NHRC issues bailable warrants against health department of Madhya Pradesh

Direction issued by the CommissionThese proceedings are in continuation of the Commission's detailed proceedings dated 17.12.2012 vide which it ordered issuance of summons against the Secretary, Department of Health, Government of Madhya Pradesh. The summons was required to be served through the Chief Secretary of the State. The summons was sent to the Chief Secretary by Speed Post, which was not received back undelivered. Hence, the Commission presumed that summons was served upon the Health Secretary. However, the Health Secretary did not appear before the Commission on 16.01.2013. The Commission vide proceedings dated 14.02.2013 requested the Secretary General to contact the Secretary, Department of Health, Government of Madhya Pradesh, and ask him to respond to the Commission's notices within four weeks positively, failing which the Commission may invoke its power to issue bailable warrants against him under Order 16, Rule 10(3) C.P.C. Accordingly, the Secretary General sent a DO letter dated 15.03.2013 to Shri S.R. Mohanty, Secretary (Health & Family Welfare), Government of Madhya Pradesh. The DO letter has been received back undelivered with the remarks "The addressee refused to accept and Incharge of the Department is not with him, hence returned". In the meanwhile, Additional Director (Administration), Directorate of Health Services, Madhya Pradesh, has endorsed to the Commission a copy of the communication dated 15.03.2013 addressed to Dr. Rajender Singh, Divisional Joint Director, Health Services, Rewa Division, requesting him to submit a report in the matter to the Commission. However, no further communication has been received thereafter. Dr. Rajender Singh, Divisional Joint Director, Health Services, Rewa Division, Rewa Madhya Pradesh, is directed to submit report in the matter within four weeks positively. A copy each of the complaint and communication received from the Additional Director (Administration), Directorate of Health Services, Madhya Pradesh, be sent alongwith the notice.
