Direction issued by the Commission Dr. Lenin, General Secretary of the 'PVCHR', has drawn the attention of the Commission to the incident of loot and arson of the property of the people belonging to a particular community in the areas of Naliakhali, Heerobhanga, Gopalpur and Goaldogra in the State of West Bengal. As per the complaint, on the intervening night of 18/19-2-2013, Maulvi Rohul Kudas was attacked by some unknown persons at Naliakhali Road while he was returning home on his motor cycle with on Abdul Wahab after attending a religious function. He died at the spot. A rumour spread that members of the RSS were involved in the attack. Thereafter, the incident of arson and looting took place in the four villages under police station Canning. About 200 houses belonging to Hindu community were torched and people were attacked. Pursuant to the direction of the Commission, the Director General and Inspector General of Police, West Bengal, has forwarded a report of the Addl. SP (East), South 24 Parganas. A Special Secretary to the Government of West Bengal Home Department, Human Rights Branch, has also forwarded report of the District Magistrate, South 24 Parganas. These reports confirm the incident. It is further stated that the unruly mob set on fire 121 houses, 27 shops and 120 families were affected. A case vide FIR No. 85/13 dated 19.02.13 for rioting etc. was registered at police station Canning. 28 accused persons have since been arrested and further investigation in the case is in progress. It is further stated that on the murder of Shri Kudas, FIR No. 84/13 dated 19.2.2013 u/s 394/302/307/153A IPC and section 25/27 of Arms Act was registered. It has been found that it was a case of robbery and murder. Five accused persons have been arrested in this case. The report of the District Magistrate also enumerates the relief measures taken, which are as under:- (i) The State Government decided that all houses would be restored to their original state and a committee was formed for this purpose under the chairmanship of the SDO, Canning, to oversee this work. An amount of Rs. 2,87,12,000/- has been provided by the Government and work is on completion stage. (ii) Gruel kitchen was started at the spot which fed around 500 persons daily and it functioned till 20.3.2013. (iii) A house building grant of Rs. 10,000/- was disbursed to 117 households on 21.2.2013. (iv) A rehabilitation grant of Rs. 10,000/- each was disbursed to the owners of the 26 shops gutted in the incident. (v) A set of utensils has been provided to each victim family. (vi) A sum of Rs. 3,00,000/- has been paid to the family of the deceased Maulana Rohul Kudas. The Commission has carefully considered the reports abovementioned. It is unfortunate that a rumour gave rise to incident of arson and looting which affected so many people of a particular community. The Government of West Bengal appears to have taken care to provide adequate relief to the affected people. Hence, in the facts and circumstances of the case, no further intervention of the Commission in the matter is required and the case is closed.
