I want to draw your kind that today around 3:30 when Dr. Lenin Raghuvanshi, Convener of PVCHR went to Bagwanala Hall Mauza, under Jaitpura Police Station to see the newly under construction school building, he saw Mr. Turre alias Mr. Ghan Shyam was standing their, after looking Dr. Lenin he immediately rush with his pulsar motorbike. Dr. Lenin immediately rang on 100 to call police, but the receiver of phone suggested him to call Pandeypur Police Chowki incharge under Cantt police station and he gave him the contact no. 0542 – 2503546 of Cantt police station.

 

Two days before Pandeypur police Chowki incharge came to PVCHR office and enquire about the injury of Dr. Lenin and the address of Mr. Turre alias Ghanshyam.

Politics for silence under the rule of lord: collision of caste, patriarchy and corruption


Widespread corruption and the near-impossible task of exposing it, has rendered many of the government-sponsored schemes in rural India a failure. Neither the state government nor its agencies like the revenue department and the police have shown much active interest in the problem. When ordinary villagers protest and fall victim to landlord-sponsored violence, their protection often falls to human rights defenders. This has led to many such defenders being abused, injured and killed.

 

It is noted that PVCHR activists are human rights activist facing threat, the threat is also an infringement of the right to association and freedom of speech and expression of the community that PVCHR work with and also against PVCHR activists. In the caste based feudalist setup in rural villages of India, the village head and officers at the local bodies like the Block Office and the local police officers is pretty much what government is. What these officers do to the ordinary people is what governance is. Most often due to inadequate monitoring mechanisms these officers exploit their authority and position in the villages to such extent that the ordinary villagers are forced to pay bribes and the like to these officers to avail their services.

The villages are remotely located in many parts of India that even the district administration finds it difficult to be in touch with the village and block level officers even to verify the implementation of government welfare programmes. The fact that the PVCHR is organizing the villagers and protesting before authorities is an act of trying to link the severed connection between government schemes and actual implementation at the grass-root level. This act often becomes a direct challenge to the authority of those officers in rural areas who thus far had been enjoying the illegal benefits of lack of accountability. When such protests are organised and attended by the members of the lower caste, who were so far under the absolute control of the petty officers and their corrupt practices it poses a further threat to the authority of these officers. For all these reasons Mangala and his work is at risk. Additionally, in a state like Uttar Pradesh, were death threats turn real often, there is good reason why a person like Mangala should take all precautions to ensure that he himself and the people for whom he work remains safe.

 

The village sabha meeting of Ahirani Nathipur was arranged on 6th July, 09 in the primary school instead of the open space. In the meeting village head husband Mr. Arun Singh alias Lolarak Singh was continuously influencing and misbehaving with the presented village sabha members. The member informed to BDO and SDM, Pindra. The meeting peacefully proceeds after the intervention of the Kathirao police outpost in charge.  So, the responsibility of BDO is to inform police and administration but he did not do so.

 

 

According to local reports, the head position at Nathaipur village at Varanasi in India was reserved for a female candidate in the past election. The local landlord Lolarak Singh put his wife, Usha Devi forward for the post and since then for all practical purposes, Lolarak has managed the office, allegedly controlling the village with a group of aggressive henchmen and paying regular bribes to village officials. It appears to local activists that officials have colluded in the misappropriation of funds meant for development programmes. The arrival of Singh at the audit with the BDO, plus the lack of action taken by the officer, has done little to assuage these suspicions.

 

A social audit was arranged at the Ahirani Community Centre in Nathaipur village on 14 September by the Badagaon Block Development Officer (BDO). The audit was to look into the operation of the National Rural Employment Guarantee Act, 2005 (NREGA), which is operated by the Village Panchayat – the smallest village administrative unit, last amended in 1999 under the Uttar Pradesh Panchayat Raj Act, 1947. The NREGA is a central government scheme that provides employment to the poor and is supposed to work in tandem with the Panchayat to make sure that village affairs are attended to on a grassroots level and that villager are empowered.

The elected village head is charged with keeping payment records under the scheme, and the social audit has been built into NREGA to avoid corruption and allow villagers to lodge complaints. Local human rights organisations are also invited to participate in the audit to ensure transparency.

Though the village head, Ms. Usha Devi, was not present for the audit, her husband, Mr. Lolarak Singh arrived at the community centre with BDO Mr. Atul Mishra, in the latter's vehicle. However when Mishra started reading out the payment records to the villagers, according to procedure, many found that they were falsely recorded as having been employed and paid. A Mr. Lalji objected to the entry of his name in the list, which recorded too many working days. Others started to complain, and claim that embezzlement had taken place.

According to our reports, Singh along with staff of the Village Panchayat, including Mr. Anil Dubey, the Village Secretary and the Assistant Development Officer verbally abused the villagers, and then started to physically push them around. Various women were struck, including a Ms. Chandra Devi. Activists note that Singh and the officers were then joined by known underworld figures, who had been keeping a low profile at the meeting. They reportedly started to beat the villagers, shouting that low caste Dalits have no right to complain against their upper caste masters.

Lalji and Mr. Magala Rajbhar, an activist associated with the PVCHR, tried to intervene and keep the peace, but were beaten by Singh. The BDO called off the meeting and made moves to leave. When asked to call the police by two female PVCHR staff members (Ms. Shruti and Ms. Anupam), he claimed that he would rather report it personally. Shruti requested that she and Lajli go with him and the three tried to leave, but a mob of upper caste men led by Singh reportedly surrounded the vehicle and demanded that Lalji get out. At this point Mishra allegedly pushed Lalji out of his vehicle, and Shruti followed, fearing for his safety. The two were beaten, and one man, Guddu Dubey, known for his links to the underworld, struck Shruti to the ground. Villagers were able to intervene and the two victims were taken to Phulpur Police Station to make a report.

At the station they found that BDO Mishra had not reported the incident. Police refused to register the case or make moves to go to the scene. Left with no other option, Shruti filed a written complaint at the station and returned to the PVCHR office in Varanasi.

The village sabha of Nathaipur is consists of three ghettos i.e. Nathaipur, Tetuapat and Ahirani. Till 9th July, 2009 100 job cards issued to landless labour of Ahirani village, 13 job cards in Nathaipur. (Given data is orally presented in the meeting)

 

In Ahirani village most of the job card holders are landless and their families depend on daily wages. The impact of NREGA scheme is preventing starvation and migration of the youth.

 

On 11th September, 09 the job card holder of Ahirani village submitted complain letter to BDO, against the Rojgar Sevak. The BDO directed Rojgar Sevak, Nathaipur "several times you were taught, how to take work on hard soil. In place of following you are working against the rule, if you are unable to understand consult technician.

PVCHR highlights a case of the attack on social-conscience person by heroin mafia and local police nexus to silence him. After 13 hours of beating and intimidation, police filled first information report and then medico-legal with medical treatment, which prove absolute collapse of rule of law.

 

Case detail:

 

On 15th October, 09 Dr. Lenin Raghuavanshi went to talk with his brother Mao Raghuvanshi on the call of his mother.  His brother said a person named Mr. Turre alias Ghanshyam, resident of Nai Basti under Pandeypur, Police Chowki under jurisdiction Cantt, Varanasi, India is making pressure on him for the addition of heroin.

 

Around 9:30 PM of 15 October 2009, Dr. Lenin alone went to Nai Basti in search of Mr. Turre and nearby 12 in mid night he found his home. He called him (Turre) by giving voice. One old aged person came outside of the home holding a stick followed by other three young people. He asked what the matter is.

 

Dr. Lenin said why you are forcefully giving the heroine and after hearing this they start beating him. That time Dr. Lenin was on his bike and it fallen.  He immediately rang on 100 to call police. But no action by police to save his life.He got injured on his hand, cheek and chest. Even his watch and mobile set was broken.

 

After that he cried for help and few young people standing on the road side saved him. When Dr. Lenin returned back to his home, Pandeypur police out-post incharge ranged him. He went and submitted his application. In the morning Dr. Lenin went to Shiv Prasad Gupta Hospital for the medico – legal report with medical aid and no medico – legal report was done due to unavailability of FIR or NCR.

 

After the pressure by media to S.P City office police filled first information report (FIR). NCR no 243/09 has been lodged on 16th October, 09 at 13:30 against Turre alias Ghanshyam and three unknown people, Nai Basti, Police Station – Cantt under section 323/504/427 of Indian Penal Code (IPC).

After hearing this they start beating me. I was on my bike and it fallen. Immediately I rang on 100 and I got injured on my hand, cheek and chest. Even my watch and mobile set was broken. After that I cried and few young people standing on the road side saved me. After returning back to my home.After that Pandeypur police chowki incharge ranged me and I gave my application. In the morning I went to Shiv Prasad Gupta Hospital for the medico – legal report. It was not given due to unavailability of FIR or NCR.

Injury:

 

  1. Contusion 2 cm x 1.5 cm on the left side of the back of the head 11 cm above left ear reddish blue..
  2. Contusion on 3 cm x 0.5 cm on the left side of face 3 cm extension to left ear reddish blue.
  3. Contusion smelling 3 cm x 3 cm on dorsom of right hand just above base of right and middle and index finger. Advised X-ray and reddish blue.
  4. Contusion 3 cm x 2 cm on the left side of back 10 cm below lower end of the left scapula. Reddish 4 A blue.
  5. C/o Pain in chest but no sign of external injury seen.

 

 

Opinion: Nature simple except injury no. 3, which is KUO, advised x – ray and radiologist opinion. Duration is about more than half day old caused by some hard blunt object.

So, Dr. Lenin Raghuvanshi in the morning went to Shiv Prasad Gupta district hospital, Kabir Chaura for the medico – legal report but the doctor denied to provide medial treatment and medico – legal report and stated nothing can happened with out intervention of the police.

 

Therefore the above conversation shows the apathy of the health and police department in providing security to the Human Rights Defender. So, in this context my kind request is to lodge FIR against the perpetrator Mr. Turre and ensure the safety of Dr. Lenin Raghuvanshi.

The Children of Munshi Prem Chandra Children Parliament with the aspiration of Shakespeare of Hindi Munshi Prem Chadra organized fire crackers boycott movement in front of the district Head quarter, Varanasi on 16th October, 09 late morning. In compensanotary the children protested by sinking fire crackers in the water.

The rally started from Police line path with chanting of slogan and children were holding the plank and end up in front of the district head quarter. At District Head Quarter the congregation was facilitated by Ms. Chanda. She addressed after being implementation of child labour Abolition Act than also small children are engaged in the hazardous industry.


Jyoti stated from last nine year we are hosting the fire crackers boycott movement with in our friends and colleagues living nearby. We pledged and appeal to the people “we will celebrate diwali by lighting candle not life".

Pooja said fire cracker is being made in several part of the India like Dalmandi, Malasi, Hamirapur and Shivakasi. In this industry children are also engaged with their parents and which results the marginalization of Lakhs of children with their fundamental rights. Here we are together to protest the engagement of children.

We didn’t want this happiness on the cost of the lakhs of children’s life. The happiness attain after snatching the childhood of children. In India 1 ½ Lakhs children are employed in the hazardous fire cracker industry and are finishing their life.

Manish said the shrilling voice of fire cracker and gas is adversely affecting the atmosphere which contributes in sound and air pollution. He urge not to lit fire cracker for the protection of the environment. He added we are unhappy that my friend Shiv home is being demolished.

The members of Children Parliament Master Manish, Kissan, Pramila, Rinka, Sulekha, Kusum, Seema, Pinka, Jyoti, Chanda and Puja. Hema. Rajendra, Rekha, Neeta, Katyani, Ashok, Anup, Rohit, Anand, Shruti, Dr. Lenin and Upendra were present from PVCHR office.

VARANASI: Just a day before Diwali â€" the Festival of Light and Prosperity â€" the world will celebrate World Food Day on Friday. This year's theme is 'achieving food in times of crisis'.

For food security to all, the World Food Day is celebrated annually on October 16, the date of founding of the Food and Agriculture Organisation of the United Nations in 1945.

But, in Varanasi, the darker side is that a number of people including children are deprived of adequate food and proper nutrition. Though, the department of food and civil supply claims proper supply of food grains to below poverty line (BPL) and Antyoday families, records of the district administration clearly indicate that malnutrition exists among children, despite various government-run programmes and schemes.

The district administration had conducted a survey to identify malnourished children. Workers of all 2,529 Anganwadi centres were engaged for the purpose. According to records, over 3,000 severely malnourished children (in grade III and IV) were identified in the district by April last. As many as 78,802 children, out of 2,06,672, were found normal in weight according to their age, while 68,697 children were found suffering from PEM grade-I of malnutrition. Besides, 56,094 children were grade-II category malnourished and 3,073 children in grade-III and IV category. In 2008 five malnourished children died in Dhannipur village in Lohata.

Besides, according to a study conducted by a group of doctors, including TB Singh, RN Mishra, CP Mishra and P Sen of the Institute of Medical Science, Banaras Hindu University (BHU), about 75 per cent of pre-school children of under five-year age group living in urban slums are malnourished while 20 per cent of them are suffering from severe degree of malnutrition. The observation is based on a study on nutritional status and dietary intake of pre-school children in urban slums of Varanasi, which has 227 slums with a population of about 453,222 (about 37.69 per cent of the total population). The city development plan of the Jawaharlal Nehru National Urban Renewal Mission (JNNURM) suggests that the average income of a slum household ranges from Rs 100-150 per day.

Such a situation is prevailing when the government is running programmes like Integrated Child Development Services (ICDS), handloom cluster development scheme for weavers, and National Rural Employment Guarantee Act (NREGA) (also now known as Mahatma Gandhi Rural Employment Guarantee Act) for poverty alleviation.

According to Dr. Arvind Singh of Comprehensive Child Survival Programme run under the National Rural Health Mission (NRHM) and UNICEF, malnutrition is prevalent in the eastern UP, and majority of women are anaemic. According to government report more than half of the population of women in eastern UP was anaemic, he said. The factors like price rise and drought have made the situation worse for the people living below poverty line. They cant afford to feed their families properly, said Dr. Lenin Raghuvanshi of Peoples Vigilance Committee on Human Rights (PVCHR).

On the other hand, AK Singh, additional commissioner (food), claims that the food grain supply is 100 per cent to BPL and Antyoday families. According to him, a quantity of 15,400 MT wheat per month is allotted for the people of four districts of the division including Varanasi, Chandauli, Ghazipur and Jaunpur. Besides, in view of the drought, additional quantity of 15,400 MT wheat has been sought as drought relief for the APL families of the division from September 2009 to March 2010. Owing to poor monsoons, the paddy farming was adversely effected in the region. "However, only 648 MT additional wheat has been received so far for five months from September 2009 to January 2010 for Ghazipur, Jaunpur and Chandauli districts," said Singh.

"The Central government has also sought proposals from the states in view of the proposed Food Security Act," Singh told TOI on Wednesday adding "the proposals have been forwarded, seeking expansion of targeted families for food coverage." About 30 per cent increase in targeted families has been proposed. According to him, about 1.29 lakh BPL/Antyoday families are covered in Varanasi district while this number in the state is one crore six lakh. To prevent starvation like situation, regular monitoring is done to include and exclude new families under BPL/Antyoday coverage.
