atrocity against women.  While atrocity cases were 9,659 in 2011, in 2010, the number of cases stood at 8,918. According to home department statistics, while 1,025 cases of rape were registered in the state during 2010, the number increased to 1,112 during 2012. The detail of the crime against women can be seen in the following link: http://www.pragativadi.com/280212/local3.htm

Given the above facts, I place the following requests before the Commission for urgent intervention: 

 NHRC to direct the state government of Odisha to immediately establish special Courts to try cases of atrocities against SC and ST. These courts should be established at the District Headquarters so that poor victims do not suffer financially. State should also ensure protection of victims and witness during the trial period. 

 The Commission should also direct the state to establish all women police stations at the district head headquarters. It should also be ensured that sufficient number of trained staff function in those stations round the clock.

Dr. Lenin, a human rights activist, has sought Commission's intervention and appropriate action on a newspaper report published in Amar Ujala, Varanasi edition, dated 6.8.2011 regarding detention of two and half times of the number of prisoners in the jails as compared to the sanctioned capacity. The Commission called for a report on the petition from DG Prisons, UP. Pursuant thereto, a report dated 14.5.2012 has been received from the Additional IG (Admn), Jail Administration and Correctional Services, UP, enclosing therewith a report of DIG Jails, Allahabad Region dated 27.1.2012. It was stated in the report that two and half times of the prisoners were detained in only two prisons considering the shortage of space to accommodate the large number of prisoners, the berths erected earlier in the barracks were dismantled creating more space. Now two to three times of the sanctioned capacity of the prisoners are being accommodated properly in the barracks. The other basic amenities of bathrooms, toilets and also the supply of soaps, oil, etc., are being provided to the prisoners. They are also getting required legal aid. At present, the construction of District Jail, Sonebhadra is almost complete. The prisoners of that District who were being lodged at District Jail Mirzapur are to be shifted to the newly constructed jail at Sonebhadra. It will considerably reduce the strength of prisoners detained at District Jail, Mirzapur. Similarly, 15 new barracks are being constructed at Central Jail, Varanasi to solve the problem of overcrowding of detenues. After the construction of 15 new barracks is completed, the convict prisoners will be shifted there, reducing the load of prisoners on the present accommodation at Central Jail, Varanasi. Sufficient toilets are available at the jails for use of the prisoners. Regular inspection of the jails are being done by the CJM of the concerned district and DIG Prisons each month. If any problem was found at the time of inspection, necessary instructions are being given to the concerned officials. So far the allegation of keeping the prisoners in solitary confinement in District Jail, Varanasi is concerned, it is reported that separate rooms were erected in the hospital of the District Jail, Varanasi, where the prisoners suffering from mental disease or infectious disease are being kept. The mental patients are treated by the specialist doctor. The Commission has considered the above reports. After perusing the above reports, the Commission is satisfied that proper arrangements are being made by the concerned authorities of the Prison and Correctional Services, Government of UP to accommodate the prisoners in various jails in the eastern region of the State. The prisoners are being given necessary amenities as per rules. They are also getting free legal aid through legal service authorities. Moreover, if there is any problem, the prisoners can put up the same before the inspecting authorities i.e., CJM, DIG (Jails) and also at the time of quarterly inspection by the District and Sessions Judge accompanied by the DM & SP of the district. No further action by the Commission is needed. The case is closed.

Muslim threats, nationalist fantasies and the 'Great Assam Exodus'


"Violence in Assam is localised with its particular history and context," human rights activist Lenin Raghuvanshi told AsiaNews.

However, for Raghuvanshi, who is director of the People's Vigilance Committee on Human Rights (PVCHR), such conflicts "have repercussions that explode in internal conflicts fuelled by the nationalism of fascist forces."

In his view, "India's greatest threat is an internal exodus provoked by internal nationalist groups (supporters of the Hindutva ideology) or external groups like Muslim fundamentalists."

Edmund Burke afirmó en el siglo XVIII que, en la India, la leyes de la religión, de la tierra y del honor están fundidas en una sola que vertebra eternamente a individuos y sociedades. Cientos de años después, en la actualidad, algunas organizaciones de la sociedad civil india denuncian las consecuencias de ese sistema. Entre ellas figura People’s Vigilance Committee on Human Rights (PVCHR), cuyos líderes recalcan que la universalidad de los derechos humanos no cala en el país por la resistencia de los círculos tradicionales a prescindir de los poderes conferidos por hábitos milenarios. Sin embargo, el intelectual vivo más reconocido del Subcontinente, Amartya Sen, nos recuerda cómo muchos siglos antes el emperador Ashoka, considerado el fundador de India, incluyó entre los objetivos de su gobierno la ausencia de agresiones, la imparcialidad y las buenas maneras hacia todas las criaturas.
De haberse trazado a finales de los 90 esta comparación entre la inflexible tradición descrita por Burke y PVCHR, y la armonía igualitaria de la que hace gala Ashoka, la defensa de la tolerancia predicada por este último habría sorprendido a muchos. Friction between Asian values and universal human rights emerges. Or maybe never was.



Edmund Burke said in the eighteenth century, in India, the laws of religion, land and honor are fused into a single vertebra that individuals and societies forever. Hundreds of years later, today, some civil society organizations denounce Indian consequences of that system. These include People's Vigilance Committee on Human Rights (PVCHR), whose leaders stress that the universality of human rights in the country creek no resistance by the traditional circles to dispense with the powers conferred by ancient habits. However, the most recognized intellectual alive Subcontinent, Amartya Sen reminds us how many centuries before the Emperor Ashoka, considered the founder of India, included among the objectives of his government's lack of aggression, impartiality and good manners towards all creatures.

Had traced to the late 90s this comparison between inflexible tradition described by Burke and PVCHR and egalitarian harmony which boasts Ashoka, the defense of tolerance preached by the latter would have surprised many. Just fifteen years ago, the debate on the irreconcilability of universal human rights and so-called Asian values was in full swing. The defense of the latter was based on the alleged incompatibility with human rights principles that enshrine traditional values order and collective versus individual freedoms. According to its proponents, the prominence of Asian values prevent degradation of the customs of the Western way of life. The idea was put forward by governors as Lee Kuan Yew, Singapore's former prime minister, who took it to new dimensions practices to popularize the idea that authoritarianism promotes economic development.


The opposition between Asian values and human rights promoted by Western liberal democracy part of a vague notion, since it is impossible  to encapsulate the complexity of the traditions of Asia into a single concept. However, it works as a unifying element for different countries that share economic and moral arguments to avoid interference. Lee's thesis seems to argue, without going any further, the development model and inflexibility brilliant policy of China, where the authoritarian pragmatism caters more to the sublimation of the national economic future than the corsets of tradition. In India, however, the universality of human rights has fallen by the wayside not only pragmatic visions of the future, but above all by the desire to preserve the traditional elites and the religious organization of society. Since Asia is a vast continent, each country is to avoid disparate motivations dive full in the universal regime of human rights.


The debate now seems outdated, but the Asian skepticism towards the concept of human rights survives. China continues perched on the indispensability of the heavy hand as the foundation of economic growth. India, especially in rural areas, is adept at unquestioned aegis of the caste system. In turn, the relationship of authoritarianism to economic success, which is normally considered more typical of the Subcontinent Far East, stands out among the Indian authorities. According to the latest report published by Amnesty International, Mahomman Singh's government focuses on economic growth at the expense of human rights.


Since Asia is a vast continent, each country is to avoid disparate motivations dive full in the universal regime of human rights.

The rise of Asian values and doubts about Western formulations are also present in the ongoing process of regional integration of human rights. After 45 years of common history, the nations of ASEAN are arranged in November to approve a declaration of human rights. Experts who have seen drafts of the text argue that, contrary to the defendant by the champions of Asian values, the document will not contain explicit references to prioritize the rights of the community over the individual. But beyond this progress, the declaration shall follow the inviolable principle of non-interference in the sovereignty of the Member States, so that its scope will be diminished input.

The statement will be further weakened by the geographic disparity, religious and cultural life of the countries comprising ASEAN, which includes communist regimes, constitutional monarchies, multiethnic democracies or authoritarian city-state. They also include metamorphosed always exceptional and Myanmar, whose opposition leader, Aung San Suu Kyi, is among the more regional political figures have criticized waterproof Asian values as the universality of human rights. Given the disparity of values and interests, Asian nations are not common purposes that encourage them to agree on the statement. Contrary to what happened in Europe, where the rise of communism and the trauma of Nazism provided very strong arguments for the adoption of the European Convention on Human Rights in Asia motivations seem less compelling and more subject to the predilections of each State .


The disagreement in this and other episodes spanning several continents, not just Asia. But it is in Asia where some of the most inspiring examples to relegate human rights background. From little Amartya Sen has served recalcase in 1997 that economic success does not depend on the heavy-handed, but the improvement of education, land reform, investment incentives and the rational use of international markets. Lee's theses are especially tempting at a time when Europe economic evidence and dismantles wear by cutting a part of the repertoire of rights enjoyed by its citizens. The rise of Asia and the decline of the West keep getting recurring cultural justifications for human rights not hinder state sovereignty and economic development.

Girls strive against Child marriage ‘Will not do kitchen, I want to get educated’ Ajai Rai 
Varanasi: Manisha’s marriage was arranged by her father Ramlal at the age of 13 with a man much elder to her in a temple. Members of the Munshi Premchand Bal Panchayat served notice to Ramlal and warned him for imprisonment. There was tension for several days and at last the girls managed to convince Ramlal to send Manisha to her in-laws only when she attains the age of an adult. This was the start of a campaign against child marriage. Gradually five other girls refused to marry at an early age. Voice of these five girls is now reaching high and there are 40 other fellows in the caravan. All have one target—oppose child marriage. First get educated and become self dependant and then enter the family way. Jyoti of Hukulganj, Pooja Thatera, Chanda Rajbhar of Bhagwanala, Madhuri Banwasi, Vimla Musahar of Kuwar Village have similar stories. All of these got married at the age of 13-14 years but refused to go with their in-laws. They told their parents that they are not ready to take up house hold responsibilities and strongly resisted any move taken to send them to in-laws. Says Chanda, “Memebers of Bal Panchayat performed street plays and I was their leader. When my marriage was fixed at a tender age of it was my responsibility to oppose it. I left food and water as protest and after a few days of struggle my mother agreed to my demand.” Vimla and Madhuri but didn’t had an easy path to victory. They had to leave their homes while protesting against their marriage and they came to PVCHR office where Shruti helped them. The family was given ultimatum of a police complaint in case they insisted upon child marriage. When the family agreed to postpone the marriage the people in the neighbourhood started criticizing the family. All the five girls were felicitated for their attempts at the public function organized on July 31, the anniversary of Munshi Premchand. All of these girls are getting educated and are in class 11 and 12. Not only these girls but 40 others who refused to child marriage are with them. The education for these girls is sponsored by Parul Sharma an NRI living in Sweden. In the district there are six Bal Panchayats running in the name of Premchand, Sant Raidas, and other great men in Chiraigaon, Belwan, Baghwanala. Children associated with these Bal Panchayats organize street plays and children parliament. Some of these children even raise issued with the officials such as the district magistrate. PVCHR coordinator Dr Lenin says it was after this campaign that he could understand that the mind of a child gets very deep impact with learning.

NHRC asks state govt to pay compensation to deaf & dumb boy


Therefore, the Commission asked the government of Uttar Pradesh through its chief secretary to pay Rs 3 lakh as compensation to the victim. The compensation money should be deposited in a nationalised bank as fixed deposit in the child's ac
count under guardianship of a responsible government official. The principal and accrued interest will be given to the victim when he becomes a major.
The Commission also received letter (dated 30.05.2012) sent by secretary, home (human rights), Section - I, Government of Uttar Pradesh, stating that the then Mirzamurad SHO Dhramveer Singh and constable Anjani Kumar Paswan have been found guilty for assaulting the child and not taking legal action. A penalty of censure has been imposed upon both of them for their lapses. The letter further states that the family of the deaf and dumb child could not be traced.

Direction issued by the CommissionThe complainant in his E-mail complaint dated 27.08.2011 alleged that a Constable of Mirjamurad police station of Varanasi District sexually assaulted a deaf and dumb child in the police station premises. It has also been alleged that the child was continuously being exploited in the police station for the last four months. The Commission vide its proceedings dated 13.03.2012 observed and directed as under: - "The Director General of Police, Govt. of Uttar Pradesh vide letter dated 17.10.2011 followed by another letter dated 04.01.2012 informed that the allegation of sexual harassment was not found true but a penalty of censure has been imposed on Shri Dharmbir Singh, Sub-Inspector and Shri Anjani Kumar Paswan, Constable No. 325 for physically assaulting a deaf and dumb child and not taking appropriate action in the matter. Copies of the traders imposing the penalty have been enclosed. The Commission has considered the material placed on the record and finds that the deaf and dumb child was not only kept illegally in the police station for a long period but was also physically assaulted. This establishes serious violations of the human rights of the child by public servants of the State of Uttar Pradesh. Let a notice u/s 18 (a) (i) of the Protection of Human Rights Act, 1993 be issued to the Govt. of Uttar Pradesh, through its Chief Secretary, requiring him to show cause why compensation be not recommended to the victim for gross violation of his human rights by the policemen. The Director General of Police, Govt. of Uttar Pradesh be asked to inform regarding the rehabilitation of the child. A response is expected within eight weeks." Pursuant to the communications of the Commission, the Additional Director General of Police (Human Rights), Uttar Pradesh informed vide letter dated 09.05.2012 that as per orders of the Child Welfare Committee, counselling was conducted by Child Line, Branch Ram Nagar, Varanasi and the matter was published in the newspapers but nobody came forward to adopt the deaf and dumb child, who writes his name as 'Mashay'. The letter further states that the child has been kept in Netaji Subash Chandra Bose Sewa Samiti, Jagdishpur, Sultanpur as per the decision taken by the Committee. The Commission also received letter dated 30.05.2012 sent by Secretary, Home (Human Rights), Section - I, Government of Uttar Pradesh stating that the then SHO, Mirja Murad Police Station Shri Dhramveer Singh and Constable Anjani Kumar Paswan have been found guilty for assaulting the child and not taking legal action. A penalty of censure has been imposed upon both of them for their lapses in this regard. The letter further states that the family of the deaf and dumb child could not be traced therefore, it would not be appropriate to provide any interim relief in this matter. The Commission considered the reply of its show cause notice dated 21.03.2012 received from the Secretary, Home (Human Rights), Section - I, Government of Uttar Pradesh and observes that there was apparent violation of human rights of the deaf and dumb orphan child in the police station for which the guilty officials have been taken up. The contention of the State government that the deaf and dumb child should not be provided any interim relief because his family could not be traced, is neither tenable nor acceptable. Indeed, the child needs more assistance from the State if he has no shelter of his family. Therefore, the Commission asks the Government of Uttar Pradesh through its Chief Secretary to pay Rs. 3 Lakhs as compensation to the victim. The compensation amount be kept in a Nationalized Bank as fixed deposit in the child's account under guardianship of a responsible government official. The Principal & accrued interest will be given to the victim when he becomes a major. A copy of the FD bearing an acknowledgement of the victim child is expected in the Commission within eight weeks. The Commission should also be informed whether adequate arrangements have been made by the Government regarding upbringing including vocational education of the orphan deaf & dumb child. A copy of these proceedings also be sent to the complainant for his information.

Dear Sir/Madam,
 I want to bring in your kind attention towards the attack happening with minorities in south Asian Country and every day we are looking in the newspaper/news channel.
On this serious concern Asian Association for Communal Harmony (ACHA) had launched signature campaign[i] with the given below pledge:
I will not intentionally use my hands or my words to harm anyone
I will treat my sister and daughter with at least as much love and respect as I treat my brothers and sons.
I will treat all my neighbours as deserving of my respect, regardless of their class, caste, sect or religion and
I will practice environment –friendly practices in my daily life.

Door to door campaign against torture and organized violence (DDCATOV)


After mass awareness campaign PVCHR moved to door to door campaign against torture and organized violence (DDCATOV) in its torture free model village developed by PVCHR under its initiative “Promoting psycho legal framework to reduce torture and organized violence” with support from RCT.

In process of door to door campaign against torture and organized violence the PVCHR activist together with community leaders will visit each and every family of the targeted marginalized communities in model village for given below reasons-

·      Increase public relationship against torture and organized violence 

·   Inculcate a  better strategy with the involvement of the community for developing torture free village

·  Linking the torture and organized violence with social and economical rights

They will sensitize them on all the Acts and directive guideline issued by Hon’able Supreme Court, National Human Rights Commission such as D.K Basu guideline, SC/ST (PoA) Act and D.V Act, 2005, RTE Act, Right to Health etc. At last they will gather at one place for developing comprehensive strategy for developing torture free village. 



The DDCATOV campaign is divided in four phase:

First phase: Badagaon block of Varanasi district & Tanda block of Ambedkar Nagar district

Second phase: Robertsganj block of Sonbhadra district

Third phase: Pindra block of Varanasi district

Fourth phase:  Domchach block of Koderma district of Jharkhand
