Building Resilience and Empathy: A Journey of Healing and Empowerment in Uttar Pradesh

PVCHR, in collaboration with the  United Nations Voluntary Fund for Victims of Torture (#UNVFVT) and the International Rehabilitation Council for Torture Victims (#IRCT), recently initiated a series of folk schools to confront a deeply troubling incident and dismantle the culture of silence prevailing in the region. Spearheading this endeavor was Ms. Shirin Shabana Khan, Program Director at PVCHR, who underscored the fundamental rights enshrined in Article 21 of the Indian Constitution. Her comprehensive insights into various forms of intervention and government helplines enriched the discussions, drawing the participation of 45 individuals.

The subsequent honoring ceremony, which spotlighted survivors of police torture, provided a platform for 12 individuals to share their poignant and harrowing experiences related to the same distressing incident. Notably, the testimonies of Mr. Suresh Giri Gosai and Mrs. Asha were shared with profound empathy, eliciting a shared sense of understanding and compassion. Symbolic of solidarity and support, the traditional Gamachha represented a powerful tribute bestowed upon the survivors. 

The testimony provided by Asha, a 32-year-old resident of Kalwari Bazaar, Thana-Madhihan, Mirzapur district, lays bare a distressing sequence of events. In the face of persistent power outages and water scarcities, the community sought to address their grievances peacefully. However, the intervention of the police exacerbated the situation, leading to turmoil and violence.

Despite the reassurances of Tehsildar Phoolchand Yadav that no charges would be brought forth, the community was dismayed to discover their names implicated in a case involving 117 people. The fear and sense of betrayal palpable in Asha's account reflect a loss of trust in the authorities and a vulnerability to being falsely accused.

Within Raup, the team learned of the complete electrification of the Ghasia ghetto, a significant milestone attributed to the intervention of Member of Parliament Shri Pakauri Lal Kol and human rights activist Lenin Raghuvanshi. This development brought a renewed sense of hope to a marginalized community that has long grappled with adversity.

The village, predominantly comprising the Ghasia Basti tribes, known for their rich cultural heritage and traditional dance forms, has faced numerous challenges stemming from territorial corruption and recurring famines. The persistent issue of a reliable water supply, exacerbated by broken pipelines, continues to be a pressing concern for the community, adding to their daily struggles. PVCHR's steadfast efforts in establishing a school within the settlement and their successful opposition to the construction of a stadium in the area underscore their unwavering commitment to uplift rural communities in India.

मेरा नाम सुरेश गिरी गोसाई है| मेरी उम्र 57 वर्ष  है|मेरे पिता जयराम गिरी है| मै अशिक्षित हूँ | नमकीन और कुरकुरे की फेरी लगाता हूँ| मेरे पास कोई खेती बारी नही है | इसी से जो कुछ आमदनी होता है तो खर्च चलता है| मेरे तीन बेटे सूर्यभान 37 वर्ष,चन्द्रभान 32 वर्ष और उदयभान 25 वर्ष है| सभी विवाहित है| मै कलवारी बाजार,थाना- मडिहान ,जिला-मिर्जापुर का मूल निवासी हूँ|

मुझे नही मालूम था की आज इतना बड़ा हादसा होगा| 2 जुलाई 2023 की तारीख थी| कई दिन से लोग बिजली के लिए परेशान थे| पानी की समस्या हो गयी थी| कई बार बिजली विभाग में कम्प्लेन किया गया| लोग अधिकारी के यहा गये | कोई सुनवाई न होने पर लोगो ने तय किया की शांतिपूर्वक चक्का जाम करेंगे| तभी इस समस्या से निजात मिलेगी | मेरे गैर मौजूदगी में मेरे दरवाजे के आस पास लोगो ने चक्का जाम किया |

जिस पर पुलिस आयी| लोगो ने अपनी मांग बतायी| लेकिन पुलिस ने उसका कोई हल न नही निकाला| बेवजह लाठी चार्ज करने लगे | मौके पर बिजली विभाग और तहसीलदार फुलचंद यादव जी आये | गाव वालो ने अपनी मांग रखी| जिस पर बिजली विभाग वालो ने लाईट ठीक कर दिया | चक्का जाम खत्म हो गया| तहसीलदार साहब ने गाव वालो को आश्वासन दिया की कोई मुकदमा नही होगा|मै मौके पर नही था|

 दुसरे दिन सुनने में आया अख़बार में यह घटना छपी है| अज्ञात में मुकदमा भी किया गया है | हम शामिल नही थे तो हमे किसी बात का डर नही था| हम अपने काम में लगे थे | अभी सितम्बर महीने के दुसरे हफ्ते में राम अवध सिपाही मेरे घर आये हमसे बोले तुम्हारे और बेटो के नाम पर मुकदमा है| यह सुनकर मै घबरा गया| मैंने कहा हम तो मौके पर नही थे | मेरे घर के आस पास था | इस वजह से बच्चे घर के बाहर खड़े थे|

राम अवध से मैंने कहा पुलिस हमारा नाम कैसे जानी| इस पर उसने कहा अगल बगल के गाव वालो ने नाम दिया है| यह सुनकर मेरा दिल घबराने लगा| हमारी गलती क्या है| जो हम लोगो के खिलाफ इतना बड़ा आरोप लगा है| रामअवध ने बोला अपना और सूर्यभान,उदयभान का आधारकार्ड दे दो |

मेरे पास आधार कार्ड था उसकी कापी दिया| दोनों बेटे बाहर मजदूरी करते है| उनका आधार कार्ड उनके पास है| राम अवध ने बोला उन्हें बुला लीजिये नही तो पुलिस उठा ले जाएगी|जब हमने पूछा कौन सी धारा लगी है तो बोले नही मालूम मै इतना पढ़ा लिखा नही हूँ| FIR की कॉपी मांगे तो बोले नही दे सकता आदेश नही है| हमसे साईंन करवाकर चले गये | जाते वक्त बोले जमानत करवा लो नही तो दुसरी पुलिस आएगी तो मार कर खराब कर देगी| राम अवध चले गये लेकिन मेरा दिल जोर-जोर से धडकने लगा | दोनों बेटो के पास फोन किया बोले चले आओ, वह सब बोले पैसा नही है| कर्ज उधार लेकर पैसा भेजे तो वह आये | तब से घर पर ही है| दोनों मजदूरी करते है| डर से घर पर है | तीन लोगो का जमानत करवाना है|

जमानतदार कहा से लाये | आमदनी इतनी होती है की पेट भरना मुश्किल होता है| जमानत कहा से कराए | इसी फ़िक्र में जी रहे है| फेरी पर जाता हूँ लेकिन भय बना रहता है|

इस घटना की वजह से हमारी जिन्दगी पर बहुत असर पड़ा है| हमे इस बात की तकलीफ है कि जो मांग जनता ने की थी वह बेजा नही था| लेकिन पुलिस ने उसे गलत तरीके से दिखाकर हम बेगुनाहों का जीना दूभर किया है| रात को नीद नही आती कुछ भी खाने पीने का मन नही करता है| बहुत बड़ी आफत आ गयी है| भविष्य की फ़िक्र लगी है|

मै यही चाहता हूँ कि इस पुरे मामले की निष्पक्ष जाँच हो जिससे हम बाईज्जत बरी हो |मुझे न्याय और सुरक्षा मिल सके|

My name is Suresh Giri Gosai. I am 57 years old. My father's name is Jayaram Giri. I am uneducated. I run a street food stall selling salty and crispy snacks. I don't have any farmland. Whatever income I earn is spent on expenses. I have three sons, Suryabhan, 37 years old, Chandrabhan, 32 years old, and Udaybhan, 25 years old. They are all married. I am originally from Kalwari Bazaar, Thana-Madhihan, Mirzapur district.

I didn't know that such a big incident would occur today. The date was July 2, 2023. People had been troubled by the electricity problem for several days. There was a water problem. The electricity department was complained to several times, and people went to the authorities. When no action was taken, people decided to peacefully block the road. That was the only way to get rid of this problem. In my absence, people blocked the area near my door.

The police arrived at the scene. The people expressed their demands, but the police didn't come up with any solution. They started charging without any reason. The officials from the electricity department and Tehsildar Phoolchand Yadav also arrived. The villagers expressed their demands, upon which the electricity department fixed the light and the roadblock was removed. Tehsildar assured the villagers that there would be no case. I wasn't there at the time.

The next day, it was heard that this incident was covered in the newspaper, and a case had been filed against the unknown. We weren't involved, so we weren't afraid of anything. We were busy with our work. In the second week of September, Ram Avadh Police constable came to my house and said that cases had been filed against me and my sons. Hearing this, I was frightened. I said we weren't at the scene; we were near my house. Because of this, the children were outside the house.

I asked Ram Avadh how the police knew our names. He said that the people in the neighboring village had given our names. Hearing this, my heart started racing. What was our mistake that such a big allegation was made against us? Ram Avadh asked for my and my sons' Aadhaar cards. I had my Aadhaar card, and I gave him a copy of it. Both my sons work as laborers outside, and they have their Aadhaar cards with them. Ram Avadh said to bring them, or else the police would take them away. When I asked which section was applied, he said he didn't know; he wasn't educated enough. When asked for a copy of the FIR, they said they couldn't provide it, claiming there was no order. They made me sign and left. As they were leaving, they said, 'Get bail, or else another police will come and harm you.' Ram Avadh left, but my heart started beating loudly. I called my sons and told them to come back. They said they didn't have any money. They sent money after borrowing, and then they came back. Since then, they have been at home. Both of them work as laborers. We are at home due to fear. We need to arrange for bail for three people. I wonder where to arrange for bail. I am living in this worry. I go to the stall, but fear remains.

This incident has had a significant impact on our lives. We are troubled that the demand made by the people was not fulfilled. The police have falsely shown it, making us innocent suffer. I can't sleep at night, and I don't feel like eating or drinking anything. A great calamity has befallen us. I am worried about the future. I just want a fair investigation of this entire matter so that we can be acquitted. I hope to receive justice and security."

मेरा नाम आशा है|मेरी उम्र 32 वर्ष है| मेरे पति राजू साहू है|मैंने पांच तक की शिक्षा ली है| मुझे दो बेटी और एक बेटा है|बड़ी बेटी 12 वर्ष,दूसरी 8 वर्ष और छोटा बेटा 5 वर्ष का है| मेरी एक छोटी सी पनचुरन की दुकान है| उसी से परिवार का पालन पोषण होता है| मै कलवारी बाजार,थाना-मडिहान,जिला-मिर्जापुर की रहने वाली हूँ|

 मै मूल रूप से प्रयागराज के कौडिहार बाजार नवाबगंज की रहने वाली हूँ| आज लगभग 10 वर्षो से मै यहा हूँ|हर कुछ दिनों पर बिजली खराब हो जाती है| कभी ट्रांसफार्मर में खराबी आ जाती है तो कही से कोई फाल्ट हो जाता है| आये दिन हम बिजली की समस्या से जूझते है|2 जुलाई 2023 की तारीख थी| कई दिनों से बिजली नही आ रही थी| पानी की समस्या हो गयी| घर का काम सब पड़ा हुआ था| पीने तक का पानी नही था|लगभग सभी के घरो में बोरिंग है| सब परेशान थे| सारा काम पानी से होना है| इस परेशानी को देखते हुए हम प्रधान के यहा गये| अपनी समस्या बतायी तो प्रधान पति जवाहिर पटेल ने कहा बरसात का पानी जगह-जगह गड्ढे में भरा हुआ है | उसे लेकर पीओ और अपनी जरुरतो को पूरा करो| नही तो जाकर चक्का जाम करो| सब लोगो ने बिजली विभाग और एसडीएम् साहब के यहा शिकायत की थी लेकिन कोई हल नही निकला|

तो लोगो ने तय किया की कलवारी माफ़ी में शांतिपूर्वक चक्का जाम कर अपनी मांग को रखे|सभी का रास्ता नही रोका गया था| कोई इमरजेंसी रहती तो लोगो को जाने देते और आवागमन बंद था| पुलिस को यह खबर लगी मौके पर पुलिस आयी| बोला इसे खत्म करो लोगो ने कहा बिजली बन जाये हम लोग हट जायेंगे| उसके बाद और पुलिस वालो की गाड़ी आयी आते ही वह लोग लाठी डंडा चलाने लगे| जो पत्रकार न्यूज कवरेज कर रहे थे | उनका मोबाईल छीन लिया आम लोगो का भी मोबाईल छीन कर मारपिट करने लगे|

गाव के राजेश देवा को पुलिस ले जाने लगी लोगो ने विरोध किया की राजेश देवा को छोडो या हम सभी को ले चलो| पानी की समस्या किसी एक की नही है| इतने में पीएससी की फ़ोर्स भी आ गयी| उस वक्त पुलिस ने ऐसा माहौल बना दिया था की सारी गलती हम लोगो की है| मौके पर बिजली विभाग वाले भी आ गये| तहसीलदार फूलचंद यादव जी भी आये| हम लोगो ने कहा साहब बिजली नही रहेगी तो कैसे गुजारा होगा| तहसीलदार जी के कहने पर बिजली विभाग के लोगो ने लाईट सही किया| यही काम पहले कर देते तो हम लोग चक्का जाम नही करते| तहसीलदार फूलचंद जी ने हम लोगो को आश्वासन दिया की घबराइये नही किसी के खिलाफ कोई मुकदमा नही होगा|

बिजली आने के बाद सब अपने-अपने कामो में लग गये| दुसरे दिन जब सुबह अख़बार आया तो पता चला 117 लोगो पर मुकदमा हुआ है| यह देखकर सब घबरा गये| कोई नामजद नही था सभी अज्ञात थे| यह सुनकर मन में एक डर सा हो गया| पुलिस का कोई भरोसा नही है| वह किसी बेकुसूर का नाम डाल सकती है|

जिस बात का डर था वही हुआ| सितम्बर के दुसरे हफ्ते में राम अवध सिपाही आये बोले 19 लोगो के नाम मुकदमा हुआ है| जिसमे 18 आदमी है| औरतो में मेरा नाम है| यह सुनकर बहुत तकलीफ हुई हमने कौन सा ऐसा गुनाह कर दिया जो हमारे नाम से मुकदमा हो गया| रामअवध सिपाही ने एक पन्ने पर साईन करवाया| मेरा आधार कार्ड ले गये| हमने पूछा कौन सी धारा लगी है| तो बोला 41 A की धारा लगी है| सब लोग जमानत करा ले नही तो पुलिस गिरफ्तार कर लेगी|

यह सुनकर बहुत दुःख हुआ| हम क्या गलत कर रहे थे| पानी,बिजली हमारी जरूरत है| यह भी नही मिलेगा तो कैसे जियेंगे|इस घटना से मन में एक डर सा हो गया है| एक फ़िक्र लगी हुई है| कहा से जमानत दार लाये|रात को यही सोच सोचकर नीद नही आती| हर वक्त दिमाग में यही बाते घुमती रहती है|सिर हमेशा भारी-भारी सा रहता है|

मै चाहती हूँ कि इस घटना की निष्पक्ष जाँच हो| हमने कुछ गलत नही किया है| हम पर जो भी मुकदमे लगाये गये है| उससे हमे बाइज्जत बरी किया जाय|

"What crime have we committed that a case has been filed in our name?”

My name is Asha. I am 32 years old. My husband's name is Raju Sahu. I have received education up to the fifth grade. I have two daughters and one son. My eldest daughter is 12 years old, the second one is 8 years old, and the youngest son is 5 years old. I have a small grocery store, which supports our family. I reside in Kalwari Bazaar, Thana-Madhihan, Mirzapur district. Originally, I am from Kaundihar Bazaar, Nawabganj, Prayagraj.

I have been here for almost 10 years. Every few days, there is a power outage. Sometimes, there is a fault in the transformer, or there is some issue elsewhere. We struggle with electricity problems every day. The date was July 2, 2023. Electricity had not been available for several days. There was a water problem. All the household work had piled up. There was no water even for drinking. Almost every house has a boring well, but everyone was troubled. All the work is dependent on water. Considering this trouble, we went to the village head. When we explained our problem, the head, Pati Jawahar Patel, said that the rainwater had filled the potholes everywhere. Take it and fulfill your needs, or go and protest. No one's path was blocked. If there were emergencies, people were allowed to go, and the gathering was peaceful.

The police got wind of this, and when they arrived, they said to end it. The people said if there is electricity, we will leave. After that, when the police vehicles arrived, those people started using batons. The journalists covering the news were also robbed of their mobile phones, and they started snatching the phones of ordinary people and beating them.

The people started taking Rajesh Deva of the village to the police, and the people protested, saying either release Rajesh Deva or take all of us. The water problem is not of just one person. The PSP force also arrived. At that time, the police created an atmosphere where all the blame was on us. The officials from the electricity department also arrived. Tehsildar Phoolchand Yadav also came. We told him, "Sir, if there is no electricity, how will we survive?" On the Tehsildar's instructions, the people from the electricity department fixed the lights. If they had done this work earlier, we wouldn't have caused the traffic jam. Tehsildar Phoolchand Ji assured us that there is no need to worry; there won't be any case against anyone.

After the electricity came, everyone got back to their work. The next day, when the newspaper arrived in the morning, it was found that a case had been filed against 117 people. Seeing this, everyone got scared. No one was well-known; everyone was unknown. This news instilled a sense of fear. There is no trust in the police. They can frame any innocent person. What we feared happened. In the second week of September, Ram Avadh Sipahi came and said that cases had been filed against 19 people, including 18 men and one woman, and my name was among them. Hearing this caused a lot of pain. What wrong had we done? Water and electricity are our necessities. How will we survive without them? With this incident, a fear has settled in the heart. There is constant worry. Where to arrange for bail? These thoughts keep me up at night. The head always feels heavy.

I want an unbiased investigation into this incident. We haven't done anything wrong. The cases filed against us should be dismissed, and our dignity restored.

वाराणसी क्षेत्र के भेलूपुर थानान्तर्गत बजरडीहा में निःशुल्क स्वास्थ्य शिविर का आयोजन जनमित्र न्यास व मानवाधिकार जन निगरानी समिति के तत्वाधान में किया गया| यह स्वास्थ्य शिविर यूनाइटेड नेशन फण्ड विक्टिम ऑफ टार्चर के आर्थिक सहयोग से किया गया| जिससे संघर्षरत पीडित स्वास्थ्य सेवा से लाभान्वित हो| जिसमें कूल 130 लोगो का इलाज डॉ शुभम यादव द्वारा किया गया| बच्चों में ज्यादातर बुखार, खासी, महिलाओ में खून की कमी, कमर दर्द, किशोरियों में एनिमिया खून की कमी चक्कर आना माहवारी समय से ना आना और भूख न लगने की समस्या पाया गया जिनका इलाज कर उन्हें दवा समय समय पर खाने की जानकारी दी गयी| वही जन मित्र न्यास की एएनएम चमेली देवी द्वारा गर्भवती महिला व किशोरियों को दवा वितरण कर खान पान पर चर्चा की गयी|तथा क्षेत्र की आंगनवाड़ी कार्यकर्ती ज्योति मिश्रा द्वारा बच्चो का वजन कर उनके माता पिता को उचित खान पान की सलाह दी गयी| उपरोक्त स्वास्थ्य शिविर में डॉ शुभम यादव तथा समिति से छाया कुमारी,ज्योति कुमारी, राजेन्द्र प्रसाद, विनोद कुमार, कृष्णकुमार, संजय राजभर,और पार्षद इरफान सहित समुदाय के अगुआ लोगो की भागीदारी रही|
