13 lakhs compensation to survivors: first step of breaking of silence

13 lakhs compensation paid to the survivors. But in these two cases PVCHR wrote to NHRC regarding the action against the police officials.

These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 17.6.2013. In response, the Superintendent, District Jail, Depria, U.P., vide its communication dated 19.7.2013, has submitted the report. Perusal of the same reveals that an amount of Rs.3,00,000/- (Rupees Three Lakhs only) as recommended by the Commission, has already been remitted electronically to the account of District Magistrate, Deoria, U.P., on 18.7.2013 for disbursement to the next of kin of the deceased Ram Bachan. The Joint Secretary, Prison Administration & Correctional Department-III, government of U.P., vide communication dated 29.8.2013, has informed the Commission that the District Magistrate, Deoria has been asked to submit the proof of payment made to next of kin of the deceased. It has also been stated that the Special Secretary, Medical Department-III, Government of U.P., Lucknow, has also been asked to submit the details of departmental action taken against the delinquent Medical Officer Dr. Bharat Singh in the matter. The proof of payment and details of departmental action taken against the delinquent Medical Officer are, however, still awaited. The Commission has considered the matter. Despite sufficient time and opportunity having been given, the requisite reports have not been received. In these circumstances, let summons be issued for the personal appearance of District Magistrate, Deoria, U.P. and Special Secretary, Medical Department-III, Government of U.P., before the Commission on 15.10.2013 at 11.00 A.M. along with the requisite reports. In case the reports are received on or before 8.10.2013, the personal appearance of District Magistrate, Deoria, U.P. and Special Secretary, Medical Department-III, Government of U.P., shall stand dispensed with.

This proceeding shall be read in continuation of the earlier proceeding of the Commission dated 13.12.2012. Pursuant to the show cause notice issued by the Commission u/s 18 (a) (i) of PHRA Act 1993, a report dated 20.2.2013 has been received from the Joint Secretary, Home (HR) Department, Government of Rajasthan, Jaipur, enclosing therewith a report of SP (Civil Rights), Police Headquarters, Rajasthan. It is intimated that a sum of Rs. 10 lakhs has been paid to the victim lady by the Collector, Pratapgarh, vide cheque no. 531165 dated 18.5.2011 from the Chief Minister's Relief Fund. However, a copy of the receipt of the cheque or payment has not been enclosed with the report. The DM and SP, Pratapgarh, Rajasthan, are directed to send within four weeks, a photocopy of the receipt obtained from the victim lady regarding payment of Rs. 10 lakhs to her by cheque.
