These proceedings shall be read in continuation of the earlier proceedings of the Commission. This case pertains to death of a seven year old girl due to fall in an open manhole on 27.03.12. Vide proceedings dated 11.04.16 the Commission had observed and directed as under:- “The investigation made it clear that the death occurred to the 7-year old girl due to negligence of the EDMC authorities and therefore, the State is vicariously liable. Hence, a notice be issued to the Govt. of NCT of Delhi, through its Chief Secretary, u/s. 18 of the Protection of Human Rights Act, 1993, to show-cause, within six weeks, as to why monetary relief of Rs.3,00,000/- should not be recommended to be paid to the NOK of the deceased girl.” In response the Dy. Secretary, Home-II, Home Deptt., Govt. of NCT of Delhi vide his letter dated 20.02.17 forwarded copies of some letters which were already considered by the Commission vide its proceedings dated 07.01.15. The Commission has carefully considered the reports. The Addl. Dy. Commissioner of Police, East District Delhi, vide his letter dated 28.03.2016 informed that during investigation, it was found that the incident occurred due to the lapse of the Junior Engineer, East Delhi Municipal Corpn. (EDMC). The manhole of water tank remained in the open area. Therefore, the Commission reiterates its earlier stand and once again requests the Chief Secretary, Govt. of NCT of Delhi to make the payment of Rs. Three Lakhs to the NoK of the deceased and send the compliance report alongwith proof of payment within four weeks. Since the Commission has delivered order of compensation all the link files be hereby closed. The leading case alone be continued. Inform the complainants accordingly.
