Charge sheet in FIR No. 1300/19 u/s 304A IPC has been filed before the Court. Monetary compensation of Rs. 10 lakhs has been provided to the family of each of the victims.

Procceeding: The Commission received a complaint dated 23.08.2019 from Lenin Raghuvanshi, a resident of Varanasi, UP alleging strict action to be taken against the concerned erring officials. As per the complaint, the victims are the residents of Bihar and had to clean a sewer line which was set up by the Water Department. It is alleged that since the sewer line was closed, toxic gases had formed up which the victims were unaware of. The victims were also not provided with any safety gear. It is alleged that since the victims went down the sewer line to clean it up, they succumbed owing to the toxic gas. The complainant has thus sought for the intervention of the Commission to take requisite action in this regard. In response to notice issued by the Commission, a report dated 26.11.2019 has been submitted by Chairman, UP Jal Nigam stating therein that during construction of a sewer line under the Ghaziabad Sewerage Scheme five labourers had died. During the enquiry it came to the fore that the construction was being carried out by M/s EMS Infracon Private Limited and M/s Technocraft Construction Private Limited under the supervision of Executive Engineer. Further it also came to the fore that the construction firm had not provided any safety gear to the victims. FIR No. 1032/19 has been registered against the site in-charge, M/s EMS Infracon Private Limited and M/s Technocraft Construction Private Limited. Further one of the employees of M/s EMS Infracon Private Limited has filed an FIR against the proprietor of M/s EMS Infracon Private Limited. Disciplinary proceedings have been initiated against four govt. employees and all of them have been placed under supervision. Charge sheet in FIR No. 1300/19 u/s 304A IPC has been filed before the Court. Monetary compensation of Rs. 10 lakhs has been provided to the family of each of the victims. Instructions have been issued by Jal Nigam to ensure any such untoward event happening in future. The Commission has perused and considered the report. Since the requisite action in this regard has already been taken, no further intervention of the Commission seems to be necessary. The report is thus taken on record and the case is closed.
