PVCHR highlights a case of the attack on social-conscience person by heroin mafia and local police nexus to silence him. After 13 hours of beating and intimidation, police filled first information report and then medico-legal with medical treatment, which prove absolute collapse of rule of law.

 

Case detail:

 

On 15th October, 09 Dr. Lenin Raghuavanshi went to talk with his brother Mao Raghuvanshi on the call of his mother.  His brother said a person named Mr. Turre alias Ghanshyam, resident of Nai Basti under Pandeypur, Police Chowki under jurisdiction Cantt, Varanasi, India is making pressure on him for the addition of heroin.

 

Around 9:30 PM of 15 October 2009, Dr. Lenin alone went to Nai Basti in search of Mr. Turre and nearby 12 in mid night he found his home. He called him (Turre) by giving voice. One old aged person came outside of the home holding a stick followed by other three young people. He asked what the matter is.

 

Dr. Lenin said why you are forcefully giving the heroine and after hearing this they start beating him. That time Dr. Lenin was on his bike and it fallen.  He immediately rang on 100 to call police. But no action by police to save his life.He got injured on his hand, cheek and chest. Even his watch and mobile set was broken.

 

After that he cried for help and few young people standing on the road side saved him. When Dr. Lenin returned back to his home, Pandeypur police out-post incharge ranged him. He went and submitted his application. In the morning Dr. Lenin went to Shiv Prasad Gupta Hospital for the medico – legal report with medical aid and no medico – legal report was done due to unavailability of FIR or NCR.

 

After the pressure by media to S.P City office police filled first information report (FIR). NCR no 243/09 has been lodged on 16th October, 09 at 13:30 against Turre alias Ghanshyam and three unknown people, Nai Basti, Police Station – Cantt under section 323/504/427 of Indian Penal Code (IPC).

I, myself approximately at 9:30 pm went in search of the place around 12 am I found his home. I called him (Turre) by giving voice. One old aged person came outside of the home holding a stick followed by other three young people. He asked what the matter is. I answered why you are forcefully giving the heroine. After hearing this they start beating me. I was on my bike and it fallen. Immediately I rang on 100 and I got injured on my hand, cheek and chest. Even my watch and mobile set was broken. After that I cried and few young people standing on the road side saved me. After returning back to my home.After that Pandeypur police chowki incharge ranged me and I gave my application. In the morning I went to Shiv Prasad Gupta Hospital for the medico – legal report. It was not given due to unavailability of FIR or NCR.

Dr. Lenin was examined in Shiv Prasad Gupta Hospital on 16th October, 09 at 3:40 pm, the medico – legal report is as follows:

 

Injury:

 

  1. Contusion 2 cm x 1.5 cm on the left side of the back of the head 11 cm above left ear reddish blue..
  2. Contusion on 3 cm x 0.5 cm on the left side of face 3 cm extension to left ear reddish blue.
  3. Contusion smelling 3 cm x 3 cm on dorsom of right hand just above base of right and middle and index finger. Advised X-ray and reddish blue.
  4. Contusion 3 cm x 2 cm on the left side of back 10 cm below lower end of the left scapula. Reddish 4 A blue.
  5. C/o Pain in chest but no sign of external injury seen.

 

 

Opinion: Nature simple except injury no. 3, which is KUO, advised x – ray and radiologist opinion. Duration is about more than half day old caused by some hard blunt object.

It is noted that Dr. Lenin informed to the office of Director General of Police at 1:44 am of 16th October, 09 and DGP office started the inquiry. Letter was sent to National Human Rights Commission, Director General of Police and Director of Department of Health Services, Lucknow on the apathy of the police and health department.

This is to bring in your kind consideration that Dr. Lenin Raghuvanshi, Convener of Peoples' Vigilance Committee on Human Rights (PVCHR), SA 4/2 A Daulatpur, Varanasi was beaten by Mr. Turre a drug Mafia's in Nai Basti, Pandeypur, Varanasi on 16th October, 09 around 12:30 am. At same time he went to Pandeypur police chowki to lodge FIR but police took the complain letter and no action taken by the police.

 

So, Dr. Lenin Raghuvanshi in the morning went to Shiv Prasad Gupta district hospital, Kabir Chaura for the medico – legal report but the doctor denied to provide medial treatment and medico – legal report and stated nothing can happened with out intervention of the police.

 

Therefore the above conversation shows the apathy of the health and police department in providing security to the Human Rights Defender. So, in this context my kind request is to lodge FIR against the perpetrator Mr. Turre and ensure the safety of Dr. Lenin Raghuvanshi.
