Breaking culture of impunity and silence in case of extrajudicial killings in Telengana,India

NHRC order in case of 422/36/7/2015-ad:

 Families of five victims of extrajudicial killing  received twenty hundred thousands Indian rupees (twenty five lakhs). 

The matter relates to the death of five Under Trial Prisoners, namely, Syed Amjad, Vikaruddin Ahmad, Mohd. Zakir, Izar Khan and Mohd. Haneef who were allegedly shot dead by the policemen in the escort party at the outskirts of Tanguturu Village in Aler Mandal of Nalgonda District on 07 April2015 while they were being escorted to Hyderabad from Warangal Prison in connection with appearance in court in Hyderabad.

Vide its proceedings dated 12.09.2018, the Commission while considering entire material on record and reiterating its earlier recommendations directed the Govt. of Telangana to pay a sum of Rs. Five Lakhs as monetary compensation to the NoK of each of five deceased persons viz. Izhar Khan, Syed Amjad Ali, Mohd. Haneef, Mohd. Zakeer and Vikaruddin Ahmed, allegedly shot dead by the police at outskirts of Village Tanguturu in Aler Mandal of District Nalgonda on 07.04.15. The Chief Secretary, Govt. of Telangana was directed to submit compliance report along with proof of payment within four weeks.

Vide Commission's letters dated 12.07.2018 and 09.10.2018 followed by reminders dated 16.01.2019 and 04.06.2019 the Chief Secretary, Govt. of Telangana was requested to send compliance report along with proof of payment, but the same has not been received so far.

Chief Secretary, Govt. of Telengana vide communication dated 26.06.2019 has submitted that the recommendations of the NHRC has been submitted to the competent authority for orders and the same is awaited which may take some time. A prayer was made to grant three months time for taking necessary action in the matter. No further communication has been received thereafter.

The Chief Secretary, Govt. of Telangana is directed to ensure that monetary compensation of Rs. Five Lakhs each is paid to the send compliance report along with proof of payment as to the NoK of each of five deceased persons namely Izhar Khan, Syed Amjad Ali Mohd. Haneef, Mohd. Zakeer and Vikaruddin Ahmed within four weeks positively. The Chief Secretary, Govt. of Telengana shall submit compliance report along with proof of payment. On receipt of proof of payment, the registry shall make necessary entries in the CMIS. With these directions, the case is closed along with linked cases No. 370/36/7/2015-AD, 377/36/7/2015-AD, 389/36/7/2015-AD, 406/36/7/2015-AD, 422/36/7/2015-AD, 425/36/7/2015-AD, 428/36/7/2015-AD, 431/36/7/2015-AD, 432/36/7/2015-AD, 433/36/7/2015-AD, 434/36/7/2015-AD, 435/36/7/2015-AD, 473/36/7/2015-AD, 485/36/7/2015-AD and 683/36/7/2015-AD.

The video cassette/CD of autopsy, if any, may be sent to the concerned authority.
