These proceedings shall be read in continuation of the
earlier proceedings of the Commission dated 28.05.2013. On 28.05.2013, the
Commission observed and directed thus: "Accordingly the Commission
recommends an additional amount of Rs.4,00,000/- (Rupees Four Lakhs only) to
be paid to the next-of-kin of the diseased. Principal Secretary, Health &
Family Welfare Department, Government of Kerala, be directed to intimate the
progress of the Departmental Enquiry against the errant public
servants". Pursuant to the directions of the Commission, the Principal
Secretary, Health & Family Welfare, Govt. of Kerala, submitted a report
dated 14.08.2013. The report revealed that Departmental Enquiry has been
finalised against the errant officials of General Hospital, Kasargod and Dr.
Narayana Naik and Dr. Vasanthy K., Junior Consultant have been barred of one
increment without cumulative effect for one year as per Government Orders.
The Dy. Secretary, Govt. of Kerala, Health & Family Welfare (G)
Department, submitted a report dated 27.09.2013 alongwith a report of the
Principal Secretary to Govt., Health & Family Welfare Department, Govt.
of Kerala, dated 14.08.2013. The report revealed that Next-of-Kin of Kumari
Prajitha, has been paid a sum of Rupees 5,00,000/- (including Rs. 4,00,000/-,
recommended by the Commission) in instalments i.e. Rupees one lakh on
22.08.2011, Rupees 1.5 lakhs on 08.12.12 and Rupees 2.5 lakhs by way of
Demand Draft on 16.07.2013. The Commission perused the record and observed
that report of Govt. of Kerala has paid the compensation to the Next-of-Kin
of the deceased Kumari Parajitha and the erring doctors of the Govt.
Hospital, have been penalised, Hence the Commission is not inclined to
proceed further in the matter. The case is closed. A copy of these
proceedings be forwarded to the mother of the deceased at the address
available on record.
