My final words of advice to you are educate, agitate and organize; have faith in yourself. With justice on our side I do not see how we can loose our battle.. The battle to me is a matter of joy. The battle is in the fullest sense spiritual. There is nothing material or social in it. For ours is a battle not for wealth or for power. It is battle for freedom. It is the battle of reclamation of human personality….
Dr. B.R.Ambedkar

Testimony of Mukhtar Ahmed (father of deceased Moin Akhtar)

(Taken by Mr. Upendra Kumar under the pilot project "Capacity Building of Testimonial Therapy in India" with the joint venture of PVCHR and RCT)

I Mukhar Ahmed live in N 12/29 Bazardeeha Varanasi. I am citizen of India.  Earlier I weave sari, but after plight, I nourish my family with the small provision grocery shop.

On 11th March, 09 Mata Prasad hold Matkafod in front of his house. Hindu brother from Bazardiha, Khojawa, Patiya and Sudamapur gathered there. They burst Matki (small earthen jar) at 10:30 in the morning.  The procession moves off to Kohlua mosque in the emissary of BJP member Mr. Vijay Viswakarma. They fling dirt, colors and wine bottle and roared slogan "denigrate Pakistan and denigrate Islam." What we have to do with Pakistan, we are Indians but on denigrate Islam community people were silent as the demonstrators were drunk.

The situation was repeating from last three years. Earlier we wipe color as the precautionary measure to maintain the communal harmony. But this year it was excessive which hearted the elder people.

I was sipping tea and my elder son Moin went to purchase soap and shampoo. I heard the conversation and moved to know the reason.  I stand with other 300 – 400 people. Few elder people asked to the 25 – 35 policemen posted near Mosque "In your presence how the color and dirt fling on mosque. Bazardeeha police outpost incharge Mr. Shamsher says, oh leave it, what happened if they did so?

Elderly people demands for the arrest of the people involved. Shamsher Singh with green – eyed and angrily tell off, "go away otherwise I will break your leg, mob warn to surround police outpost if the demonstrator is not arrested.

Ignoring the conversation police precedes to the place of the matkafod and we also followed them and again put our demand for the arrest. Again he threat in the policing behavior. Meanwhile a stone from the Mata Prasad house hit on the solder of one police and the angered policemen start broking his door.  In wee another stone from opposite side hit the wall. Agitated policemen and Shamsher Singh, police check post incharge started firing. They were not ordered for the firing neither we got prior alarm. I with 25 – 30 people hid myself in the mosque, due to immediate police firing.

My son Moin was running alone. I tried to pull him in the mosque but he moved few step ahead. I was staring him from the aperture.  I was feeling powerless from inside. I started praying for his life with heavy heart.  One policeman says to Moin by abusing him, "what are you doing here, go away, hearing this I felt reinvigorate and thought my child is saved. With open eyes I saw Shamsher Singh fired and it hit on his right chest. He ran and fallen in the gallery.  I vigorously cried, I was restlessness and did not know what to do and thinking he is dead or alive. I bitterly started crying and people start consoling me. I saw in mobile it was 11 am and my son died after few minutes.

Though we rushed to Janta hospital but he was declared dead. My younger son Mobin with other 4 neighbours took the body of Moin to his uncles' house in Rewari Talab. Policemen came after looking the mob and took Moin's body in his custody for the postmortem.

After bringing Moin's body to home, police were in numerous than the public in front of my house. Police was pressurizing for immediate burial of my son killed in the firing in presence of them, the burial place at around 5.30am.

In the air firing two were killed and eight mischievous were injured, who were throwing stone from the roof.

Still the hapless survivors of Bazardiha police firing have not been given any compensation and justice

Pushed to the corner, survivors of the police firing are languishing in penury. As Nisar Ahmed says." I was sole bread earner for my family. Now it's quite difficult to get a square meal a day. Police fired ruthlessly on my right arm and left arm pit. One bullet pierced through my ankles. I suffer from excruciating pain and I have no money to purchase medicines."

Incapacitated Abdul Rehman recounts, "Bullet pierced through my left thigh and turned me into a physical wreek. Neighbours showed their generosity and my operation was possible. Still a bone grafting needs to be done. After that I can walk on my own without being dependent on the crutches.

People’s tribunal on condition of UP Muslim weavers in Varanasi tomorrow

People's tribunal on condition of UP Muslim weavers in Varanasi tomorrow

Submitted by admin3 on 17 November 2009 - 9:51pm.

By Mumtaz Alam Falahi, TwoCircles.net,

New Delhi: Globalization, inflow of Chinese fabrics and technical advancement have left about two lakh Muslim weavers in Uttar Pradesh jobless. A good number of them resorted to rickshaw pulling by taking rickshaw on loan from bank. Many could not repay the loan and committed suicide. In this background human and civil rights groups are holding people's tribunal on the socio-economic and educational conditions of the state weavers and artisans on November 18 in Varanasi.

The tribunal will be chaired by Ms. Sayeda Hameed, Member, Planning Commission of India. The report of the tribunal will be sent to the Prime Minister through Ms Hameed.

Giving details to TwoCircles.net, Dr. Lenin Raghuvanshi, Convener, People's Vigilance Committee on Human Rights (PVCHR), one of the organizers of the "People's Tribunal on situation of Education and development among Muslim Weavers and Artisan", said weavers and artisans from Varanasi, Tanda, Azamgarh, Mau and Ghazipur districts of UP are attending the tribunal. Poor and neglected people from the Muslim community, who are not weaver by profession, have also been invited to the program.

"We are working for implementation of the PM's 15-point Program that has provisions for economic and educational development of the minority community and this section of people especially, in this part of the state. We are also working for measures to check communal riots that often take place in Varanasi and other areas," said Dr Lenin.

Besides PVCHR, other groups holding this joint tribunal are Voice of people (VOP), Bunkar Dastakar Adhikar Manch (BDAM), Nalanda, a local Muslim group, and Citizen Front.

About socio-economic and educational conditions of Muslim weavers in Varanasi, Dr Lenin said: Their condition here is very worse. About 1.5-2 lakh weavers are no longer weavers by profession. We help poor people get rickshaw on loan from bank for livelihood. In Varanasi, 40% of such loanees from Punjab National Bank were weavers in the past. Their pockets are devoid of basic civic amenities. The trade of power loom and handloom is in danger of getting extinct. In Varanasi there are 40% Muslims, of them 70% are in the trade of weaving.

Asked about the reasons of this situation, Dr Lenin said the government did not plan to rehabilitate the traditional weavers and artisans when technological advancement was coming. Also, Chinese fabrics are inflowing and this has virtually destroyed the power loom and handloom sector.

Has the government woken up to the reality and is now doing for the poor weavers and are their schemes of central or state government for these people in Varanasi?

"Yes, the government has launched cluster scheme. They have also waived the electricity due of power looms but not of handlooms. Handlooms workers and owners are in heavy debt. Many have committed suicide," said Dr Lenin. In their pockets there is no scheme for nutrition of children, consequently many children are dying of malnutrition, he added.

Is the tribunal going to hear some specific cases of Muslim weavers?

The victims of the police firing in Bajadeeha in Varanasi around Holi will testify. The police had opened fire killing two Muslim youths and injuring eight others. The riot was just averted. This was one sided action. No action against those defaced mosques was taken. The victim families are very disturbed. We will also raise the case of death of five weaver family children due to malnutrition.

What will be their next step after holding the people's tribunal?

"We will send our report to the PM through Sayeda Hameed. We will impress upon politicians and parliamentarians to raise the issue in Parliament," said Dr Lenin.

Background information:

Parents' Forum for Meaningful Education challenged the legality of corporal punishment in schools. The Petition succeeded and the Court, in a judgment delivered on December 1 2000 directed the State to ensure "that children are not subjected to corporal punishment in schools and they receive education in an environment of freedom and dignity, free from fear".

The historic judgement delivered on Dec., 1st 2000, almost 3 years later held rule 37 (1) (a) (ii) and (4) of the Delhi Education Act & Rule 1973 as violative of Article 14, 21 of the Constitution and accordingly struck down. It once again draws our nation's attention to the importance a child deserves:

"Child being a precious national resource is to be nurtured and attended with tenderness and care and without cruelty. Subjecting the child to corporal punishment for reforming him cannot be part of education."

The Honb'le judges have categorically emphasized the constitutional rights of a child as guaranteed in Article 21 which runs counter to the practice of CP.

"Freedom of life and liberty guaranteed by Article 21 is not only violated when physical punishment scars the mind of the child and robs him of his dignity. Any act of violence which traumatizes, terrorizes a child, or adversely affects his faculties falls foul of Article 21 of the Constitution.

The honourable judges view the provisions of the Delhi Education Act in the light of the Indian Constitution, National Policy of Education (NPE) and Convention on the Rights of the Child (CRC), adopted by the UN and signed by India in 1992. They find that Article 14, 21, 39 of our Constitution are in consonance with NPE and the provision of CRC which set out at great length the rights of children. The judges, after citing these provisions at considerable length sum up as under:

… in a nutshell the thoughts which pervade the various Articles of the Convention are basically protection of the child from all forms of physical or mental violence, injury, neglect, exploitation, abuse, torture or any other form of cruel, inhuman or degrading treatment or punishment and adoption of means for the welfare of the child in every conceivable way and preservation of dignity of the child. (p.11)

The judgement focuses on the long term consequences of corporal punishment.

"The fallout of physical force on the children in schools by teachers defeats the very purpose for which it is applied. Infliction of bodily pain as penalty for indiscipline by the children. Some children may become submissive while others may learn that punishment is an accepted mode of ensuring compliance of one's wishes by others and that physical violence is an accepted means of exercising control over them. With the latter class of subjects, violence becomes means to acquire what they wish."

It not only perpetuates but inculcates violence in children as the judgement observes.

Thus violence becomes an integral part of their lives. It is difficult to imagine the future of a nation whose children believe in violence for subjugating others or being submissive to force. Brutal treatment of children can never inculcate discipline in them. Obedience exacted by striking fear of punishment can make the child adopt the same tactics when he grows up for getting what he wants. (p,16)

The judgement noted the anti-educational effects of CP denying right to education.

"Children who are ruled by the rod in school may acquire disdain and hatred for their teachers. Beating affects their concentration in studies and leads to development of fear psychosis towards learning. Fear of corporal punishment discourages regular attendance at schools and increases dropout rate. This obviously hampers and obstructs education and affects their right to education, which is a fundamental right flowing from Article 21."

CP is not in keeping with child's dignity, observed the judgement.

"It also appears to us that corporal punishment is not keeping with child's dignity. Besides, it is cruel to subject the child to physical violence in school in the name of discipline or education.

The judgement refocuses the objective of the nation,

"The child has to be prepared for responsible life in a free society in the spirit of understanding, peace and tolerance. Use of corporal punishment is antithetic to these values."

If we want our country to move in the direction of a peaceful and well ordered society, we have to begin by building on such values from early childhood. The judgement cites Gandhiji's insight in this regard:

"If we are to reach real peace in this world, and if we are to carry on a real war against war, we shall have to begin with children, and if they will grow up in their natural innocence, we won't have to struggle, we won't have to pass fruitless idle resolutions, but we shall go from love to love and peace to peace, until at last all the corners of the world are covered with that peace and love for which, consciously or unconsciously, the whole world is hungering. (quoted, p. 17)."

Dismissing the concept of a school discipline based on physical punishment as untenable and outdated, the judgement concludes as follows:

"In view of the forgoing, the writ petition succeeds. The rule is made absolute. Rule 37(1)(a)(ii) and (4) of the Delhi School Education Rules, 1973, is held to be violative of Article 14 and 21 of the Constitution and is accordingly, struck down.''

It also directs the state to ensure that "children are not subjected to corporal punishment in schools and they receive education in an environment of freedom and dignity, free from fear. (p.22)"

Weavers of Lohta in Varanasi at German Radio

http://www.dradio.de/dlf/sendungen/einewelt/1069862/

India Weber vor dem Aus By Achim Nuhr India is emerging as an economic power, poverty and hunger in the country are still pervasive. For seven years, the proportion of undernourished children in India is growing even again significantly and currently stands at 53 percent of all children. The district on the outskirts of Varanasi Lothario at first looks like a slum: The walls of the houses are made of exposed-brick, many of whom are under way dark or greenish. Iron beams jutting from the walls and roofs. The roads are not paved, malaria mosquitoes breed in puddles and the lawns between the houses are littered with garbage. Here to stay primarily Weber. But the people must one day be gone better: Because the houses are built of stone, not from boxes or cans, as is common in Indian slums. Electricity pylons and cables neatly moved testify that people relate to their current legal, rather than tap into power cables. However, no one seems to relate more power, even light bulbs remain unused, instead, in most homes burn candles. Also in the Driess by Mohamad: "Until ten years we have lived Weber well. We were able to sell our products at a profit. We have eaten three times a day and take good clothes. But in ten years it is all downhill: Today we can hardly earn a dollar a day. We no longer have enough to eat. And what should I do if my children need time to see a doctor? " Mohamad looks bad: skinny body, emaciated face, which affects the nose oversized. He sits beside his hand-loom, which he has laid his hands on his lap. For a long time he has done nothing. And what he's going to feed his family, he did not know either. As Mohamad is now many weavers in Lothario, or in other neighborhoods weavers of Varanasi. Most of the looms stand still, to many lies a thick layer of dust. There is unemployment, grinding poverty. But this was not always so. For centuries, the weavers were able to survive on its handmade silk saris, which were sold throughout the country, quite well. The demand and sales in the country were good. Many products from the Weber metropolis were also exported abroad. But those days are over. Now there is famine - a fight for survival. And not everyone succeeds. The latest victim was a two-year Mohamad's son. His mother could not breast feed him after the birth, because she herself was too hungry. Finally, there was a lack of red blood cells to the baby - a typical, life-threatening symptom of starving people. Mohamad writhes on his stool. The memory of the tragic death of his son and that he could not help him, caused him pain. "He could take nothing more to it, neither food nor drink. We took him to hospital. The doctor said he needed a blood transfusion. But my wife and I were too weak to donate blood. I still need to cry today when I think that I could give my own son, no blood. The neighbors tried to help us. They collected money for a treatment: around eight euros. But it was too late. "My son died the same day. " Varanasi has approximately 1.2 million inhabitants. The city is located in north-eastern India and is internationally known as a religious center which countless pilgrims to the banks of the holy river Ganges, attracts, and just as the center of the weaving. Almost half the population is economically dependent on the textile industry. But as the market for handmade silk saris ever shrank and eventually collapsed completely, there was no alternative for them. The weavers were left alone in their struggle for survival. The responsible politicians and administrators tried to banish famine and misery in the Walker district. Official information about starving or even starving citizens still do not exist. But then the media reported about the fate of the weavers of Varanasi. And so the death of Mohamad's son did not go unnoticed: "Even before the death of my son's newspaper journalists and TV reporters were present in the area. You've visited us here and then reports on the famine among the weavers. Suddenly came in the wake of the City manager to us personally over. It was he who initiated, that my son could be made shortly before his death at all to the hospital. For the eight euro, had collected our neighbors were not sufficient. The doctor was very disrespectful though: He beat me even in the face and yelled at me that I should Kindly give my son to eat, so he does not die. I would have done that very much. But we had nothing to eat. " For centuries, the Indian government to protect the traditional Weber: Up to the 90s, she granted them a monopoly for 22 popular types of clothing, such as the traditional silk saris for brides could only be manufactured here. International Importers thwarted by high protective tariffs, which was protected by the Indian market. Then came the economic reforms: protection rules and rights have been removed, under the heading of "bureaucracy". Many of protective tariffs have been sharply reduced or completely disappeared. The small weavers who were previously long been completely sealed off from the world market, delivered to him were suddenly almost defenseless. KP Berma, deputy director of the Center for Hand Weaving, it looks different, however: "When a weaver's really good, he still has enough money and food. Only he who is not well developed, has problems. Okay, some weavers have committed suicide. But there is no single, which had had nothing to eat. In Varanasi There is no nutritional problems. There is only a few social problems, diseases and other ailments. " KP Berma advised to speak with the "really good weavers", for example, with Aftaba Alam. Weber, who also lives in the District Lothario, just a few blocks from the family Driess. The first impression is good: in the family hut, there are four looms and two will even work. Mr Alam confirmed for his family business at first a positive trend: "A year ago we could hardly afford one meal a day. Now we eat three times a day and slowly again. We now take vitamin D pills. Therefore, my children develop into good again. But from a normal state here in Lothario, one can not but speak. That would only happen if all parents could feed themselves and their children back then. " Mr. Alam has just a lucky streak. His family is traditionally produces high quality Patolasaris and have evolved over the past few months, the latest fad: the new rich in India scramble for them. Only six months ago they were still saris as shop keepers. But really happy Alam has no effect anyway. He knows: Who counts in the new times, just to the winners, may tomorrow be back on the losing side. "We're doing at the moment so well because we produce in the latest fashion. But at some point over too. The market can turn at any time and we will be hungry again, as our neighbors."
